A. South Bend Central Development Area
(1) Resolution No. 2934 terminating a
Contract for Sale of Land for Private
Development between JeffCourt, Inc. and
the South Bend Redevelopment
Commission dated June 6, 2008, and a
Development Agreement by and between
South Bend Redevelopment Commission
and JeffCourt, Inc. dated June 6, 2008.
Mr. Relos noted that Resolution No. 2934
terminates a Contract for Sale of Land for
Private Development between JeffCourt, Inc.
and the South Bend Redevelopment
Commission dated June 6, 2008, and a
Development Agreement by and between the
South Bend Redevelopment Commission and
JeffCourt, Inc. dated June 6, 2008. On April
12, 2011, the Commission authorized
Richard Nussbaum II, Attorney-at-Law, to
prepare notices of default for the Contract for
Sale, First Amendment to the Contract, and
Development Agreement with Jeffcourt, Inc,
for the Commission-owned lot at the
northwest corner of Jefferson and St. Joe
streets.
As part of these agreements, Jeffcourt had
certain obligations, which have not been met.
Because these obligations have not been met,
Jeffcourt is in default of the agreements. The
two most noteworthy defaults are:
• Property was to be closed on by
December 15, 2008.

• Project excavation was to begin by
March 15, 2009, with construction
completed within 24 months and a
certificate of occupancy issued.
Mr. Nussbaum has followed the notification
process required by these agreements, and
Jeffcourt has failed to cure the defaults
within the 30-day cure period. This
resolution terminates the agreements between
the Commission and Jeffcourt, and will allow
the property to be available for future
development. Staff requests your approval of
Resolution No. 2934.
Ms. Jones asked whether there are penalties
when a Contract for Sale is terminated. Mr.
Relos responded that they forfeit their
performance guarantee, in this case it is
$60,000.
Mr. Varner whether their might be an appeal.
Mr. Nussbaum responded that Jeffcourt has
not responded to any of our communications.
He would be surprised if they would contest
the Commission's action.

A. South Bend Central Development Area
(2) Resolution No. 2933 approving and
authorizing the execution of an Addendum
to the Master Agency Agreement
(Memorial Hospital Streetscape
Improvements Project, Bid Packages 3
and 4.
Mr. Relos noted that Resolution No. 2933
and its Addendum to the Master Agency
Agreement deals with the next two phases of
streetscape improvements around the
Memorial Hospital campus. This Addendum
is for Supplemental Agreement No. 2 from
DLZ, which, through the Board of Public
Works, will design and prepare construction
and final plans, perform surveying, right of
way platting, utility engineering, and will
provide a statement of probable construction
costs for those next two phases.
The main improvement projects to be
completed around the Memorial campus in
the next three years are:
• Demolition of selected structures and
parking lot improvements on both the
east and west sides of the 400 block
of N. Michigan St.
• Facade improvements to the buildings
on the east side of Michigan between
Bartlett and Navarre, the Mar Main
Pharmacy building, and the skywalk
over Michigan St.
• A new, more prominent entrance
road, which will allow visitors to
more readily identify where to enter
the hospital. This new road will be
called Park Lane.

Mr. Relos noted that this Addendum covers
what is referred to as Phase 3 and 4, the first
and third components listed above. The
facade improvements are currently being
designed by the Troyer Group.
These three components will create a unified
look for the Memorial campus, will make a
dramatic entrance corridor into the
downtown core, and compliment the work
that has recently been completed north of
LaSalle Street. Staff requests approval of
Resolution No. 2933, and the Addendum to
the Master Agency Agreement, in the amount
of$320,700.
Mr. Varner asked if anything would be
physically accomplished with these requested
funds. Mr. Inks responded that this money
will lead to construction, but these funds are
not for construction. It has to do with the
engineering, studies and research.

Mr. Relos noted that on May 24 the
Commission approved a professional
services agreement in the amount of$14,900
with the Troyer Group to design facade
improvements for the Memorial Hospital
campus. As this process has progressed, it
has expanded from facades only to include
cohesive design features for the open parking
and landscaped areas between Bartlett and
Navarre. In addition, staff would like to
include the old Nipsco building at the corner
of Michigan and La Salle into the facade
improvement program.
To accommodate these changes, an
addendum to the May 24 agreement covers
architectural services for final concept
boards, two concepts for the Nipsco building,
and providing preliminary construction costs
for all components of the project. The cost
for these additional services is $4,600, plus
expenses.
Staff requests approval of this Professional
Services Agreement Addendum in a not-to-
exceed amount of$5,000.

(4) Request to advertise for Parking
Management Services.
Ms. Jennings noted that staff last bid out
parking management services in 2008. The
result of that was a three year contract with
Ampco Parking Services which expires
January 31, 2012. The request for proposals
will be for the parking garages located at
Wayne St., Leighton Plaza, and at Main and
Colfax streets. Staff requests approval to
advertise bids for parking management
services.
Mr. Inks asked if the request was also for on-
street parking enforcement. Ms. Jennings
responded that it was, for the area bounded
roughly by Western Ave., William on the
south west, Colfax and LaSalle on the north
and Michigan and St. Joseph Streets on the
east.
Mr. Inks noted that there have been changes
in state law regarding contracting so the
city's legal department is still reviewing this
to make sure we are in compliance with the
changes. Staff requests approval subject to
final legal review.
Upon a motion by Mr. Varner, seconded by COMMISSION APPROVED THE REQUEST TO
Mr. Alford and unanimously carried, the ADVERTISE FOR PARKING MANAGEMENT
Commission approved the request to SERVICES,SUBJECT TO FINAL LEGAL REVIEW,
WITH RECEIPT OF BIDS TO BE BY OCTOBER 25,
advertise for Parking Management Services, 2011
subject to final legal review, with receipt of
bids to be by October 25, 2011.

