The proposed use is compatible with the surrounding land uses. The office zoning and its associated use would help buffer the residential area to the east from the mixed use area to the west. The required landscaping and residential bufferyard should provide an acceptable buffer between the proposed development and the adjacent residential area. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Location: 623 South St. Joseph Street Jurisdiction: City of South Bend Requested Action: The petitioner is requesting a zone change from SF2 Single Family and Two Family District to O Office District to allow a Bureau of Motor Vehicles Branch Office. Land Uses and Zoning: On site: The site is currently being used as a parking lot. North: To the north is a vacant lot zoned MU Mixed Use District and a single family home zoned SF2 Single Family and Two Family District. East: To the east are four single family homes and a vacant building zoned SF2 Single Family and Two Family District. South: To the south is vacant land and the railroad tracks zoned LI Light Industrial District. West: To the west is an office and vacant parcel zoned MU Mixed Use District. District uses and development standards: The "O" Office District is established to promote the development of general office uses and complexes; professional health care uses and complexes; limited public and semi-public uses; and, other uses which are generally compatible in physical appearance and service requirements to office uses. The potential for the development of multifamily dwellings is also provided. Site plan description: The site is approximately 1.17 acres. The petitioner is proposing 7,000 square foot office building. The proposed building is 27 feet in height. The building will cover approximately 14% of the site. Parking and drives will cover an additional 52% of site. The remaining 34% will consist of open space and landscaping. There are 73 proposed parking spaces for the development. The site has one access point on St. Joseph Street. Type B residential bufferyard and landscape screening is required along the northern and eastern property lines. Utilities: The site will be served by municipal sewer and water. 5 Criteria (per IC 36-7-4-603): 1. Comprehensive Plan: Policy Plan: City of South Bend -City Plan, November 2006 Economic Development Policy ED 1.2 Encourage reuse of abandoned and underutilized land and structures. The rezoning is consistent with the Comprehensive Plans economic policy. River of Life Family Church, Inc. #2456-07 Page 1 of 2 Land Use Plan: City of South Bend -City Plan, November 2006 The Future Land Use Map identifies this area as Medium Density Residential. The rezoning conflicts with the Future Land Use Map. 2. Current conditions and character: The site is currently a paved parking lot. The area is a mixture of residential, office and mixed use in character. 3. Most desirable use: The most desirable use for this property is office or mixed use. 4. Conservation of property values: The surrounding property values should be conserved with the rezoning because of the buffering required by the zoning ordinance. 5. Responsible development and growth: It is responsible development and growth to allow infill development on underutilized property in the downtown area. Recommendation: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation. Analysis: The proposed use is compatible with the surrounding land uses.
