Mr. Varner noted that Ms. King is expected for the
meeting, but has not arrived to create a quorum. He
suggested moving Progress Reports up on the agenda
and taking Ms. Stewart's presentation on Unity Gardens
at this time.

7. PROGRESS REPORTS
Ms. Stewart made a presentation about the progress of STATUS REPORT ON UNITY GARDENS
Unity Gardens since its beginning in 2008. She noted
that the vision for Unity Gardens has always been to
provide the community with an abundance of healthy
fresh food and produce. There were forty -two gardens
this year. The vision has expanded now to be "improve
community health."
Ms. Stewart noted that Unity Gardens' educational
program has grown a great deal. It's one thing to make
vegetables accessible to everyone, but it's another to
teach people where their food comes from. Many
people, especially children, don't know. Our goals have
always been to ensure healthy vegetables are accessible
to everyone, and that everyone has the opportunity to
grow. But equally important is education: teaching
people how to prepare the food once it's harvested. You
hand someone some of this stuff from the garden and
they have no idea what to do with it to make it edible.
Ms. Steward noted that more importantly, they build
community through gardens, providing safe gathering
areas that make our neighborhoods grow again.
Through the gardens and through education, we're
learning to trust each other more and fear less.
Homeless and poor people are working side by side with
the wealthy and with service groups, shedding their
normal social roles and mentoring one another.
Therefore, our motto has become "we're growing more
than vegetables here."
Unity Gardens' role:
• Garden planning
• Year -round classes
• Fund raising for the gardens
• Securing land
• Provide an extra layer of liability insurance
• Assist with infrastructure — we've learned the
benefits of raised beds, picnic tables, benches
that encourage community.

• Raising awareness. We post on Facebook about
four times a day and get about 111,000 views a
month.
• Getting schools involved in growing gardens.
We're teaching healthy habits from early
childhood. The joy of a vegetable in these kids
is just amazing and it makes you more tenacious
in teaching it because they really don't
understand.
Mr. Inks noted that Unity Gardens would like a ten -year
lease for the LaSalle Square property, recognizing that
development on the property would supersede the lease.
Mr. Varner asked if the request is in writing. Mr. Inks
responded that we have no request at this time, although
we do have letters of support from the Lincolnway West
Gateway Association and the LaSalle Square Steering
Committee.
Ms. King joined the meeting during the presentation.
2. APPROVAL OF MINUTES
A. Approval of Minutes of the Regular Meeting of
Tuesday, September 16, 2011.
Upon a motion by Mr. Downes, seconded by Ms
King and unanimously carried, the Commission
approved the Minutes of the Regular Meeting of
Tuesday, October 25, 2011.

Mr. Inks noted that the public hearing file is
complete, containing a copy of Declaratory
Resolution No. 2932 amending the
Development Plan for the South Bend
Central Development Area; a copy of the
Area Plan Commission's Resolution No.
22 1 -11 approving the declaratory resolution;
a copy of the South Bend Common Council's
Resolution No. 4124 -11 approving the Area
Plan Commission's Resolution No. 213 -10; a
copy of the Notice of Hearing.; a copy of
Resolution No. 2952; An affidavit from Jacki
Krolczyk, Advertising Director of the South
Bend Tribune, that the Notice of Hearing was
published in that newspaper on October 28,
2011; an affidavit from Richard Andrysiak,
Classified Manager of the Tri- County News,
that the Notice of Hearing was published in
that newspaper on October 28, 2011. The
mail was checked prior to this meeting. As
of 10:00 a.m., November 8, 2011, there were

Mr. Sikora noted the confirming resolution is
the final step in the process to add this parcel
to the acquisition list. Staff requests
approval of Resolution No. 2952.

Mr. Varner opened the public hearing for PUBLIC HEARING ON RESOLUTION No. 2952
anyone wishing to speak. Seeing there was
no one who wished to speak, Mr. Varner
closed the public portion was closed.
(2) Consideration of Resolution No. 2952.
Mr. Inks requested that the resolution be
tabled today and be brought back to the next
meeting. The ownership of the property has

changed. Staff spoke to the new owners
today. They had other investors that they
wanted to inform and they want to get back
to us on whether they would be in favor or
not in favor of putting the property on the
acquisition list.
Action on Resolution No. 2952 was tabled
until the November 22, 2011 meeting
B. Housing
(1) Loan and Grant in connection with the
South Bend Home Improvement Program
for property located a 424 Lamonte
Terrace. (Marilyn Sheree LaPorte).
Mr. Inks noted that the loan is $6,500 and the
grant is $17,000.
Upon a motion by Mr. Downes, seconded by
Ms. King and unanimously carried, the
Commission approved the loan and grant in
connection with the South Bend Home
Improvement Program for property located a
424 Lamonte Terrace. (Marilyn Sheree
LaPorte).
C. South Bend Central Development Area
(1) Listing Contract with Grubb &
Ellis /Cressy & Everett for the sale of 111
S. St. Joseph Street (College Football Hall
of Fame).
Ms. Nicholl -Smith noted that staff would like
to hire Grubb & Ellis /Cressy & Everett to
market the College Football Hall of Fame at
111 S. St. Joseph Street
On March 22, 2011, the Redevelopment
Commission approved the bid specs, fair-

