DoRAU This is EXHIBIT K, consisting of pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated December 12, 2017. AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. 1 1. Background Data: a. Effective Date of Owner -Engineer Agreement: December 12, 2017 b. Owner: Board of Public Works, City of South Bend, Indiana C. Engineer: Chistopher B. Burke Engineering, LLC (CBBEL) d. Project: Mishawaka Avenue Traffic Signals a proposed Fire Station #9 (Project) 2. Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: 1) Task I — ADA Improvements and Pavement Markings: CBBEL will identify the removal and replacement of the existing curb ramps for the intersections of Mishawaka Avenue at 20th Street and Mishawaka Avenue at Ironwood Drive. The new curb ramp designs will be designed according to current ADA policy. The intersection of Mishawaka Avenue at Ironwood Drive will be restriped to align the east and west approach left turn lanes and eliminate the existing negative offset. Pavement markings on the north and south Ironwood Drive approaches will be reviewed and refreshed based on the final locations of the added crosswalks and stop bars. 2) Task 2 -- Traffic Signal Modification Plans: This task will include the design of the traffic signal modification. Base sheets will be prepared at a scale of 1" = 20' using aerial images, the existing traffic signal data, and utility information which will be coordinated by CBBEL. The extent of the traffic signal work is as follows: a) Mishawaka Avenue at 20th Street: Existing dual call pushbuttons will be replaced with separate pushbuttons for each crosswalk and installed on separate traffic signal posts per MUTCD policy. Preemption cabling will also be added leading to the new Fire Station. b) Mishawaka Avenue at Ironwood Drive: All existing vehicle traffic signal heads will be replaced and backplates meeting INDOT standards will be added. The left mast arm signal heads will be replaced with 5 section signal heads to add protected -permitted left turn phasing to each approach. The project will add four (4) FUR FC 344 T2 thermal imagining cameras to capture all four approaches. Preemption cabling will be installed leading to the new Fire Station. 3) Task 3 — Flashing Yellow Beacon Warning Sign Assembly Installation: This task will include developing the plans for the flashing yellow beacon warning sign assemblies adjacent to the new Fire Station driveway. These assemblies will be positioned based on MUTCD policy and initiated by a pushbutton located in the Fire Station. 4) Task 4 — Bid Documents: CBBEL will prepare plans and specifications for bidding purposes. CBBEL will use existing aerial images as the base for the plans. The project specifications will utilize INDOT standard pay items and special provisions when applicable. No topographic survey will be obtained as part of this project. 5) Task 5 -- Design Coordination with the City: CBBEL will meet the City to discuss review comments on the plan submittals. The City anticipates three submittals and will include 30%, 60%, and 90% plan sets. A field check is also anticipated. At total of four(4) meetings have been included in this task. 6) Task 6 — Bidding & Construction Engineering Services: CBBEL will provide "As -Needed" Bidding and Construction Engineering Services that include: a) Attend a Pre -Bid Meeting b) Respond to contractor questions and issue addenda (if needed). c) Compile a certified bid tabulation sheet and assist City staff in analyzing the bids provided for an award recommendation. d) Attend the pre -construction meeting, review project submittals, and respond to design questions that come up during construction. b. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: NIA c. The responsibilities of Owner are modified as follows: d. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: 1) Tasks 1 through 5: $32,900 2) Task 6 will be "As -Needed" based on Hourly Rates and Not to Exceed - $6,600 e. The schedule for rendering services is modified as follows: • Final Bid Documents — eight (8) weeks from NTP f.
