Board. met in regular session at 1.0:00 A.M. All members present.
Petitions Piled by Councilaen for, lights to be ,placed on the following, street
the same were read and placed on file until the Board makes trip to look over streets
where lights are requested.

Bond and contract for pipe sewer on Jaquith Court from -Prairie Avenue to
a point 115 ft. East of Chapin Street, signedby Staples & Ackerman and approved by
the Board.
Concerning the improvement of the roadway of Franklin Street from Sample
Street to Indiana Avenue in pursuance to resolution No. 3B8 petitions having been
filed within ten days from the time bids were reeeiveds-by persons claiming to be a
majority in number of the freeholders residing on said street"to be improved, and the
Board hereby refers said petitions to the City Engineer for his report - as to whether
said petitioners constitute a ma jokity in number of the freeholders residing on said
street; and this matter is hereby continued until the 7:45 P.M.this 27th. day of
July*1915, then the Board will determine the sufficiency of said petition, and will
let the contract, or will reject all bids.
LOCAL SEVER IMPROVEMENT RESOLUTION NO. 402.
Resolved by the Board of Public Works of the City of South Bend, County of
St. Joseph, State of Indiana, That the construction of a local sewer, intended and
adapted only for local use by the property holders vdiose property abuts thereon, and
not intended or adapted for receiving sewerage from collateral drains, be and the same
Is, hereby ordered in and along Golden Avenue from Woodward Avenue to Portage Avenue
as followstto-w1t:-
Beginning at a point on the northerly garb line of Golden Avenue
and the center line of Woodward Avenue; thence southwesterly to the center of Golden
Avenue with a 10 inch vitrified pipe sewer; thence westerly along the center line of
Golden Avenue to a point about 100 feet northeasterly from the easterly line of
Portage Avenue with a 10 inch vitrified pipe sewer. Together with the necessary
manholes, Inlets, Conduits and House Connections to the curb line along the line of
said improvement. All as shown on the plans, and in accordance with theprofiles,
detail drawings and specifications on file in the office of the Department of Public
Works of the City of South Bend, Indianan and said sewer, with all its appurtenances
shall be constructed in accordance with the profile and specifications now on file in
the office of the Department of Public Works of said City.

The cost of said improvment shall be apportioned against and paid by the property holders
whose property abuts thereon, and upon the City of South Bend if the City is benefitted
by said improvements all according to the method and manner provided for in Act of the
General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corporations,
approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual install-
ments, *ith interests at the rate of Stx per cent per antrum. A bond or bands shall be
issued to the contractor in payment for such work, unless the property owners pay said assess-
Tq,ents before said bond or bonds are issued. Under no circumstances -shall the City of South
Bend be or be held•responisble for anu sum or sums due from said property owner or owners
for -said work, or for the collection of same, or for the payment of any bond or bonds, certi-
ficates or certificates, issued to said contractor in payment for such work, except for such
moneys as shall have been actually received by the City from the assessments for such
improvement,_ or such moneys as said City is by said above entitled Act req fired to pay. All
proceedings had, and work done in the making of said improvement, assessment of property
collections of assessments and issuance of bonds therefor, shall be a`s provided for in said
above entitled Act.

LOCAL SEWER IMPROVE1,AENT RESOLUTION NO. 4039
Resolved by the -Board of Public Works of the City of South Bend, County of
St. Joseph, State of Indiana, That the construction of a local sewer, intended and adapted
only for local use by the property holders whose property abuts thereon, )and not intended
or adapted for receiving sewerage from collateral drains, be and the same is, hereby ordered
in and along Calvert Street from High Street to Miami Street as follows,to-wit:-
Be gin at
the intersection of the center line of High Street and Calvert Street; thence east along the
center line of.Calvert Street to the center line of Dale Avenue with a 15 icnh vitrified
pipe sewer; thence still east along the center line of Calvert Street to a point 100 feet
west of the west line of Miami Street with a 12 inch vitrified pipe sewer..° Together_ with the
necessary manholes, inlets, conduits , Flush Tank and House Connections to the curb line
along the line of said improvement. All as shown on the plans, and in accordance with the
profiles, detail drawings.and specifications on file in the office of the Department of Public
Works of the City'o'f South..Bend, Indiana and said sewer, with all its appurtenances shall be
constructed in accordance' with the profile and specifications now on file in the office of
the Department of Public Works of said City. The cost of said improvement shall be appor-

payment for such work, except for such moneys as shall have been actually received by the
City from the assessments for such improvement, or such moneyss as said City is by said above
entitled -Act required to pay. All proceedings had, and work done in the making of said
improvement, assessment of property, m llections of assessments and issuance of bonds therefor
shall be as provided for in said above entitled Act.
Notice of this resolution shall be published on the 28th. day of July,1915
and aft the 4h. day of August91915 in the South Bend Daily Tribune. This Board will give a
hearing on this resolution at its office in the City Hall on the 24th* day of August21915
at 7:45 P.M.

