HomeMy WebLinkAboutNo. 1152 ratifying/confirming Resolution No. 1138, changing the base assessment date for property in the WWCDA93 %09'76 RESOLUTION NO. 1152 , A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT cJ COMMISSION RATIFYING AND CONFIRMING RESOLUTION x, NO. 1138, CHANGING THE BASE ASSESSMENT DATE FOR ., PROPERTY IN THE WEST WASHINGTON- CHAPIN DEVELOPMENT AREA e "y w WHEREAS, the City of South Bend, Indiana, Redevelopment Commission (Commission) at its regular meeting February 19, 1993, approved and adopted Resolution No. 1138, changing from March 1, 1987, to March 1, 1992, the base assessment date for property in the West Washington Allocation Area (South Bend Allocation Area No. 7), the boundaries of which Area are coterminous with the boundaries of the West Washington- Chapin Development Area, all hereinafter referred to as the Area, and described more particularly as follows: A PARCEL of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: .-vr �jFLj. a 3 _ X A Parcel of land being a part of Section 10, and a part of Section 11, Township 37 North, range 2 East, City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows: F COMMENCING at the point of intersection of Western Avenue and William Street; thence North along the centerline of William Street to the Easterly projection of the Southerly right -of -way of the first 14.0 foot alley; being the point of beginning; thence Westerly along the South right -of -way line of said 14.0 foot alley and projected to the intersection of the West right -of -way line of Taylor Street; thence North 2 along the West right -of -way line of Taylor Street a to the intersection of the South right -of -way line of Wayne Street; thence West along the South right -of -way line of Wayne Street to the intersection of the East right -of -way line of Scott Street; thence South along the East right -of -way line of Scott Street to the intersection of the Easterly projected South right -of -way line of Napier Street; thence West along the South right -of -way line of Napier Street to the intersection of the centerline of the first 14.0 foot North -South alley; thence South along the centerline of said 14.0 foot alley to the projected Southerly right -of -way line of the first 14.0 foot East -West alley; thence West along the projected and South right -of -way line of said alley to the ' intersection of the East property line of St. Joseph County Tax parcel 18- 3051 -2012, Block 71 (now noted as Block W88- Parcel 5); thence South along said East property line of said Parcel 5 and projected to the intersection of the centerline of Western Avenue (State Road 2); thence West along the centerline of Western Avenue to the centerline intersection of Laurel Road; thence North along the centerline of Laurel. Road to the Easterly projection of the Southerly right -of -way line of s the first 14.0 foot alley; thence West along the projected and South right -of -way line of said alley to the intersection of the East right -of -way line of Maple Street and West property line of Lot A, Baker's Subdivision (unrecorded); thence South along the East right -of -way line of Maple Street and West property line of said Lot A to the easterly projection of the Southerly right -of -way line of the first 14.0 foot alley North of Western .-vr �jFLj. a 3 _ X EXHIBIT A TO RESOLUTION NO. 1152 WEST WASHINGTON - CHAPIN DEVELOPMENT AREA FINDINGS OF FACT MAY 7, 1993 On October 23, 1987, the Commission adopted its Resolution No. 818, declaring the West Washington- Chapin Development Area to be blighted within the meaning of the Redevelopment of Cities and Towns Act of 1953, as amended, and on February 23, 1990, the Commission adopted its Resolution No. 908, expanding the boundaries of the West Washington - Chapin Development Area to those of the Area described. above. The Commission has conducted a study of the Area, and of the West Washington - Chapin Allocation Area (South Bend Allocation Area No. 7), coterminous with the Area. The Commission has determined that it is of public utility and benefit to change the base assessment date for property within the Area from March 1, 1987, to March 1, 1992, and that the public health and welfare will be benefitted by the acquisition and redevelopment of the Area permitted thereby. This finding for the Area is based on the following facts: 1. The blighting conditions identified in Resolution No. 818, including the presence of vacant and, abandoned or vacant buildings, old buildings, substandard structures, and property tax delinquencies, which conditions were found in Resolution No. 908 to extend to the West Washington- Chapin Development Area, as expanded, continue to exist within the Area notwithstanding the redevelopment efforts undertaken by the Commission in the Area since 1987. 2. The presence of blight within the Area, as indicated by the continued presence of the above -noted bl.ighting conditions, necessitates and warrants continued redevelopment activities within the Area by the Commission. 3. Tax increment revenues generated within the Area are necessary to fund continued redevelopment efforts within the Area. 4. Tax increment generated within the Area has diminished to the point that the Area is generating negative increment, due to the reduction in the aggregate assessed value of real property within the Area over the past years. 5. The aggregate assessed value of real property within the Area as of the base assessment date of March 1, 1987, was approximately $9,154,834. 