On August 9, 2011 the Redevelopment Commission approved the purchase of property at 622 East Sample Street, one of the last pieces of property in an area proposed for future development as an expansion of the Southeast Neighborhood Park. The property was purchased on August 30, 2011. Both 622 and 718 East Sample Street are now owned by the Redevelopment Commission. The proposed project consists of demolishing a residence (622 East Sample) and storage building (718 East Sample), the removal of foundation walls, non -city sidewalks, the capping of utilities and the clearing of trees, stumps, brush and assorted debris (within the hatch - marked areas of the attached map), and regarding and seeding of the land. This work will allow the site to be ready for future development as well as help increase the safety of the surrounding area. Bid specifications prepared by the Department of Engineering are attached to this memo. To provide the price element prior to consideration, our office is coordinating with Engineering to open bid quotes for the project at the Monday, September 12, 2011 Board of Public Works meeting (that information will be forwarded to you as soon as it's available). Pending approval from the Commission, a bid would be awarded at the September 26, 2011 Board of Public Works meeting. NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: Section 1. The Commission hereby approves the Addendum to Master Agency Agreement (Demolition of 622 and 718 East Sample Street) and hereby authorizes its execution in substantially the form attached hereto with such changes as the Commission may deem necessary or appropriate upon the advice of counsel, said execution thereof to be conclusive evidence of the Commission's approval of such changes. Street The project includes the furnishing of all equipment, material, and labor for the demolition of two buildings located at 622 and 718 East Sample Street within the City of South Bend. Work to be performed shall include the removal of multiple structures, and all other appurtent work on the site as specified in these documents. Compact fills and subbase materials to 100% standard proctor maximum dry density. Testing will be done by nuclear gauge. Testing will be completed by an independent testing agency. All costs associated with material testing will be considered incidental to the project. Testing locations shall be chosen by the owner or owner's representative. The number of tests will be at the discretion of the owner based upon compaction methods and fill material. PREVAILING SPECIFICATIONS AND DESIGN & CONSTRUCTION STANDARDS The City of South Bend's PREVAILING SPECIFICATIONS, most recent version, and DESIGN & CONSTRUCTION STANDARDS, most recent version, are to be used on this project. Each bidder is specifically instructed to become completely familiar with the PREVAILING SPECIFICATIONS and the DESIGN & CONSTRUCTION STANDARDS prior to submitting a bid. These SPECIAL PROVISIONS will list only "Additions" or "Deletions" to the PREVAILING SPECIFICATIONS and are to be used only in conjunction with the PREVAILING SPECIFICATIONS. INSURANCE A. Prevailing Specifications: 2010, INDOT Standard Specifications Section 103 B. Additions: All Contractors and subcontractors doing business with the City of South Bend shall present a Certificate of Insurance showing coverage in the following minimum amount: General Liability: Premises - Completed Operations or Products, Bodily Injury and Property Damage Combined Single Limit - $5,000,000 or $750,000 per person. There shall be no exclusion for explosion, collapse or underground hazard. Workmen's Compensation: Statutory State of Indiana Employer's Liability - $100,000. Auto Liability: Bodily Injury and Property Damage Combined Single limit - $1.000,000 City of South Bend shall be named as additional insured on the Certificate. the date of final completion as set forth in the final completion affidavit. IV. WAGE RATES A. Prevailing Specifications: 2010, INDOT Standard Specifications Section 103 B. Additions: 1. The attached wage rates are applicable to this project. The successful Bidder is required to submit Form 347, Weekly Payroll form, to the EEO Compliance Officer within two (2) weeks of the applicable payroll date. 2. The Contractor shall post at the job site any and all information required to comply with EEO guidelines. 3. The Contractor, and any sub - contractors, shall submit a schedule of wages to be paid on the project prior to beginning work on the site. V. TAX EXEMPT A. Prevailing Specifications: None B. Additions: Materials and properties purchased under contract with the Owner that becomes a permanent part of the structure or facilities constructed are not subject to the Indiana Gross Retail Tax (Sales Tax). The exemption number will be furnished to the Contractor upon award. VI. PROSECUTION AND PROGRESS A. Prevailing Specifications: 2010, INDOT Standard Specifications Section 108 B. Additions: 1. The completion time for this project is thirty (30) calendar days from Notice to Proceed. 2. The Contractor will send the Notice of Demolition to IDEM and EPA upon the Owner's notice of award. Notice to Proceed will be effective upon the end of the ten working day notification period for the notice of demolition. The IDEM notification form shall be provided as included in these specifications. 