B. Airport Economic Development Area
(1) Resolution No. 2935 setting a Public
Hearing on the appropriation of tax
increment financing revenues from the
Airport Economic Development Allocation
Area for the payment of certain
obligations and expenses related to their
respective allocation areas and other
related matters.
Mr. Inks noted that Resolution No. 2935 sets
a Public Hearing for 4:00 p.m.,
September 13, 2011, on the appropriation of
tax increment financing revenues from the
Airport Economic Development Allocation
Area.
The Controller asked the Redevelopment
Commission early in the year not to
appropriate everything until it was actually
needed. We are at a point were we have
gone through all of the money that has been
appropriated. The current appropriation for
the Airport area is being used for projects
that are either under contract or in the
process of being bid. To continue with other
projects, we need additional funds to operate.
Mr. Varner asked if staff will delineate the
projects at the time of the public hearing.
Mr. Inks responded that he has a draft of a
schedule similar to the one provided for the
last appropriation showing the original,
second, and third appropriations and the
projects related to each. Mr. Varner asked
how much has been appropriated so far this
year. Mr. Inks responded over $20,000,000.

of property in the Airport Economic
Development Area (1527 S. Kemble).
Mr. Relos noted that 1527 S. Kemble was
added to the Airport Economic Development
Area Acquisition List by Resolution
No. 2668 on May 21, 2010 in an effort to
clean and clear the southern boundary of
Ignition Park, and to help stabilize the Rum
Village neighborhood to the south. This
particular property is a two story rental with
three units. Total square footage is 1,932.
All three units are one bedroom, one bath.
All units are currently leased.
Resolution No. 2928 sets the acquisition
value of the property at $32,000, the average
value as determined by two independent
appraisals. Staff requests approval of
Resolution No. 2928.

(3) Administrative Settlement for acquisition
of 1527 S. Kemble.
Mr. Relos noted that the owner of 1527 S.
Kemble has made a counter offer to the
above purchase offer in the amount of
$65,000. This property is a large,
extensively remodeled two story rental.
Recent improvements include:
• 3 years ago new windows were
installed in two of the units, and new
floor coverings in all three units
• 5 years ago the house was insulated
and siding put on
The income stream from this property is
$1,025 per month. Using a 12% cap rate, the
annualized investment property value is
calculated to be almost $75,000. Staff feels
the acquisition cost of$65,000 is reasonable
for this property, and requests approval of the
administrative settlement in the amount of
$33,000.
Mr. Relos also noted that in the last several
months, we've made great progress in the
Ignition Park South expansion areas. We've
had difficulty moving forward on Kemble
and Kendall Streets but in the last several
months it has broken loose a little and this is
one of the houses on Kemble St. that would
help us reach our goal of buying all the
properties along Kemble.
Mr. Varner questioned the use of the 12%
cap rate. In this economy 12% seems
excessive. Mr. Relos responded that banks

usually rate at 10%. The higher cap rate
brought the value down.
Upon a motion by Mr. Varner, seconded by COMMISSION APPROVED THE ADMINISTRATIVE

Commission approved the Administrative KEMBLE IN THE AMOUNT OF$65,000.

(4) Resolution No. 2929 related to acquisition
of property in the Airport Economic
Development Area (1530 S. Kemble).
Mr. Relos noted that 1530 S. Kemble was
added to the Airport Economic Development
Area Acquisition List by Resolution
No. 2668 on May 21, 2010. This particular
property is an 8,400 square foot vacant lot at
the corner of Kemble and Indiana Ave.
Resolution No. 2929 sets the acquisition
value of the property at $3,650 the average
value as determined by two independent
appraisals. The property owner is willing to
sell for the set value of$3,650. Staff
requests approval of Resolution No. 2929.

Mr. Relos noted that 1526 S. Catalpa. was
added to the Airport Economic Development
Area Acquisition List by Resolution
No. 2668 on May 21, 2010. This particular
property is a two story vacant house in poor
condition. It is a three bedroom, one bath,
1,392 square foot structure.
This property was purchased by the
Commission in the March 2010 County
Commissioner Tax Sale, and was later
redeemed. It is currently listed on the
County's September 14, 2011 tax sale for the
$2,040.16 in back taxes. The property could
be redeemed again between now and tax sale
time.
Resolution No. 2930 sets the acquisition
value of the property at $2,500. Staff
requests approval.
Mr. Varner asked whether the property could
be redeemed after it goes to tax sale. Mr.
Relos responded that the owner would have
to pay all the back taxes this time in order to
redeem it. According to the Auditor's Office,
they only had to pay taxes for one year to
redeem it last time.

Mr. Relos noted that 1517 S. Kendall was
added to the Airport Economic Development
Area Acquisition List by Resolution
No. 2668 on May 21, 2010. This particular
property is a vacant two story rental. It is a
four bedroom, one bath, 1,216 square foot
structure.
Resolution No. 2931 sets the acquisition
value of the property at $21,250, the average
value as determined by two independent
appraisals. Staff requests approval of
Resolution No. 2931, to allow for the
acquisition of this property.

Mr. Relos noted that the staff has been
working with the property owner of 1517 S.
Kendall to reach a reasonable agreement to
acquire this property. This property is a
large, newly remodeled two story rental. The
income stream from this property is $642 per
month. Using a 12% cap rate, the annualized
investment property value is calculated to be
a little more than $44,000. The owner has

agreed to sell this property for $44,000. Staff
feels that is reasonable for this property, and
requests approval of the administrative
settlement .