market valuation, and advertising of legal
notices to begin the disposition process for
this property.
At the April 26, 2011, Redevelopment
Commission meeting, staff reported that no
bids had been received on the property and
that as such it would now be able to be sold
at a negotiated price.
The Listing Contract is a standard agreement
wherein sales commission would be 5% if a
tenant or purchaser is found by Cressy &
Everett and 7% if the tenant or purchaser is
represented by another agent. Additionally,
the agent understands a prospective tenant or
buyer may not be able to obtain possession
until after December 31, 2012, unless certain
conditions contained in the Extension
Agreement are satisfied, in which event,
possession may be available on November 1,
2012.
Staff requests your approval of the Listing
Contract.
Upon a motion by Mr. Downes, seconded by
Ms. King and unanimously carried, the
Commission approved Listing Contract with
Grubb & Ellis /Cressy & Everett for the sale
of 111 S. St. Joseph Street (College Football
Hall of Fame).
(2) Lease with Carl Duncan for 121 S.
Michigan Street.
Ms. Jennings noted that Carl Duncan would
like to lease 121 S. Michigan Street to
operate a licensed Notre Dame apparel store.
The lease terms are:

• Tenant shall pay for all utilities
• Common Area Maintenance (CAM),
insurance and real estate taxes shall
be paid in one lump sum at the time
of lease execution
Mr. Downes asked Mr. Duncan if he had any
prior experience in retail. Mr. Duncan
replied that he and his partner own The Old
Bag Factory in Goshen, Indiana. He also
operates the Two Men And A Truck
franchise in Osceola, Indiana.
Ms. King asked whether this is a trial to see
if there is community interest. Mr. Duncan
believes that the Notre Dame apparel will do
very well. He has a contract with another
local company that makes the apparel. He
has some concern about the Hall of Fame
leaving and what that may do to the business,
but he saw this as a great opportunity to give
this a try.
Upon a motion by Mr. Downes, seconded by
Ms. King and unanimously carried, the
Commission approved lease with Carl
Duncan for 121 S. Michigan Street.
(3) Proposal for roof repair of 325 S.
Lafayette Blvd. (Shillings Building).
Ms. Jennings noted that the Schillings
Building, 325 S. Lafayette Street is in need
of roof repair. Two quotes have been

obtained: AMR Roofing for $3,985 and Tri
M Construction for $4,500. Staff
recommends accepting the proposal from
AMR Roofing.
Mr. Downes asked whether there has been
any interest in that building. Mr. Inks replied
that there have been temporary users of the
building, but no one interested in permanent
use.
Upon a motion by Mr. Downes, seconded by
Ms. King and unanimously carried, the
Commission accepted the proposal from
AMR Roofing for the scope of services and
fee proposed.
(4) Resolution No. 2955 a Supplemental Bond
Resolution supplementing and amending
Resolution No. 2012, adopted on October
17, 2003, all for the purpose of authorizing
the modification of certain contractual
rights, the execution and delivery of its
City of South Bend, Indiana,
Redevelopment District Amended Tax
Increment Revenue Bonds, Series 2003
(South Bend Central Development Area),
and regarding certain related matters.
Mr. Inks noted that this resolution authorizes
the refunding of a bond that was issued in
2003. There's a better interest rate available
today and savings to be had on the current
bond.
Mr. Rompola explained both the South Bend
Central and Airport Economic Development
Area bonds. He noted that both bonds, when
issued, were issued to the Indiana Bond Bank
and then the Indiana Bond Bank in turn sold
one large bond issue to account for those two
smaller bond issues. The reason that was

done some years ago was to get a better
interest rate for the city. Therefore, what is
proposed is to refund the bond bank bonds,
not the city bonds. The bond bank will have
a savings at their level and they will pay the
savings back to the redevelopment district so
that for the South Bend Central Development
Area Bond, the savings is estimated at
$500,000. The Airport Bond savings is
estimated at $294,000. To get that savings,
the city would give up its rights to redeem
the bonds early.
Mr. Varner asked if the savings would be an
annual payment. Mr. Rompola replied that it
is a one -time lump sum payment. The bonds
are expected to close in December. The city
will get the money at closing from the bond
bank. The cash will be divided for the two
respective TIF districts.
Ms. King asked what the terms of the
existing bonds are. Mr. Rompola believes
they are for eight and eleven more years,
respectively. Ms. King wondered if the city
would not be refunding these if the bond
bank was not involved. Mr. Rompola said if
the bonds were the city's outright, the city
would be refunding them for the savings
also.