3. Contractor shall provide a schedule of demolition prior to beginning any work on the site. VII. RETAINAGE AND FINAL PAYMENT A. Prevailing Specifications: 2010, INDOT Standard Specifications Section 109 B. Additions: 1. Payments may be requested once every calendar month. 2. There will be a five percent (5 %) retainage. 3. Before final payment is released, the Contractor must satisfy the following: a. All parts and labor meet requirements stated in the specifications. b. Provide copies of test reports or cut sheets on all materials supplied. C. One (1) copy of the Completion Affidavit and one (1) copy of a Waiver of Lien are submitted to the City of South Bend. Department of Public Works. VIII. CONCRETE APPROACH, SIDEWALK, AND CURB REMOVAL A. Prevailing Specifications: 2010. INDOT, Standard Specifications Section 202 B. Additions: All curb, sidewalk, and approaches surrounding the site is to REMAIN. Any damage by the contractor to the existing curb, sidewalk, or approaches shall be replaced at the owner's discretion at no additional cost to the owner or increase in contract amount. IX. DEMOLITION AND CLEARING A. Prevailing Specifications: None B. Additions: Demolition Procedure a. All demolition procedures shall be conducted in such a way that non - regulated asbestos - containing materials on or within the structures shall remain non - friable. b. The Contractor will be required to arrange and pay for disconnection of any utilities remaining in place. c. The use of explosives on the site will not be permitted. No open fires or burning will be permitted. d. Use water sprinkling, temporary enclosures, and other suitable methods to limit the amount of dust and dirt rising and scattering into the air. Do not use water when it may create hazardous or objectionable conditions such as ice, flooding, and pollution. e. The Contractor shall remove all the structures and their contents and all walkways, driveways, steps, slabs, pavements whether concrete or asphalt, fences, retaining walls, signs and foundations, bushes, shrubs, trees including stumps, and any other such items from the property. The contractor shall protect all existing sidewalk and curb. f. In all cases where it is necessary to work on the public right of way, including the sidewalks and alleys, the Contractor shall submit a traffic control plan to the Engineer for approval prior to beginning the work at that structure. The Contractor will provide all barricades, warning signs and lights, flaggers, or other methods in compliance with the Indiana Manual for Uniform Traffic Control Devices to control traffic. Alleys shall be used wherever possible for truck and equipment access to the structures. No tracked vehicles shall be operated on public streets or public sidewalks. Loading of debris into trucks located within the right of way will not be approved without proof that there is no other way to accomplish the work with damage to private property. g. All existing sewer and water mains on the site will be capped at the property line and removed. The Contractor shall coordinate the termination and removal of the sewer and water mains with the Owner. Documentation in the form of an as -built sketch is to be provided where the sewer and water lines were capped at the ROW line. Photo documentation is also required. h. All concrete generated from the demolition of the structures and appurtenances shall be removed from the site and disposed of as provided in these Specifications. i. All demolition debris, rubbish, and all other material removed from the site as part of the work shall be transported in a lawful manner to landfill(s) or other disposal facilities licensed to receive such material. The Contractor shall inform the Owner in writing of the identity of those facilities, the nature of materials disposed there, and a statement from the facility that it is licensed to receive such material prior to any work starting on site. Trucks leaving the work area shall be adequately covered, protected and secured to prevent debris from spilling or blowing from the trucks during transport. j. Foundation walls of the buildings are to be removed to their full depth. Underfloor water pipe, sewer pipe, electric wire and conduit, ducts, valves, tunnels, and all other constructed appurtenances shall be completely removed. Crushed in place will not be permitted. k. Backfill shall be clean sand or sand and gravel free of roots, clay, or other deleterious materials meeting INDOT's borrow specification. Backfill shall be compacted in thin lifts with a vibratory roller compactor using the number of passes recommended by the manufacturer to compact that thickness of lift to one hundred (100) percent of standard proctor maximum dry density, ASTM D698. Backfill shall be approved by the owner prior to placement. The owner may disapprove Backfill deemed unsuitable at the owner's discretion. Any unsuitable backfill delivered or placed on the site prior to approval shall be removed at no additional cost to the owner. I. After backfilling the ground shall be graded with a 0.5' to 1' depression sloping towards the middle of the site. The grading shall remove any ruts or hole caused by demolition equipment or procedures on the site. The site shall receive 4 inches of rich topsoil and hydroseed upon completion of grading. The topsoil shall be free of R XI. GE any debris and a sample must be approved prior to placement. m. The site shall be secured by the Contractor with a temporary 6' tall chain link fence. n. Any Dewatering required in order to