A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana, Department of
Redevelopment (Redevelopment) is the owner of the following
described real property situated in St. Joseph County, Indiana:
See attached Exhibit "A"
(hereinafter referred to as the Real Property),and;
WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend
Redevelopment Commission (Commission) is the governing body of the
City of South Bend, Department of Redevelopment and, pursuant to
I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and
WHEREAS, Redevelopment, through the Commission, is desirous of
transferring the Real Property to Ivy Tech State College for the
sum of Five Hundred Seventy -five Thousand Dollars ($575,000.00),
with the understanding that Ivy Tech State College will construct
a post- secondary public educational institution on the Real
Property; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting
through the Commission and the City, acting by and through the
Board, may exchange or transfer property with one another upon
terms and conditions agreed upon by the two (2) entities as
evidenced by the adoption of substantially identical resolutions of
each entity.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property situated in St.
Joseph County, Indiana, and generally described as follows:
See attached Exhibit "A"
for the sum of Five Hundred Seventy -five Thousand Dollars
($575,000), by the City of South Bend, Indiana, Department of
Redevelopment to Ivy Tech State College, for use in the
development of a post- secondary public educational institution,
shall be, and hereby is, approved.
2. That the President and Secretary of the South Bend
Redevelopment Commission shall be, and hereby are, authorized,
respectively, to execute and attest to the execution of a
quitclaim deed conveying all of the right, title and interest in
the Real Property to Ivy Tech State College.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment
Commission held at 1300 County -City Building, 227 W. Jefferson
Boulevard, South Bend, Indiana 46601 on September 6, 1996.

EXHIBIT A - LEGAL DESCRIPTION
That part of the Northwest Quarter of Section 13, Township 37
North, Range 2 East, Portage Township, City of South Bend, St.
Joseph County, Indiana, which is described as: Beginning at a
point on the East line of Michigan Street which is South 00
degrees 13 minutes 30 seconds West, 25.00 feet from the
Northwest corner of Lot AC as shown on the recorded Plat of
Hutchin's Addition ", as recorded in the Office of the Recorder
of St. Joseph County, Indiana; thence South 89 degrees 50
minutes 03 seconds East, 1393.81 feet; thence South 44 degrees
23 minutes 15 seconds East, 63.14 feet to a point which is
North 88 degrees 56 minutes 28 seconds West, 35.00 feet from the
centerline of Fellows Street; thence along the Westerly line of
Fellows Street, South 01 degree 03 minutes 32 seconds West,
741.49 feet to a point on the North line of a 14 foot wide
public alley; thence along the North line of said alley the
next three (3) course, South 89 degrees 49 minutes 22 seconds
West, 1001.10 feet and South 00 degrees 28 minutes 55 seconds
West, 6.10 feet and North 89 degrees 56 minutes 38 seconds
