rw A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana, Department of
Redevelopment (Redevelopment) is the owner of the following
described real property situated in St. Joseph County, Indiana:
A part of the of the Northeast Quarter of Section 13, T.
37 N. R. 2 E., Portage Township, City of South Bend, St
Joseph County, Indiana which is described as: Lot "A"
of the Plat of " Wenger's 6th Addition to the City of
South Bend First Replat & Wengers & Krieghbaum's Replat
of a part of M.L. Wenger's 6th Addition to the City of
South Bend Second Replat" recorded as Document No.
9639730 in the Records of the St. Joseph County
Recorder's Office. Subject to all legal highways,
easements and restrictions of record.

(collectively hereinafter referred to as the Real Property),and;
WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend
Redevelopment Commission (Commission) is the governing body of the
City of South Bend, Department of Redevelopment and, pursuant to
I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and
WHEREAS, Redevelopment, through the Commission, is desirous of
transferring the City of South Bend, Indiana for subsequent
transfer to the South Bend Heritage Foundation, Inc. (SBHF) an
Indiana non - profit corporation exempt fropm taxation under Section
501(c) of the Internal Revenue Code, for the sum of Ten Dollars
($10.00), for use by SBHF in its Sample -Ewing Development house
move project; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting
through the Commission and the City, acting by and through the
Board, may exchange or transfer property with one another upon
terms and conditions agreed upon by the two (2) entities as
evidenced by the adoption of substantially identical resolutions of
each entity; and
WHEREAS, the Board of Public Works, at its meeting of ,
1996 will consider its Resolution No. , accepting the
transfer of the Real Property from the City of South Bend, for the
use and benefit of its Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property situated in St.
Joseph County, Indiana, and generally described as follows:
A part of the of the Northeast Quarter of Section 13, T.
37 N. R. 2 E., Portage Township, City of South Bend, St
Joseph County, Indiana which is described as: Lot "A"
of the Plat of " Wenger's 6th Addition to the City of
South Bend First Replat & Wengers & Krieghbaum's Replat
of a part of M.L. Wenger's 6th Addition to the City of
South Bend Second Replat" recorded as Document No.
9639730 in the Records of the St. Joseph County
Recorder's Office. Subject to all legal highways,
easements and restrictions of record.

Joseph County, Indiana which is described as: Lot "B"

South Bend Second Replat" recorded as Document No.

easements and restrictions of record.

Recorder's Office. Subject to all legal highways,
easements and restrictions of record.
for the sum of Ten Dollars ($10.00), by the City of South Bend,
Indiana, Department of Redevelopment to the City of South Bend,
Indiana, for subsequent transfer to the South Bend Heritage
Foundation, Inc., for use in its Sample -Ewing Development Area
house move project, shall be, and hereby is, approved.
2. That the President and Secretary of the South Bend
Redevelopment Commission shall be, and hereby are, authorized,
respectively, to execute and attest to the execution of a
quitclaim deed conveying all of the right, title and interest in
the Real Property to the City of South Bend, Indiana.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment
Commission held at 1300 County -City Building, 227 W. Jefferson
Boulevard, South Bend, Indiana 46601 on December 1, 1996.
