HomeMy WebLinkAbout08/31/1915 Board of Public Works MinutesAssessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rata payment for such improvement. Under no circumstances shall the City of South Bend be, or be held responsi- ble for any sum or sums due from said property owner or olmners for said work, , or for the collection of the same, or for the payment of any bond, bonds, certificates or certificates, issued to said contractor in paymentnfor such work except for such moneys as shall have aetu- ally been received by the City from, the assessments for such improvement, or such moneys as said City. is by said entitled Act and a,menmdents and supplements thereto required to pay. Wednesday August 25th.,1915, The Board met in special session at 10:00 A.M. Mr. Rice absent. Mr. Lewis F. Meyers, Attorney for the Chicago Lke Shore & South Bend Ry. Company met with the Board, and agreed as attorney for the above mentioned company that .the distance between the south edge of walk and the north rail of the Chicago, Lake Shore do South Bend Foy. Company tracks should be Ten (101) feet on La Salle Avenue at the corner of La Porte. The curb to be Fifteen (151) from the north line of the trackunt it it intersects the pr_esPnt curb, and the space between the new curb and the present pavement should be paved properly by said company. All members present. ✓ Mrs. Jacob Kuntz appeared Before the Board and Piled a, remonstrance against an asphalt plant of the Western Construction Company being located at,Vandalia Ry. Company's round house yards on south Lafayette Str_Pet as same was regarded as a nuisance. The Board referred the above mentioned remonstrance to the City Attorney for c. report. Communication received from V. G. ?ones Attorney, in regard to petition 'filed for opening of South Scott Street from Sample Street to Three"I" Tracks, The Board instructed the clerk to notify Mr. Jones that said petition was up for hearing last year and turned down, and as they think this territory which this stret opening would affect) will be platted very soon. Attorney W. G. Crabill appeared before the Board and remonstranced against the Widening of Indiana Avenue and Webster Street representing Mr. J. D. Oliver. Pole and Wire Inspector reported that Poles at 1st. alley north of Portage Avenue on Vassar Avenue betweellWoodward Avenue and Portage Avenue, also ah Allen Street between Birner Street and Oak Street were already moved inside curb line,per City Engineer's instruction, the above report was approved by the Board. Petition filed for pavement on Indiana Avenue from Leer Street to Miami St. ✓ The same was read and referred to the City Engineer for investigation. Permission granted the Central Union Telephone Company to set one pole on the south side of alley between Grace and Huron Street and Meade and Olive Street Communication received from Joseph P. Pink, Clerk of the Board of Public Works of Indianapolis, Indiana in regard to record book for ale ctric lights. Same read and placed on file. Mr. Crabill informed the Boa d that the reason the Gr^_nd Trunk and e Western Ry. Company had not replan heir crossings in this city was due to not being able to get suitable crossing plank, but would give this their immediate attelition as soon as new planking arrived. STREET OR AiLEY IMPROVEMENT RESOLUTION NO.. 407. BE IT RESOLVED BY THE BOARD Or PUBLIC WORKS OR THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY,STATE OF INDIANA, that it is desired and deemed necessary to improve Keasey Street from Michigan Street to Carroll Street as follows, to -wit: - By grading and paving the roadway, also by grading and paving the road- ways of all intersecting and entering streets and alleys lying within the property lines of slid Keasey Street not included in the roadway; by paving said roadways with either Asphalt, Asphaltic Concerte, Brick or Bitulithic laid on a five (5) pinch Portland Cement cuncrete foundation, or with brick laid on a six (6) inch rolled gravel foundation; by placing the necessary marginal cement curb; by curbing the roadway with cement curb where same is not already constructed; and by the construction of all necessary storm water inlets end conduits; all as shown on .the plans and in accordance with the profiles, detail drawl. -is and specifications on fie file in the office of the DepP.rtment of Public Works of the City of South Bend, Indiana. The cost of the improvement herein provided for_, except street and alley intersections , shall be paid by special assess-ent to be levied upon the property specially benefitted, to the amounts that the same maybe legally assessed therefor, in accordance with an Act of the General Assemble o the State of Indiana entitled "An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and purusant to the provisions of all acts amendatory and supplemental thereto. �� _. 3 t,j Tuesday August 31st.,1915. Defferred' hearing had on Pipe sewer on Golden Avenue from Portage Avenue to Woodward Avenue, under Improvement Resolution No. 402. In the City of South Bend, Indiana. Upon said hearing a remonstrators appeared but no remonstrance was filed. And. the Board being -'ally advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported. by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in ell things ratified, confirmed nd approved. The Board after due consideration decided to defer all action on said condemnation resolution No. 39. until Tuesday September 7th.1915. at 7:45 P.M.