Hearing had on Improvement Resolution No. 395 for cement walks and curb on
Dubail Avenue from W. Line of High Street to West Line of Dale Avenue, In the City of
South Bend, Indiana. r
w Upon said hearing no remonstrators appeared and no remonstrances were Piled..
And the Board being fully advised in the premises, decides that the benefits to property
liable to be assessed for said improvements are equal to the estimated cost of the
same, as reported by the City Civil. Engineer, and thereupon takes final action on said
resolution as originally adopted, and the same is hereby in all things ratified, con-
firmed and approved.
Resolved further, that notices be published on the 28th. day of July,1915
and on the 4th. day. of August,1915 in a newspaper of general circulation in said City,
stating that this Board will receive bids for the construction of said improvements up
to 70:-00 A.M. on the 17th. day of August,1915. The Board `reserves the right to reject
any and all bids. a
Hearing had on assessment roll and final estimate for Brick Pavement on
Division Street from Michigan Street to 1st. alley east of Michigan Street, Under
Improvement Resolution No. 361. In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances were
filed. The Board therefore find that the property assessed in said roll filed July
6th. A015 is benefitted in the amount of assessments as shown on said rolls, and the
Board further find that the assessment rolls filed July 6th.,1915 and the.final esti-
mate allowed July 6th..1915 should be and the same is hereby_in all things ratified,
confirmed and approved,
Engineer filed assessment roll and final estimate for Pipe sewer on
Y Jacob Street from Jefferson Blvd. to Washington Avenue,under Improvement Resolution No.
382. In the City o-f South Bend, T_ndiana.
The Board ordered that said roll be held up for two weeks until August 10
1915 at 7:45 P.X.
Mr. Nicely appeared before the Board and requested the Board to hold up
v/ thirty day notice sent him under date of July 21,1915 until one year from datesas he
intended to rebuild his plant and construct sidewalk at the same time. The Board
instructed the Clerk to with -hold notice for one year from date or until July 27-1916
The following`., report was filed by the City. Civil Engineers and was approved.

Gentlemen: -
I have checked the petition for asphalt and brick pavements on South
Franklin Street from Sample Street to Indiana Avenue. I find that there are 91 free-
holders residing on the street.
5$ of these originally signed a petition for asphalt but 16 of these
afterward signed petitions for brick on gravel, making 42,petitions for sheet asphalt
and 49 for brick oh -:gravel.

The Board deferred the awarding of said contract for paVement on Franklin
Street until Tuesday, August3rd.1915 at 10:00 A.M. o
A petition presented by Orson L. Morgan and signed by six property owners
on Hill Street between Corby and Howard Street was filed with the Board, requesting them
to change grade2cu rb, gravel roadway and cement, walk as originally planned by the City
Engineer (or to a 301 roadway i nstead of a 42$1%2 ft. roadway). The same was placed on
file as it can not be changed on advice of the. City Attorney.
Clerk instructed to notify H. G. Christrman Company to file an excavation
Bond for work this year.
Engineer filed assessment roll and final estimate for Pipe sewer on
Grant Street from Huron Street to Division Street, under Improvement Resolution No.
359. In the City of South Bend, Indiana.
Resolved, that notices as to the amounts of assessments be published on
the 28th. day of July,1915 and on the 4th. day of Sugust,1915 in the South'Bend Daily
Tribune, stating that this Board will give a hearing on the amount of such assessments
at its office in the City Hall on the 17th. day of August,1915 at 7:45 P.M.
Resolved further, that the entire work under the above contracts be ac-
cepted and approved and the final estimate thereon allowed. Notice of this resolution
shall be"published on the 29th. day of July,1915 and on the 4th. day of Au ust,1915 in
the South Bend Daily Tribune, stating that this Board will give a hearing on the ac-
ceptance of such work at its office in the City Hall on the 17th. day of August,1915 at
