Seven of these properties have houses of varying sizes, with the remaining two having smaller commercial buildings. Before demolition specs can be written for these properties, an asbestos inspection report must be completed for each of them. On April 12, 2011, the Commission approved 41 properties to have asbestos reports completed. Because of nearby houses not yet under Commission ownership, only 24 of these properties were chosen for demolition. It is anticipated that once these asbestos reports are completed, most of the remaining 26 structures will be bid out for demolition. Grauvogel & Associates, who completed asbestos reports for many of the original 41 properties, provided a proposal for the nine remaining properties, in the amount of $2,930. We understand that the following properties are included in this second group: Ignition Park South Expansion Project 1503 -05 South Kemble 1513 South Chapin 1510 Kendall 1525 South Kemble 1518 South Chapin 1521 -27 Kendall 1527 South Kemble 1520 -26 South Chapin 1518 South Scott This investigation will be for purposes of compliance with the National Emissions Standards for Hazardous Air Pollutants ( NESHAPS), specifically the regulations governing asbestos in buildings to be demolished. The proper language for these materials under NESHAPS is regulated asbestos - containing materials (RACM), which includes friable ACM and non - friable ACM that could become friable as a result of the mechanical forces acting upon them during demolition. These are referred to as NESHAP Category I and II non - friable ACM. This terminology is used below. SCOPE OF SERVICES Grauvogel & Associates will provide the services of qualified asbestos inspectors, asbestos project designers, professional engineers and support staff to perform the following: • conduct an inspection of each structure to identify the types and quantities of suspect regulated asbestos - containing materials (ACM) present; to include friable regulated RACM and potentially friable Category 1/II non - friable ACM • collect sufficient samples of the suspect ACM, and provide laboratory analysis by an EPA recognized laboratory to identify the ACM • prepare a summary report of the types, locations and quantities of the ACM • complete the appropriate sections of the IDEM Notification of Demolition and Renovation Operations; provide the Notification in printed and electronic format for the use by the Commission and prospective demolition contractors 17660 Fall Creek Drive • Granger, Indiana 46530 • Phone 574.277.4770 • Fax 574.277.5281 South Bend Redevelopment Commission Ignition Park ACM Demolition Proposal — Batch 2 9/23/2011 Page 2 �y identify as part of the survey other materials that will need special consideration for demolition; this will include, but not be limited to fuel oil tanks (above and below ground) and RCRA hazardous wastes (paint, oil, household wastes) Suspect asbestos - containing material sampling will follow the protocol established by the EPA in the AHERA regulations (40 CFR 763) for schools. Although these regulations do not have jurisdiction over these buildings, they present a logical, comprehensive protocol for identification of ACM which gives accurate and reproducible results. Our protocol will incorporate the following definitions: • ALL: We will identify and classify all accessible materials. • ACCESSIBLE: Only materials which are accessible without penetration behind existing walls, floors and ceilings will be sampled; multiple layers on these surfaces will be sampled. • ASSUMED: Suspect ACM enclosed behind existing walls, floors and ceilings will be assumed to be the same material as those portions of the surface or similar surfaces which are accessible. • Our scope of services under this Agreement does not include assistance during the design, bid procurement or construction phases of the project. We can provide these services on request for an additional fee once the results of the sampling under this proposal have identified the structures involved. COMPENSATION For providing this Scope of Services, Grauvogel & Associates will be paid on an hourly rate basis, in accordance with the following schedule, plus reimbursable expenses: Classification Hourly Rate Certified Industrial Hygienist $100.00 IDEM Asbestos Inspector/Planner $100.00 Certified Hazardous Materials Manager $100.00 Reimbursable expenses will consist of laboratory charges and sample shipping/handling charges. Compensation under this Agreement will be allocated as follows: LABOR — Per Structure FEE Asbestos - Containing Materials (ACM) Survey $100.00 ACM Survey Report/IDEM Notification 100.00 Subtotal $200.00 REIMBURSABLES — Per Structure ACM Analyses PLM: 6 per structure @ $15.00 each $ 90.00 Basic Fee - Per Structure $290.00 BASIC FEE — All Structures (9) $2,610.00 South Bend Redevelopment Commission Ignition Park ACM Demolition Proposal — Batch 2 9/23/2011 Page 3 ADDITIONAL CHARGES Commercial Buildings (2) $ 200.00 Category I Flooring on concrete: 2 @ $60.00 120.00 TOTAL PROJECT FEE — 9 Structures $2,930.00 The quoted fee for Labor is a fixed amount based on 9 structures, independent of the number of suspect asbestos - containing materials encountered and samples. The number of structures takes into account any multiple structures at combined addresses, except as noted for warehouses. This fee will not be exceeded without prior written justification and approval. Analyses of samples for suspect asbestos - containing materials (ACM) will be invoiced at the stated unit costs. The number of suspect asbestos containing materials (ACM) per structure based on our previous experience with structures of similar size, age and construction is expected to average 6 by PLM per structure. This includes brittle, potentially friable Category II suspect materials. We intend to assume that Category I non - friable materials (resilient flooring, flooring adhesive, asphalt roofing, gaskets) are ACM and do not anticipate the need to sample these at this time. These can remain with the structures for demolition. Older linoleum consisting of two separable layers will be considered Category II potentially friable and sampled if encountered. The only Category I material that will be sampled is resilient flooring attached to concrete, to allow the concrete to be recycled. The actual number of samples needed will be determined in the field. It is not expected to vary greatly from the number quoted. The Commission will be billed for the actual number of samples collected. BASIS OF PROPOSAL The above pricing is based on the following assumptions: • Commission to provide ready access to each structure • Commission to assure that each structure is unoccupied Ready access includes keys or the typical chipboard or plywood sheeting over doors fastened with hex head or #2 square drive multipurpose screws. Locked doors either alone or underneath this sheeting are not considered "ready access ". IDEM allows the demolition of residences with non - friable Category I and II materials in place, except when intentionally burned. We propose to assume such materials to be ACM and document them as such, including their quantities, on the IDEM Notification and in our survey reports. Although it rarely occurs, severely water - damaged resilient flooring, normally a Category I non - friable material even for demolition, may be encountered and need to be classified as potentially friable for demolition. A confirming analysis for this type of material will be needed and is done by TEM. TEM analysis for Category I flooring on concrete is included in this pricing, but if potentially friable Category I flooring is encountered the need for this additional analysis will be brought to the Commission's attention for action. TIME OF COMPLETION • from receipt of the formal Notice -to- Proceed to completion of the field survey -- 1 week South Bend Redevelopment Commission Ignition Park ACM Demolition Proposal — Batch 2 9/23/2011 Page 4 from completion of the field survey until submission of the Survey Report and IDEM Notification -- 2 weeks This schedule includes the laboratory analysis time. We are normally able to schedule the field survey within 5 working days of the Notice -to- Proceed. BILLING and PAYMENT One invoice will be issued at the completion of the project. ADMINISTRATION We trust that this Agreement adequately sets forth the terms and conditions between us. If so, please sign, date and return one copy of the Agreement to us as our official Notice to Proceed. If you prefer to issue a purchase order, please reference this Agreement.
