HomeMy WebLinkAboutNo. 1195 authorizing and approving the transfer of real property in the Studebaker corridor development planRESOLUTION NO. 1195 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION AUTHORIZING AND APPROVING THE TRANSFER OF REAL PROPERTY IN THE STUDEBAKER CORRIDOR DEVELOPMENT AREA WHEREAS, the City of South Bend on behalf of its Department of Redevelopment appropriated and condemned certain real property in the Studebaker Corridor Development Area, now a part of and within the Sample -Ewing Development Area, for use in the redevelopment of the Studebaker Corridor Development Area; and WHEREAS, among the property condemned and appropriated by the City of South Bend on behalf of its Department of Redevelopment were numerous parcels of real property situated in what the South Bend Redevelopment Commission has designated as Block 10 of the Studebaker Corridor Development Area; and WHEREAS, among the parcels of property condemned and appropriated by the City of South Bend on behalf of its Department in Block 10 of the Studebaker Corridor Development Area was a narrow strip of land of what was formerly railroad right -of -way (Parcel K); and WHEREAS, at the time Parcel K was condemned and appropriated by the City of South Bend on behalf of its Department title was held jointly by four separate parties; and WHEREAS, at the time Parcel K was condemned and appropriated by the City of South Bend on behalf of its Department one of the parties, Howard R. Goodhew, indicated his interest in acquiring full fee title to Parcel K, for use in the development of his business, Ridge Auto Parts, which is adjacent to Parcel K; and WHEREAS, the Commission has determined that the best use of Parcel K, a strip of land approximately 26' x 4031, is for use in the development and improvement of the Ridge Auto Parts property; and WHEREAS, the Commission has determined that no other viable use for Parcel K exists; and WHEREAS, as a part of the comprise of the condemnation action concerning the Block 10 properties, the City of South Bend on behalf of its Department agreed to transfer all right, title and interest in Parcel K which it had condemned to Howard R. Goodhew. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the real property hereinabove referred to as Parcel K, and more fully described at Exhibit "A," hereto, shall be transferred to Howard R. Goodhew. 2. That the President and Secretary of the Commission shall be and hereby are authorized, respectively, to execute, and attest to the execution of a quitclaim deed conveying all of the right, title and interest of the City of South Bend, Department of Redevelopment in and to Parcel K to Howard R. Goodhew. Adopted at the regularly scheduled meeting of the South Bend Redevelopment Commission held October 1, 1993 at 10:00 a.m., 1308 County -City Building, 227 W. Slfafp', SeyXetary EXHIBIT "A" That part of the West half of the Northwest quarter of Section 13, T. 37 N., R. 2 E., City of South Bend, St. Joseph County, Indiana which is described as: Beginning at a Point on the North line of Indiana Ave. which is S. 89 °11'59" E., 169.21 ft. from the intersection of the East line of Lafayette Street (said street being 50.00 f t. wide) and the North line of Indiana Ave. in said City of South Bend; thence N. 00 °00'47" W., 403.21 ft.; thence N. 89 °11159" E., 25.77 ft.; thence S. 00 009134" E. along the East line of the former Penn Central Railroad, 403.20 ft.; thence S. 89 011'59" W. along the North line of Indiana Ave. 26.80 ft. to the Point of Beginning. Containing 0.243 acres. The above - described parcel represents the East half of a part of the vacated former Penn Central Railroad.
