Bids Were received_, opened and read on the following improvements. ✓ Pipe sewer on Bowman Street. from Bov�ntan Creek Trunk sewer to iichigaa St. Pipe sewer on Fellows Street from Dubail Avenue to the first alley north, Pavement on Vassar Avenue from Riverside Drive to Portage Avenue. The same were referred to the City ✓Engineer for tabulation to be reported at 7:45 P.M. this 25th. day of May,1915. Petition -filed wit1.11 the Board for eater main on Jaquith Court from ✓ Prairie Avenue to Chapin St. The same was referred to the Superintendent of hater Works. Complaint received of broken cement sidewalk in -front of 1215 Vistula Avenue. The Board ordered that a thirty day notice be sent to Mrs. Geo. Loughman of 716 South b.Aich. Street to repair or construct new walk within t irty days or the same would be put in under Improvement Resolution No.366 for Various walks in the City by the City contractor. Plat of Irvington was approved by the Board. In the matter of the hearing on the pipe sewer. on Division Street from Meade Street to Olive Street , under Improvement Resolution No. 355, tine Board deferred the hearing on same until Tuesday June Sth.,1915 at 10:00 A.M. The Board ordered that the salary of the Caretaker of River Park Lights Edward Moritz, be increased Seven Dollars and fifty cents W.50) m month; ✓the same to go into effect June 1st . ,1g15. Bond and contract for pipe sewer onJacob Street froin Jefferson Blvd. to lst. angle north, under. Improvement Resolution No. 352, si.;ned by L.H.Webster as y principal and The London & Lancashire Guarantee and Accident Co. of America, as surety was al?proved by the Board. The Board approved of an order to the St. Joseph Loan and Trust Copipany to withdraw the sum of Three hundred ( 300.00)Dollars from the fund of Two Thousand ($2,000.00)Doll Dollars now on deposit with then to pay for labor, equipment and material on the repairing, of South Michigan Street where Bowman Creek Trunk sewer was constructed bythe Stewart_Sxleets Company. Hearing had on Improvement Resolution No. 379 for pavement on Allen Street ✓ from Oak Street to Van Buren street. In the City of South Bend, Indiana. Upon said hearing remonstrators appeared and remonstrances were filed. Attorney Farabaugh rep resented remonstrators north of Miciigan Avenue. And the Board being fully advised in the premises, decides .that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reportd by the City Civil Engineer, and thereupon takes final estion on said resolution as originally adopted, and the same is hereby in all things ratified, confirmed and ap— proved. Resolved further, that notices be published on the 5ths day of June1915 and on the 12th. day of June,1915 in a newspaper of general circulation in said City, stating that this Board will receive bids for the construction of said improventent up to 10:00 A.M. on the 29th. day of June1915 . The Board reserves the right to reject any and all bids. ( The contract for the above pavement to be let with the understanding that assessment roll would not be filed until December1915.) Hearing had on Improvement Resolution No. 379 for Pavement on Fuerbringer Street from Cottage Grove Avenue to Sherman Avenue. In the City of South Bend, Ind., Upon said hearing remonstrators appeared, but no further remonstrance was filed. The Board after due consideration decided to defer hearing' on said improvement resolution No. until Tuesday March 1915. Hearing had on Improvement Resolution No. 376 for the pipe sewer on Dale Avenue from Dubail Avenue to Dayton Street. In the City of South Bend, Indiana.. Upon said hearing no remonstrators appeared and no remonstrance was filed. And the Board being fally advised in the premises, `decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, con— firmed and approved. Whereas, the Board of Public Works of the City of South Bend,Indiana, did, on the 27th. day of Apri1,1915 adopt a preliminary resolution for the improvement of Fulton Court From LaSalle Avenue to lst. alley North of LaSalle Avenue in the City of South Bend, Indiana by grading and macadamizing the roadway, also paving the roadway of all intersecting and entering streets and alleys, lying within said portion of said roadway not included in the roa4iw#y to be improved with Tuesday May 25th..1915. Continued Macadam 8 inches in depth. PlatAng the necessary marginal cement curb, curbing the roadway with cement curb where same is not already constructed. Also the construction of the nec— essary manholes, and inlets, water inlets, conduits and resetting all manholes and inlets to the proper grade. All as shown on the plans, nd in accordance with the profiles, detail