A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMIISSION APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND
WHEREAS, the City of South Bend, Indiana, for the use and
benefit of its Department of Redevelopment owns or is negotiating
for the purchase of the following- described real property situated
in St. Joseph County, Indiana:
Parcel I:
Lot Numbered One Hundred Sixty -four (164) as shown on
the recorded Plat of Wengers & Kreighbaum Replat of a
part of M.L. Wenger's Sixth Addition to the City of
South Bend, excepting a tract of land forty (40) feet
in width, North and South, taken off of and from the
entire South end of said Lot 164. Key No. 18-7014-0525.
Parcel II:
Lot Numbered One Hundred Sixty -three (163) as shown on
the recorded Plat of Wengers & Kreighbaum Replat of a
part of M.L. Wenger's Sixth Addition recorded April 1,
1903 in the Office of the Recorder of St. Joseph
County, Indiana, in Plat Book 8, page 103. Key No. 18-
7014 -0526. Commonly known as 506 Pennsylvania, South
Bend, Indiana
Parcel III:
Lot Numbered One Hundred Sixty -two (162) as shown on
the recorded Plat of Wengers & Kreighbaum Replat of a
part of M.L. Wenger's 6th Addition to the City of South
Bend, recorded April 1, 1903 in the Office of the
Recorder of St. Joseph County, Indiana, in Plat Book 8,
page 103. Key No. 18- 7014 -0527. Commonly known as 510
Pennsylvania Street
Parcel IV:
Lot Numbered One Hundred Sixty -one (161) as shown on
the recorded Plat of Wengers & Kreighbaum Replat of a
part of M.L. Wenger's 6th Addition recorded April 1,
1903 in the Office of the Recorder of St. Joseph
County, Indiana, in Plat Book 8, page 103. Key No. 18-
7014 -0528. Commonly known as 516 Pennsylvania Street
Parcel V:
Lot Numbered One Hundred Sixty (160) and a tract of
land two (2) feet in width, East and West, taken off of
and from the entire length of the West side of Lot
Numbered One Hundred Fifty -nine (159), as shown on
Wengers & Kreighbaum Replat of a part of M.L. Wenger's
Sixth Addition to the City of South Bend, recorded
April 1, 1903 in the Office of the Recorder of St.
Joseph County, Indiana, in Plat Book 8, page 103, St.
Joseph County, Indiana, excepting therefrom a tract of
land described as beginning at the Southwest corner of
said Lot Numbered One Hundred Sixty (160) running
thence North along the West line of said Lot seventy -
six (76) feet; thence East forty -two (42) feet; thence
South seventy -six (76) feet to a point two (2) feet
East on the Southeast corner of Lot Numbered One
Hundred Sixty (160) ; thence West forty -two (42) feet to

Parcel VI:
All of Lot Numbered One Hundred Fifty -nine (159),
excepting therefrom a strip of land two (2) feet in
width, East and West, taken off of and from the entire
length of the West side thereof; also a strip of land
two (2) feet in width East and West taken off of and
from the entire length of the West side of Lot Numbered
One Hundred Fifty -eight (158 as shown on the recorded
Wenger's & Kreighbaum Replat of as part of M.L.
Wenger's Sixth Addition to the City of South Bend,
recorded April 1, 1903 in the Office of the Recorder of
St. Joseph County, Indiana, in Plat Book 8, page 103.

(hereinafter collectively referred to as the Real Property) and;
WHEREAS, the South Bend Redevelopment Commission (the
Commission) is the governing body of the City of South Bend,
Department of Redevelopment, pursuant to I.C. 36- 7 -14 -3; and
WHEREAS, the Commission, is desires to transfer the Real
Property to the City of South Bend, Indiana; and
WHEREAS, structures are currently located upon Parcels II,
III, IV, and V of the Real Property; and
WHEREAS, the City of South Bend is desirous of acquiring the
Real Property from the Commission but desires that the Commission
assume financial responsibility for the removal of the structures
from Parcels II, III, IV, and V of the Real Property; and
WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public
Works of the City of South Bend (the "Board ") has custody of and
may maintain all real property of the City of South Bend; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend,
acting by and through the Board, may exchange or transfer property
with another governmental entity upon terms and conditions agreed

upon by the two (2) entities as evidenced by the adoption of
substantially identical resolutions of each entity; and
WHEREAS, the Redevelopment, acting through the Commission,
and pursuant to I.C. 36- 7- 14- 12.2(a)(3), may exchange or transfer
property with another governmental entity upon terms and conditions
agreed upon by the two (2) entities as evidenced by the adoption of
substantially identical resolutions of each entity; and
WHEREAS, the Commission desires to transfer the Real
Property to the City of South Bend, agrees to assume the
responsibility of causing the removal of the structures from the
indicated Parcels of the Real Property, and the City of South Bend,
acting by and through the Board, has agreed to accept the transfer
of the Real Property from the Commission under this condition and
for the payment of a nominal consideration.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That the transfer of the following described real property
situated in St. Joseph County, Indiana by the City of South Bend,
Department of Redevelopment, acting by and through the South Bend
Redevelopment Commission to the City of South Bend, Indiana:
Parcel I:
Lot Numbered One Hundred Sixty -four (164) as shown on
the recorded Plat of Wengers & Kreighbaum Replat of a
part of M.L. Wenger's Sixth Addition to the City of
South Bend, excepting a tract of land forty (40) feet
in width, North and South, taken off of and from the
entire South end of said Lot 164. Key No. 18-7014-0525.

Wenger's Sixth Addition to the City of South Bend,
recorded April 1, 1903 in the Office of the Recorder of
St. Joseph County, Indiana, in Plat Book 8, page 103.

for the sum of One Dollar ($1.00) apiece, and subject to the
condition that the Commission assume financial responsibility for
causing the removal of the structures situated upon Parcels II,
III, IV, and V of the Real Property, and subject to the adoption of
a resolution by the Board of Public Works of the City of South Bend
substantially identical in its terms and conditions to the terms
and conditions of this resolution shall be, and hereby is,
approved.
2. That the President and Secretary of the Commission shall be,
and hereby are, authorized, respectively, to execute and attest to
the execution of a quitclaim deed conveying all its right, title
and interest in and to the Real Property to the City of South Bend
upon the occurrence of the condition set forth immediately above.
3. That this Resolution shall be in full force and effect upon
its adoption by the South Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment
Commission held on May 5, 1995, at 1308 County -City Building, 227
West Jefferson Boulevard, South Bend, Indiana 46601.
