Substitute Bill No. 76-OS
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA AMENDING CHAPTER 2, ARTICLE 1, SECTION 2-3.1 OF THE SOUTH
BEND MUNICIPAL CODE TO ADDRESS THE DATE AND THE LOCATION OF THE
MAYOR'S ANNUAL ADDRESS TO THE COMMON COUNCIL
STATEMENT OF PURPOSE AND INTENT
In 1988, the South Bend Common Council passed Ordinance No. 7862-88 which
required the Mayor to annually address the Council on the "statement of finances and the general
condition of the city".
It has been determined that the existing requirements of the South Bend Municipal Code
which call for what is now commonly referred to as the "Mayor's State of the City Address "and
takes place at the second regularly scheduled Council meeting in January of each year, need to
be amended. The .current provisions do not allow sufficient flexibility for preparation and
presentation of that address. Additionally, there may be instances when the location of this
Council meeting may need to be moved from the Council Chambers.
This ordinance would set the presentation of the Mayor's State of the City address to be
at the first Council meeting in February of each year; and provide for a mechanism to move the
location of that Council meeting, when necessary.

Section I. Chapter 2, Article 1, Section 2-3.1 of the South Bend Municipal Code be and hereby
is amended to read as follows:
Section 2-3.1. Mayor's Annual Address to Council
~ The Mayor shall annually address the Common Council at theme first regularly
scheduled Council meeting each~~ February.
The Mayor shall provide a statement of finances and a general condition of the City
in his or her annual address.

~) If the Council meeting location needs to be moved from the Council Chambers for
the Mayor's annual address in any calendar year, an announcement shall be made by the Council
President at the 1St, or, 2°d re ularl, scheduled Common Council meeting in December of the
prior year under the "Special Business" portion of that meeting announcing the exact location for
that meeting.
Section II. This ordinance shall be in full force and effect from and after its passage by the
Common Council, approval by the Mayor and legal publication.

The attached version of Substitute Bill No. 76-OS will amend § 2-3.1 of the South
Bend Municipal Code which addresses the "Mayor's Annual Address to Council".
It would:
• Change the date of the Mayor's Annual Address from the 2d meeting
in January to the 1St meeting in February of each year; and
• Provide that an announcement be made at the 2d regularly scheduled
Ann Puzzello Council meeting in January identifying the exact location of the 1St
Fourth District regular Council meeting in February.

Fifth District These changes are being recommended to allow the Mayor additional time and
flexibility to prepare for the address. Each year, the speech, handouts and the
Ervin Kuspa power point presentation are enhanced; and this additional two-week time period
Sixth District would be time well spent. Additionally, recent past practice has required that the
location for the Mayor's. Annual Address be moved from the Council Chambers
Al "Buddy" Kirsits to another location, so that all technology and space needs can be properly
