Attached to this memorandum is a professional service proposal to complete a variety of items
related to and because of the James Oliver Memorial. The City of South Bend, through the financial
participation of the Redevelopment Commission, recently constructed and dedicated the James
Oliver Memorial within the Oliver industrial Park. The project was built on a parcel that was planned
from the inception of the park to be used for the memorial. At a point in time, the parcel was
transferred to Rose Brick, the adjacent property owner, as they were going to assist in the memorial
development and it was believed that the time that the memorial could be developed privately and
on a private parcel. With the City's participation in the development of the plaza and memorial, and
more importantly the statue, it is imperative that the parcel be returned to the City so that the
memorial can remain and be charged as a city asset.
The scope of work to be provided by Danch, Harner and Associates includes the following work
items:
- Survey fieldwork to delineate plaza and all features to be rededicated to the City
- Preparation of a Special Use exception and multiple variances
- Preparation of a Subdivision Plat
The total amount of the project budget based on the scope of work is $12,875.00 and staff requests
a total project amount of $14,000.00 to cover incidental expenses (title work, monumentation, etc).
Additionally, staff requests Commission approval to allow the plat and any related documentation by
Don Inks in his capacity as Director of Economic Development.
Finally, staff requests Commission approval to allow Danch, Harner and Associates to represent the
Commission at the various approval meetings related to this project.
Staff requests Commission approval of these various requests.

RE: Planning Services cost quote for Special Exception, Variance Petition &
Subdivision Replat for Lots #2 and #3 of the Oliver Plow Works First Major —
Section One, South Bend, Indiana. Also know as The James Oliver Memorial and
Rose Brick & Materials, respectively.
Dear Mr. Schalliol:
Please accept this letter as our written cost quote to provide your Department with
Surveying and Planning Services for a Subdivision Replat of Lot #2 (The Oliver
Memorial) and Lot #3 (Rose Brick & Material) located within the Oliver Industrial Park.
The subdivision replat is required, as the lot line between the properties is proposed to be
adjusted.
The Planning service required entails submitting to the Area Board of Zoning
Appeals a petition for approval of two (2) Special Exceptions and several Variances.
Special Exception 1 would be to allow the Oliver Memorial to exist within the Oliver
Industrial Park (zoning "General Industrial ") as a Passive Park as defined in the City
Zoning Codes. Special Exception 2 would be for approval of the amount of existing
outside storage allowed for Rose Brick & Materials When the property lines are adjusted
the lots and their uses must conform to the latest City Zoning Codes. We would also
request several Variances for the reconfigured properties for setbacks for the Park
improvements, frontage and parking requirements. We would request several Variances
for the Rose Brick & Material property for setbacks along the perimeter boundary of the
site and for landscaping screening and perimeter trees. This is to bring them into
compliance with the "GI" development standards.
Our scope of services would be as follows:
Task A:
Execution of Survey fieldwork to establish existing conditions and current boundary data
for the above described properties and location of all existing improvements on both
properties.

Task B:
Preparation of a Special Use Exception for 2 uses and a Petition to request approval of
multiple Variances for the reconfigured lots as described above, including Preliminary
Site Plan, Application forms, Notice of public Hearing, Notice to adjacent owners and
representation at Board of Zoning Appeals Public Hearing, City Council Land Use
Planning Committee, and South Bend Common Council Public Hearing(s).

Cost of submittal fees, mailings & legal advertisement .........................$575-$675
Task C:
Preparation of a Subdivision Replat for the properties described above. This would be
prepared in accordance with the City of South Bend Subdivision Control Ordinances.
The Subdivision Replat would include the preparation of the Site Plan with all required
Subdivision Replat information, the application forms and re- flagging and setting
required new property corners.
Cost for the preparation of the Subdivision Replat .......................................$ 3,200
Cost of filing fees would be approximately ................ ............................... $ 400
If revisions were requested by any review agency or the City, those revisions would be
done at our standard hourly rates, which are attached.
If the above proposal is acceptable, we could start the required work within 5 -7
working days or less. We would plan to be able to submit for the November 15`"
deadline for the Area Board of Zoning Appeals for a December 7th Public Hearing and
either January meetings before the City Council.
We will require a signature from the Rose Brick & Materials and the City to represent
the owners at the BZA Public Hearing.
