HomeMy WebLinkAboutNo. 1397 approving the transfer of property to the COSBResolution 1397 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF PROPERTY TO THE CITY OF SOUTH BEND WHEREAS, the City of South Bend, Indiana, for the use and benefit of its Department of Redevelopment owns the following - described property situated in St. Joseph County, Indiana: A part of Lots Numbered Eleven (11) and Twelve (12) as shown on the recorded Plat of Hiram F. Berst's Subdivision of Out Lot 73 of the First Plat of Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, which part is bounded by a line running as follows: Beginning at a point 108 feet West of the Northeast corner of Lot 14 in said Subdivision, thence running West on the North line of said Sub - lot 11 to the Northwest corner thereof; thence South on the East line of Chapin Street in said City 71 feet; thence East to a point due South of the place of beginning; thence 71 feet to the place of beginning. Commonly known as 202 Chapin Street. Key No. 18- 3050 -1947 (hereinafter, the Real Property) and The residential structure located upon the following- described real property situated in St. Joseph County, Indiana: A part of Bank Out Lot Numbered Seventy -one (71) of the First Plat of Bank Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, described as beginning at a point 52 feet South of the Northwest corner of said Bank Out Lot Numbered Seventy -one (71), which point is 32 feet South of the Southeast corner of Chapin and Napier Streets in said City of South Bend; thence East on a line 32 feet South of and parallel to the South line of said Napier Street, a distance of 118.14 feet; thence South 57.1 feet; thence West 118.14 feet to the East line of said Chapin Street; thence North on the East line of said Chapin Street a distance of 57.1 feet to the place of beginning. Commonly known as 306 South Chapin Street, said structure commonly known as the Bivens house (hereinafter, the Structure) and; WHEREAS, the South Bend Redevelopment Commission (the Commission) is the governing body of the City of South Bend, Department of Redevelopment, pursuant to I.C. 36- 7 -14 -3; and WHEREAS, the Commission desires to transfer the Real Property and Structure the City of South Bend with the intent and upon the condition that the City of South Bend reconvey the real property to the South Bend Heritage Foundation, Inc. (SBHF) for the sum of One Dollar ($1.00) for use by SBHF in its revitalization of the West Washington- Chapin Revitalization Area and with the understanding that SBHF will cause the relocation of the Structure to the Real Property and that the Structure, once relocated to the Real Property, will be rehabilitated to house an African American Resource Center, the same to be completed within twelve (12) months of the relocation of the Structure to the Real Property; and WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Redevelopment, acting through the Commission, and pursuant to I.C. 36- 7- 14- 12.2(a)(3), may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property and Structure, as described above, by the City of South Bend, Department of Redevelopment, acting by and through the South Bend Redevelopment Commission to the City of South Bend, Indiana for the sum of One Dollar ($1.00) and pursuant to the terms and restrictions set forth above, shall be, and hereby is, approved. 2. That the President and Secretary of the Commission shall be, and hereby are, authorized, respectively, to execute and attest to the execution of a warranty deed to the Real Property and a quitclaim deed and bill of sale to the Structure conveying all its right, title and interest in and to the Real Property and Structure to the City of South Bend upon the occurrence of the condition set forth immediately above. 3. That this Resolution shall be in full force and effect upon its adoption by the South Bend Redevelopment Commission. a, ADOPTED at a meeting of the South Bend Redevelopment Commission held on December 1, 1995, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