drawings and specifications on file in the office of the Department of Public Works. And Whereas, we, the undersigned, are the only persons owing property on said street to be improved, and that we along are affected in any way by said proposed im- prvement. That we are the sole owners of the separate parcels of land bordring upon said street proposed to be improved. Therefore, in consideration that said Board of Public Works proceed to pas improve said street as proposed in said resolution, and for the further purpose of saving time and expense, we, the undersigned, do hereby waive all objection and defense to any defeat in said proceedings, and to any violation in prodedure for the improvement of streets as fixed by Section 8710 or Burns Revised Statutes of 1914. We waive any right to obtect to the form of said resolution in that it does not name four different kinds of modern City pave -rents, and we further waive any and all objections to the fact that no advertisement for hearing was published as required by law, and that no n6tices were mailed to the owners of property, and that no hearing was had by said Board. We also consent that said Board shall proceed to let the contract for doing said work in the following manner: — That they shall notify by mail responsible contractors in the City of South Bend, Indiana of said work to be done under said resolution, and that they shall receive bids from said contractors for the doing of said work, and they shall let the con— tract for doing said work to the lowest responsible bidder. And we waive any abjection to the action of said Board in letting said contract fA a form and manner other than provided by said Section 8710. And we -further consent that the cost of doing said work shall be assessed against the different parcels of real estate owned by us as provided by Sections 8710,8711, 9714,8715,8716,9719 of Burns Revised Statutes of 1914. And we further agree that notice given us by mail shall'be sufficent notice of the hearing upon the assessments made for said improvement. Whereas, the Board of Public Works of the City of South Bend, Indiana, did, on the 4th. day of May.1915 adopt a preliminary resolution for the improvement of Hamden Court from La Salle Avenue to 1st. alley North of La Salle Avenue in the City 6f South Bend,Indiaaa, by grading and paving the roadway also paving the roadway of all intersecting that entering streets and alleys, lying.within said portion of said roadway not included in the roadway to be improved with Water Bound Macadam 8 inches in depth. Pacing the necessary marginal cement curb, curbing the roadway with a cement curb where same is not already constructed. Also, the construction of the necessary manholes, and inlets` water inlets, conduits and resetting all manholes and inlets to the proper grade. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications. on file in the office of the Department of Public Works. And Whereas, we , the undersigned, are the only persons owing property on said street to be improved, and that we along; are affected in any way by said proposed improvement. That we are the sole owners of the separate parcels of land nordering upon said street proposed to be improved. Therefore in consideration that said Board of Public Works proceed to improve said street as proposed in said resolution, and for the further purpose of saving time and expense, we, the undersigned, do hereby waive all objection and defense to 6 7 S` defect in said proceedings, and to amV violation in procedure for the improvement of streets as fixed by Section 5710 or Burnsf Revised Statutes of 1914 We further waive. any ,right to object to the form of said resolution in that it does not name four different kinds of modern City pavements; and we further waive any and all objec— tions to the fact that no advertisement for hearing was published as required by law, and that no notices were mailed to the onners of property, and that no hearing was had by said Board. Contract for the pipe sewer on Fellows Street from Dubail Avenue to the 1st alley northwas awarded by unanimous consent to L.H. Webster. Contract for the pipe sewer on Bowaan street from Michigan Street to Boman Creek Trunk sewer was awarded to De Peape & Coussens. Resolution was ordered prepared on petition filed on August 25th. 1914 for a pipe sewer on ''Sorin` ­ Street from Mt. Louis Street to Eddy. Bond and contract signed by L.H. Webster as principal and The London & Lancashire Guarantee and Accident Co. of Canada as surety, for the pipe sewer on Jacob Street from Jefferson Blvd. to 1st. angle north ,under Improvement Resolution No. 352. was approved by the Board.
