Home My WebLink AboutNo. 1323 accepting the transfer of real property from the COSB (Keasey, Columbia, Wenger, Dean Johnson Park, Paris)0 0 Resolution No. 1323 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, for the use and benefit of its Park Department (the "City ") is the owner of the certain real property situated in St. Joseph County, Indiana and being more particularly described at Exhibit "A," hereto (hereinafter referred to as the "Real Property "); and WHEREAS, pursuant to I.C. 36- 10- 4 -9(a), said Real Property is under the exclusive control of the Board of Park Commissioners of the Park District of the City of South Bend (hereinafter referred to as the "Park Board "); and WHEREAS, the City of South Bend, Department of Redevelopment (Redevelopment), acting by and through the South Bend Redevelopment Commission ( "Commission "), hereby expresses its desire to acquire Real Property from the City; and ke WHEREAS, the City is desirous of transferring the Real Property to Redevelopment and to that end the Park Board adopted at its meeting of February 20, 1995, a resolution indicating its intent to transfer the Real Property to the Commission; and WHEREAS, pursuant to I.C. 36- 10 -4 -18, the City may transfer park property upon the approval of the Common Council of the City of South Bend, Indiana; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and more particularly described at Exhibit "A," hereto, by the City of South Bend, Indiana, for the use and benefit of its Park Department to the City of South Bend, Department of Redevelopment shall be, and hereby is, accepted, subject to the adoption of an ordinance by the South Bend Common Council approving the same. 2. That upon receipt of fully executed quitclaim deed (s) to the Real Property from the City, the Director of Redevelopment is hereby authorized and directed to cause the recording of said quitclaim deed (s) in the Office of the St. Joseph County Recorder. 0 0 3. That this Resolution shall be in full force and effect upon its adoption.