6. The aggregate assessed value of real property within the Area as of March 1, 1991, was approximately $8,041,555. SOU, BEND REDEVELOPMENT COMMISSION Paula N. and WHEREAS, the Area Plan Commision of St. Joseph County at its regular meeting March 16, 1993, approved its Resolution No. 116 -93, which Resolution constituted the written.order of the Area Plan Commission of St. Joseph County approving Resolution No. 1.138 as it pertains to the Development Plan for the Area pursuant to IC 36- 7- 14 -16; and WHEREAS, the Commission. submitted to the South Bend Common Council, legislative body for the City of South Bend, St. Joseph County, Indiana, Resolution No. 116 -93 of the Area Plan Commission of St. Joseph County, constituting the Area Plan Commission's written order approving Resolution No. 1138 and its certification that Resolution No. 1138 as it pertains to the Development Plan conforms to the master plan of development for the City of South Bend; and WHEREAS, the South Bend Common Council, at its regular meeting, March 22, 1993, adopted its Resolution No. 2026 -93 approving the order of the Area Plan Commission of St. Joseph County with regard to the base assessment date change for property within the Area; and WHEREAS, after receipt of the written order of approval of the Area Plan Commission of St. Joseph County, Indiana, and approval of the South Bend Common Council, the Commission caused to be published ,► notice of the adoption and substance of Resolution No. 1138, in accordance with IC 5 -3 -1, with such notice also stating that maps and plats have been preparedd and can be inspected at the office of the Redevelopment Department and naming May 7, 1993, at 10:00 a.m., at 1308 County -City Bldg., South Bend, Indiana, as the date, time, and alley; thence South along the centerline of said alley to the intersection of the centerline of the first East -West 16.5 foot alley; thence East along the centerline of said alley to the intersection of � the West right -of -way line of Studebaker Street; and WHEREAS, the Commission. submitted to the South Bend Common Council, legislative body for the City of South Bend, St. Joseph County, Indiana, Resolution No. 116 -93 of the Area Plan Commission of St. Joseph County, constituting the Area Plan Commission's written order approving Resolution No. 1138 and its certification that Resolution No. 1138 as it pertains to the Development Plan conforms to the master plan of development for the City of South Bend; and WHEREAS, the South Bend Common Council, at its regular meeting, March 22, 1993, adopted its Resolution No. 2026 -93 approving the order of the Area Plan Commission of St. Joseph County with regard to the base assessment date change for property within the Area; and WHEREAS, after receipt of the written order of approval of the Area Plan Commission of St. Joseph County, Indiana, and approval of the South Bend Common Council, the Commission caused to be published ,► notice of the adoption and substance of Resolution No. 1138, in accordance with IC 5 -3 -1, with such notice also stating that maps and plats have been preparedd and can be inspected at the office of the Redevelopment Department and naming May 7, 1993, at 10:00 a.m., at 1308 County -City Bldg., South Bend, Indiana, as the date, time, and place of the Commission's receipt and hearing of remonstrances and objections from persons interested in or affected by the proceedings pertaining to the proposed change in the base assessment date for property within the Area and to determine the public utility and benefit of the proposed base assessment change for property within the Area; and WHEREAS, the Department of Redevelopment, having studied the same with respect to each taxing unit that is wholly or partly within the West Washington- Chapin Allocation Area (South Bend Allocation Area No. 7), described above, has prepared and mailed to each such taxing unit a statement disclosing the impact of the change from March 1, 1987, to March 1, 1992, of the base assessment date for property within the West Washington- Chapin Allocation Area (South Bend Allocation Area No. 7), including: (A) The estimated economic benefits and costs incurred by the allocation area, as measured by increased employment and anticipated growth of real property assessed values, and (B) the anticipated impact on tax revenues of each such taxing unit; and WHEREAS, at the hearing held by the Commission May 7, 1993, at 10:00 a.m., at 1308 County -City Building, South Bend, Indiana, the Commission heard all persons interested in the proceedings and received written remonstrances and objections that had been filed, and considered those remonstrances and objections, if any; and WHEREAS, the Commission is cognizant of the conditions that are 'x imposed under Title VI of the Civil Rights Act of 1964, as amended, providing that no person shall, on the grounds of race, age, sex, color, religion, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking and carrying out of any federally- assi.sted.project. NOW, THEREFORE., BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, as follows: 1. After considering the evidence presented at its hearing May 7, 1993, the Commission confirms the change in the base assessment date from March 1, 1987, to March 1, 1992, for property within the West Washington- Chapin Allocation Area (South Bend. Allocation Area No. 7), coterminous with the West Washington - Chapin Development Area, and adopts and confirms the Findings of Fact for that Area, Exhibit A, attached to this resolution and made a part hereof. 2. The Commission finds and determines that it will be of public utility and benefit to proceed with the change in base assessment date for property within the Area, as set forth in Resolution No. 1138, adopted by the Commission on February 19, 1993, and that the public health and welfare will be benefitted by the acquisition and redevelopment of the Area permitted thereby. 3. Resolution No. 1138 is hereby approved, ratified, and confirmed without change.. 4. This Resolution constitutes final action, pursuant.to IC 36- 7- 14- 17(c), by the Commission determining the public utility and benefit of the proposed base assessment date change from March 1, 1987, to March 1, 1992, for property within the Area and confirming Resolution No. 1138, pertaining to the West Washington- Chapin Allocation Area (South Bend Allocation Area No. 7) and West Washington- Chapin Development Area. 5. The Secretary is directed to record this resolution pursuant to the requirements of IC 36- 7- 14- 17(c). Adopted at a regular meeting of the South Bend Redevelopment Commission held on May 7, 1993, at the office of the Commission, 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