D. Airport Economic Development Area
(1) Staff report on Ignition Park South
expansion.
Mr. Relos noted that the Commission
authorized acquisition of 150 parcels in the
Ignition Park South expansion area. Of those
150 parcels, 21 were already owned by the
city, 20 were acquired at the March 2010 tax
sale, and seven were railroad owned.
Mr. Relos reviewed a map of the Ignition
Park South expansion area showing the
current status of those parcels. As of today,
103 parcels are under city control, 29 are in a
negotiating status, one was recently
purchased at the September 2011 tax sale,
and 10 have either stated they do not want to
sell, or are in some other status with the
department. For comparison purposes, as of
the last update to the Commission 14 months
ago, 66 parcels were under City ownership.
Mr. Relos noted that, to date, total
acquisition and relocation costs have been
$2,193,965, compared to $3,999,500 that had
been budgeted for these parcels (a
$1,805,535 savings or 45% under budget).
Though much work remains, staff wishes to
thank the Commission for the approvals
necessary to carry out this project. It will
expand Ignition Park by an additional 23
acres, and help stabilize the Rum Village
neighborhood to the immediate south of this
planning area.
Ms. King asked how many properties that are

under city control have been demolished.
Mr. Relos responded that about half of them
have been demolished.
(2) Proposal for professional services related
to installation of dedication plaque at the
James Oliver sculpture.
Mr. Sikora noted that the final element to
complete the James Oliver Memorial Plaza
project is to have a plaque installed to
identify and recognize the sculptor of the
James Oliver sculpture. The plaque was part
of the city's contractual obligations in
commissioning the sculpture.
This professional service proposal will allow
Danch, Hamer & Associates, the project
designer, to coordinate the design, fabrication
and installation of the dedication plaque.
South Bend Monuments has helped with
initial pricing of the plaque and the total
projected cost of the entire process is $1,200.
Staff requests approval of a not -to- exceed
budget of $1,500 to cover any unforeseen
expenses that might arise during the design,
fabrication and installation process.
Upon a motion by Mr. Downes, seconded by
Ms. King and unanimously carried, the
Commission approved proposal for

(3) Resolution No. 2956 a supplemental bond

attached to Resolution No. 2953 adds
funding to cover additional design services
that have been incurred on the Main -
Lafayette Connector project as part of the
removal of the roundabout concept from the
connector plan. The supplement also covers
a variety of site specific design issues related
to property acquisition for the U.S. Post
Office, the Cinemark Movie Theater
Complex, Caroline Partners properties, Carl
Kay property, the Sears Store and drainage
design at the southeast corner of the
intersection of Barbie and Michigan. The
project is well under way, with parcel
appraisals and early stages of right -of -way

Mr. Sikora noted Resolution 2954 and
Amendment to the Addendum to the Master
Agency Agreement for the Main - Lafayette
Corridor Project, Supplement #4.
The purpose of this supplement is to add
funding to cover the right -of -way acquisition
needed for the Main - Lafayette Connector
project. There are three total acquisitions
(two residential and one commercial), several
partial, permanent and temporary
acquisitions associated with this project. The
budget estimate for all of the acquisitions is
$1,225,000 but staff is requesting approval of
a budget amount of only $1,000,000 and will
use this as a base budget. When the budget
needs to be amended based on the acquisition
process, staff will present an update and a
supplemental budget request.
Mr. Sikora noted that questions had been
raised about this Addendum to the Agency
Agreement and staff is now requesting
Resolution No. 2954 be tabled.

(1) Resolution No. 2957 authorizing the
transfer of real property to the City of
South Bend Board of Public Works.
Mr. Meteiver noted that during the
acquisition process in the northeast
neighborhood triangle area, properties were
purchased in the name of the Redevelopment
Commission and also in the name of the
Board of Works. This resolution will
authorize transfer of the Redevelopment
properties to the Board of Works to
consolidate that ownership for ultimate
development purposes. In pursuing
development in that neighborhood we are
going through the process of rezoning those
parcels from their current zonings, which
vary from parcel to parcel, to a single zoning
planned -unit development.
Mr. Varner asked if all the properties to be
transferred are in the triangle area. Mr.
Meteiver said yes.
Mr. Varner asked if any of the properties are
the contested parcels. Mr. Meteiver said that
all of those have been resolved.
Upon a motion by Ms. King, seconded by
Mr. Downes and unanimously carried, the
Commission approved Resolution No. 2957
authorizing the transfer of real property to the
City of South Bend Board of Public Works.
(2) Ratification of signing of documents for
Eddy Triangle Rezoning to Planned Unit
Development.
Mr. Meteiver noted that the documents
needed to be filed for the rezoning of the
above properties and were signed by Mr.
Inks. He asked the Commission to ratify Mr.
