The City Engineer reported as follows on Peti-tion for sideteack From the VanDalia Railway
tra-ek in the public alley between Main a -,d lafayette Streets end Sample and Garst Streets.
To the Hon. Board of Pub -lie Works,
of the City of South Bend, Indiana-
Gentlemen:-
I have investigated the petition of Jacob Reamer relative, to the placing of
a side track in the alley west of Main Street from Sample Street` to Garst Street.
The construction of this track would so obstruct the alley that it would` no
longer be used for street purposes, and would also necessitate the removal of a pole line
belonging to the Indiana and Michigan Electric Co. I t is the opinion of the City Attorney
that this petition should be'signed by all the abutting property owners; it is his opinion
that otherwise'the construction of such a track could' readily be enjoined.
A contract of this nature must be in all cases be submitted by the Board,
to the Common Council and be approved by -ordinance before the same shall take effect.

The Board ordered-ithat the petition for the above mentioned sidetrrack be returned to
petitioners for an Ordinance.
Complaint received of defective walk and curb on West Ford Street from South
Scott Street to South Chapin Street. The Street Commissioner reported that walk and
curb should be repaired at 601 South Scott cor. Ford Street, and 705 W. Ford Street and 561
South Scott Streets 712 west Nord Street714 and 721 W. Ford. Street.
Contractors bond for the sum ag One Thousand.($1000.00)Dollars signed by
Perkins and Perkins, was approvdd by the Board.

In regard to the deferred hearing on Widening of Indiana Avenue and
Webster Street under Condemnation Resolution No. 39, the same was deferred until Tuesdp
September 21st. 1915. at 7:45 P.N,
In regard to deferred hearing on V€cation Resolution No. 23 for the
vacation of 4 ft. of alley at rear of 1,0t 35 Original Plat of South Bend. The same
was deferred until'Tuesday September 21st. 1915 at 7:45 P.M.
Communication received and read and placed on file from the Postal
Telegraph —Cable Company- in regard to poles in City, on Michigan Avenue.
Engineer filed assessment roll and final estimate for PipPsewer on
k/Jaquith Court from Prairie Avenue to Alley east of Chapin Street, under ,Improvement
Resolution No. 394. In the City of South Bend, Indlana.-
Resolved, that notices as to the amounts of assessments be publihed on th
the 19th. day of September,1915. and oi the 25th. day of September,1915. in the
South Bend Daily Tribune, stating tha- this Board will give a hearing on the aamount
of such assessments at its of ice in the City Hall on the 5th. day of October,1915
at 7:45 P.M.
Resolved further, that the entire work under the above contracts be
accepted and approved and the final estimate thereon allowed. Notice of this resolu-
tion shall be published on the 18th. day of September,1915 andon the 25th. day of
September,1915.in the South Bend Daily Tribune, stating that this Board will give a
hearing on the acceptance of such work at its office in the City Hall on the 5th.
day of October,1915. at 7:45 P.M.

The avvaarding of the contract for grading and paving Bartlett
Street from E. line of St. Joseph Street to Riverside Drive was deferred until
Tuesday September 14th. ,1915. at 10: 00 A.M.

I herewith returning to you a certain remonstrance signed by 34 citizens against
the asphalt plant located on yards of Vandalia Railway Co., and I advise you as follows: —
There is no -ordinance declaring an asphalt plant to be a nuisance, therefore
I` can bring no prosecution for the same'. If this plant is a nuisance to the citizens
within that locality, they doubtless would have a cause t)f action for injunction which they
or any of them could bring in the Circuit of Superior Court.
. However, I presume that the business of this plant is to furnish asphalt for
street improvements, which are within the control of the Board of Public Works, and a sugges—
tion from you to these peope to the effect that it night be desirable for them to move
