Dr. Crumpacker appeared before the Board e,nd presented a petition for, the Paving of Indiana Avenue from Miami Street to South Michigan Street. The Board ordered a resolution prepared and same was filed and adopted by the Boardq Mr. Purest Hillier appeared before the Board and remonstrated against his v assessment on the High Street Trunk sewer. The Board instructed Mr. Hillier to appear before them.at 7:45 P.M. this loth. day of August,1915:when said roll would come up for a hearing. Mr. Daniels of the Central Union Telephone Company appeared before the Board in regard to their underground work in City. And the following resolution was adopted and approved by the Board. RESOLUTION. Resolved, by the Board of Public Works that the Central Union Telephone Company be given peiZmission to do their own back filling and refilling and placing the foundation in as good order as when taken up by them. This work to be done in good workmanlike manner and to be thoroughly replaced and well tamped. An inspeetor to be appointed by the Board, and paid for by said company. All va rk done by the City in re- laying the pavement and other necessary work in completing said work shall be paid for by the Central Union Telephone Company. The said work to be guaranteed for one year after completion. Mr. James Judie appeared before the Board and made a proposition that he t--*ould take Two hundred ($200.00)Dollars per front foot for two feet strip off of Prt of Bank Out Lot No. 14 of the 1st. Addition of Bank Out Lots on Colfax Avenue,) for the widening of the William Street alley between Colfax Avenue and La Salle Avenue. The Board took the above under advisement. Petition filed with the- Board for the Paving of Allen Street from Va n Buren �.- Street to Portage Avenue. The Board referred the same to the City ,engineer for investigatio Engineer filed estimated cost of pavement on Jacob Street from Jefferson 61K Blvd. to a point 300 feet North of Jefferson Blvd. at .............$1,732.00 7�te Board instructed the City Engineer to make blue prints of Lafayette Street from Broadway to In Tana Avenue, and investigate old records and plans of said street and report on same to the Board in two weeks or August 24th.11915. The petition for grade, curb and side walk on Lafayette from Broadway to Indiana Avenue was also referred to City Engineer. Bond and contract for Brick Pavement on Franklin Street from Sample Street to Indiana Avenue signed by C. H. De Frees as principal and London and Lancashire & Accident Company as surety was approved by the Board. The Board ordered that expension of sidewalk be placed at Norther West corner of Oak Street and Allen Street by the City Contractor. Communication received from the Postal Telegraph Company notifying the Board V that they are trying to get other companies together to inregard to the telephone pole questions with copies of letters sent to other companies. Same read and placed on file. Communication from C. N. Chubb Mgr. Northern Indiana Gas h Elec. Co. stati- v that all gas mains were placed on Franklin Street between Sample Street and Indiana Ave. The same read and referred to the City Engineer for investigation. Report of the Public Service Commission of Indiana in regard to the issuing of Bonds for the South Bend Home Telephone Company. The same read and placed on file. f e�� The following communication was received by the City Engineer and referred to the Board. Mr. C. F. Anderson, City Engineer. South Bend, Indiana. Dear Sir :- Refering to your letter of July 31st. ,1915, relative to proposed changes to be made in curbing at the corner of La Porte Avenue and La Salle Ave. South Bend, beg to advise that file correspondence pertaining to this subject was turned over to Mr. Wilcoxen, President. He advises that -this matter has been referred to Mr. Meyers, our general 06tiftel, Mr. Meyers is at present array on his vacation. I have no doubt but that this matter will be given prompt attention immediately on his return. Yours very truly, J. K. GRAY, Superintendent. The above was referred to the City Attorney for immediate enforcement. STREET OR ALLEY IMPRRVEMENT RESOLUTION N0. 404. Be It Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary t.o improveIndians Avenue from Franklin Street to Miami Street as follows, to -wit:- By grading and paving the roadway, also grading -and paving the roadway of all inter - seating and entering streets add alleys lying within said portion of said Indiana Avenue not included in the roadway. To be improved with ASPHALT,ASPIIALTIC CONCRETE, CREOSOTED WOODEN BLOCKS,BRICK OR BITULITHIC laid on a five (5) inch portl and cement concrete foundation, Or with BRICK land on a six (6) inch Rolled Gravel foundation. Or a Concrete Pavement seven (7) inches in depth. Placing the necessary Marginal cement curb, curbing the roadway with Cement curb where same is not alreadyneon structed. Also the construction of the necessary storm water inlets and conduits. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications on file in the office of the Department of Public Works ofthe City 'of South Bend, Indiana. The cost of the improvement herein provided for, except street and alley interse-ctions,� shall- be- paid by special assessment to be levied upon the pro— perty specially benefitted, to the amounts that the same may be legally assessed there for, in accordance with an Act of the General Assembly of the State of Indiana, en- titled "An Att Concerning Municipal Cozp orations," approved March 6,1905, and in accordance vrith and pursuant to the provisions of all acts amendatory and supplemental thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys, which run into, but do not cross said roadway herein proposed to be improved and that peoti on of such street or alley abutting upon propertybelonging to said City, or upon property not sub- ject to such assessment, shall be paid by the City in cash out of its general fund, of able to do so, or from a fund created by a special assessment to be levied under the provisions of Section 108 of the above entitled Act. Assessments of Ten Dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six -per cent per annum, A bond or bonds will be issued to the contractor to the a._nount of such deferred assessments in pro rats payment for such improvement. Under no circumstances shall the City of South Bend be, or be held responsible for any sum or sums rue from property owners or owner for said work, or for the collection of the same, or for the payment of aV bond, bonds, certificate or certificates, issL1ed to said contractor in payment for such work, except for such moneys as shall have actually beenn received by the City from the assessments for such improvement of such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceedings had, and work done in the making of said improvement, assessment of property , collection of assessments and issuance' bonds therefor, shall be as provided for in said above entitled Act, add Acts amendatory thereof and supplemental thereto. 7e3 7 BE IT'FURTHER'RESOLVED,That the Board of Public Works fix the 3rd. day of September1915 at the hour of 7:45 P.M. at the office of the Board of Public Works, of this City, as the time and place for the public consideration of said proposed improvement, at which said Board of Public Works will hear all persons interested, or whose property is liable to be assessed for said improvement, ; and v+d.11 decide whether the benefits to theproperty liable to be assessed for said improvement Will equal the estimated cost thereof. Hearing had on assessment roll and final estimate for Trunk sewer on High Street from Dayton Street to Bowman Street, under Improvement Resolution No. W. In the City of South Bend, Indiana. In the above matter remonstrators appeared and a written remonstrance was filed, by Attorney G. Elliot -' for the St. Joseph Loan & Trust Company, successor to title of Martha E. Hillier, remonstrating against assessment on certain lots. In the above matter the Board --deferr hearing until Tuesday August l7th. ,191t. at 7:45 P.M. Hearing had on improvement Resolution No. 399 for the Oiling of roadway on Lindsey Street from Blaine Avenue to Portage Avenue, in the Cit y of South Bend, Indiana. Upon said hearing remonstrators appeared but no written remonstrance was filed. The property owners stated that they did not think that oiling; the street at this time of year would be any benefit to them, and decided they would rather have a pavement. The Board having the sand matter under advisement decided to rescind said resolution. Hearing had on Improvement Resolution No. 399 for Grade, curb and walk ✓ on Robinson Street from South Lot S in M. S. Robinson's 2nd. Plat to the Lake Shore & M. S. Icy. Co. In the City of South Bend, Indiana. Upon said hearing remonstrators appeared but no written remonstrance was filed. Mr. Ro binson appeared and objected to said improvement be_ ng put in this year. The Board after due consideration decided to defer said hearing until Tuesday August 17th.,1915 at 7:45 P.M. Hearing had on Improvement Resolution No. 400 for the Paving with gravel Prairie Avenue from Grant Street to Western City Limits, In the City of South Bend, Indiana. Upon said hearing remonstrators appeared but no written remonstrance was filed. The Board after -due consideration decided to defer hearing on said improve- ment until August 17th.,10,,15 at 7:45 P.M. Referred hearing on Condemnation Resolution No.3S for the purpose of � appr6priating a strip of land for the Widening of Eddy Street and Mishawaka Avenue from Jefferson Blvd. to East line of Pottowatomie Park, In the Otty of South Bend, Indiana. The Board deferred the hearing on said condemnation until Tuesday August 17th.,1915 at:7 45 P.M. Hearing had on improvement Resolution No. 401 for the Grading and paving "'of Bartlett Street from E. Line of St. Joseph Street to Riverside Drive, In the City of South Bend, Indiana.. Upon said hearing no remonstrators appred and no written remonstrance was filed. And the Board being fully advised in the premises, decides that thebenefits to property liable to be assessed for said improvement are equal to the estimated cost of same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same are hereby in all things ratified, confirmed and approved. Resolved further , that notices be published on the ;?Qtjl,L, day of August 1915 and on the 27th. day of August 1915 in a newspaper of general circum- lation in said City, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. on the 7th. day of September 1915. The Board reserves the right to re jest' any and all bids. Tuesday August 10th.,1915. Continued. Deferred hearing on Vacation Resolution No. 23 for the Vacation of 4 ft. of alley at rear of lot 35 O.P. South Bend, In the City of South Bend, Indiana. The Board decided, to defer all action on said -resolution until Tuesday September 7th. 1915 at 7:45 P.M. The City Engineer made thefollowing report and same was placed on file. To the Hon. Board of Public Works, of the City of South Bend, Ind ana. Gentlamen: Regarding; the petition for a pavement on Allen Street from Van Buren Street to Portage Avenue. Contract for water connections on Tont i Avenue signed by Stap1le s do Ackerman as principal and approved by the Board. Board ordered that" a resolution be prepared for petition for grade curb and Macadam pavement on Leeper Avenue from Angella Avenue to Howard Street. Engineer filed assessment roll and final estimate for pipe sewer on Dale Avenue from Dubail Avenue to Dayton Street, under Imp rovemant Resolution No. 376. In the City of South Bend, Indiana. Resolved, that notices as to the amounts of assessments be published on the 14th. day of August and 21st. d"ay of Au gust,1915 in the South Bend Daily Tribune stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 31st. day of _August,1915 at 7:45 P.A. Reselved further, that the entire work under the 'above contracts be ke- cepted e.ncl approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 14th. day of August,1915 and on the 21st. (lay of August,1915 in the South Bend Daily Tribune, stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 31st. day of Augu.st,1915 at 7:45 P.M.
