A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND
WHEREAS, the City of South Bend., Indiana, Department of Redevelopment
has appropriated and condemned the following described real property
situated in St. Joseph County, Indiana.:::
A lot or parcel of land in the West Half (1/2) of
the Northwest Quarter (1/4) of Section No. Thirteen
(13), Township No. Thirty -seven (37) North, Range
No. Two (2) East, described as follows, viz:
Beginning on the West line of South Michigan Street,
in the City of South Bend, at the Southeast corner
of the Plat of South Bend City, as platted by Samuel
Morrison, now within. and. a part of the City of South
Bend; thence running South on the West line of
Michigan Street, 35 feet; thence West 10 rods, more
or less, to the. East line of a public alley; thence
North on the East line of said alley, 35 feet;
thence East 10 rods, more or less, to the place of
beginning, and now known as Lot Lettered A as shown
on the recorded Plat of Stull's Third Addition to
the City of South Bend. Key No. 18- 8004 -0192,
( "Real Property "); and
WHEREAS, pursuant to I.C.. 36- 7 -14 -3 the South Bend Redevelopment
Commission ( "Commission ") is the governing body of the City of South
Bend Department of Redevelopment and, pursuant to I.C. 36 -7 -14 -12.2
is authorized to dispose of the Real Property; and
WHEREAS, the Commission is desirous of conveying its interest in
the Real.Property to the City of South Bend, Indiana; and
WHEREAS, the City of South Bend is desirous of receiving the Real
Property from the Commission; and
WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board.of Public Workss of
the City of South Bend (the "Board ") has custody of and may maintain
all real property of the City of South Bend; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend,
acting by and through the Board, may exchange or transfer property
with another governmental entity upon terms and conditions agreed
upon by the two (2) entities as evidenced by the adoption of
substantially identical resolutions of each entity; and
WHEREAS, the Commission has agreed to convey its interest in the
Real Property to the City-of South Bend, and the City of South Bend,
acting by and through the Board, has agreed to accept the Real
Property from the Commission for One Dollar ($1.00) and other good
and valuable consideration..
�dOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION AS FOLLOWS:
1. That the conveyance of the following- described real property
by the South Bend Redevelopment Commission to the City of South Bend,
acting by and through its Board of Public Works:
A lot or parcel of land in the West Half (1/2) of
the Northwest Quarter (1/4) of Section No. Thirteen
(13), Township No. Thirty -seven (37) North, Range
No. Two (2) East, described as follows, viz:
Beginning on the West line of South Michigan
Street, in the City of South Bend, at the Southeast
corner of the Plat of South Bend City, as platted
by Samuel Morrison, now within and a part of the
City of South Bend; thence running South on the
West line of Michigan Street, 35 feet; thence. West

as shown on the recorded Plat of Stull's Third

for One Dollar and other good and valuable consideration, shall be,
and hereby is, approved, subject.to the adoption of a resolution by
the Board of Public Works of the City of South Bend, substantially
identical in its terms and conditions as this resolution.
2. That the President and Secretary of the Commission shall be,
and hereby are, authorized to execute and attest to the execution of,
respectively, a Quit Claim Deed to effectuate such conveyance.
3. That this Resolution shall be in full force and effect upon
its adoption by the South Bend Redevelopment Commission.
ADOPTED at a- meeting of the South Bend Redevelopment Commission
held on December 18, 1992, . at 1308 County -City Building, 227 West
Jefferson Boulevard, South Bend, Indiana 46601.