properly remove underground utilities will be considered incidental to the project. All costs associated with dewatering shall be included in the demolition cost of the project. o. Payment for all items under Demolition and Clearing shall be included in the Lump Sum price in the proposal. TOPSOIL AND SEED A. Prevailing Specifications: 2010, INDOT Standard Specification Section 621 B. Additions: The entire project site shall receive four (4) inches of rich topsoil (from an offsite source, approved by the Owner) and be graded prior to the placement of seed. The Contractor is responsible for watering for thirty (30) calendar days after placement of the seed per the schedule set forth in the Prevailing Specifications. Hydroseed shall be utilized for this project. Payment for the Seeding and Topsoil shall be included in the Lump Sum Price for Site Restoration as set forth in the proposal. MAINTENANCE OF TRAFFIC A. Prevailing Specifications: 2010, INDOT Standard Specifications Sections 105 & 801 B. Additions: 1. Maintenance of traffic during construction shall conform to the 'Indiana Manual on Uniform Traffic Control Devices" and the City of South Bend Design and Construction Standards. 2. The Contractor shall arrange and prosecute the work specified for this contract in such a manner that traffic on existing streets is unrestricted throughout the project. The Engineer shall approve the method of traffic control. No construction equipment, vehicles, materials, supplies or temporary facilities shall be left unattended in the right -of- way of any street or left parked overnight without proper marking and lighting. 3. After the award of the contract and before beginning the work, the Contractor shall submit his proposed schedule of operations for the review of the Engineer. The schedule of operations as reviewed by the Engineer shall be maintained at all times. 4. There will be no direct payment for this work. OTHER UTILITIES A. Prevailing Specifications: None B. Additions: 1. The Contractor shall verify the locations of all utilities by contacting Indiana 811 at 1 -800- 382 -5544 at least two (2) working days, not counting Saturdays, Sundays or federal and state holidays before proceeding with construction. It is also the Contractors responsibility to contact any other utility that is not contacted by Indiana 811 and verify the utility locations. 2. The Contractor shall be responsible for working with the other utilities, i.e., gas electric, telephone, etc. in order to assure that all utilities that need to be replaced or relocated can be done with a minimum disturbance to service. The contractor shall also be responsible for coordinating schedules with the various utilities such that they can proceed with their relocation work as efficiently as possible. 3. If the odor of natural gas is detected in a work area at any time during the course of work, the Contractor shall immediately notify NIPSCO at 1- 800 - 634 -3524. The Contractor shall also immediately notify the residents of adjacent properties. The Contractor shall advise the residents to evacuate their homes immediately if the odor is present within the dwelling. 4. Restoration of sprinkler systems damaged by the Contractor's operations will be repaired by the Contractor at no additional cost to the City or the Owner of the system. XIII. INDEMNIFICATION A. Prevailing Specifications: None B. Additions: Contractor agrees to indemnify, defend and hold harmless the City of South Bend, its agents, officers and employees, from all costs, losses, claims and suits, including court costs, attorney fees, and other expenses, arising from or out of the negligent performance of this Contract by Contractor, or because or arising out of any defect in the goods, materials or equipment supplied by the Bidder. When the prospective Contractor is unable to certify to any of the statements below, it shall attach an explanation to this Affidavit. Contractor agrees that he /she /it shall enroll in and verify the work eligibility status of all of Contractor's newly hired employees through the E -Verify Program as defined by I.C. 22- 5- 1.7 -3. Contractor's documentation of enrollment and participation in the E -Verify Program is included and attached as part of this bid/quote; and 4. Contractor shall require his/her /its subcontractors performing work under this public contract to certify that the subcontractors do not knowingly employ or contract with an unauthorized alien, nor retain any employee or contract with a person that the subcontractor subsequently learns is an unauthorized alien, and that the subcontractor has enrolled in and is participating in the E -Verify Program. The Contractor agrees to maintain this certification throughout the term of the contract with the City of South Bend, and understands that the City may terminate the contract for default if the Contractor fails to cure a breach of this provision no later than thirty (30) days after being notified by the City. 5. Persons, partnerships, corporations, associations, or joint venturers awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment because of race, sex, religion, color, national origin, ancestry, age, or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions may consider the Contractor's good faith efforts to obtain participation by those Contractors certified by the State of Indiana as a Minority Business ( "MBE ") or as a Women's Business Enterprise ( "WBE ") as a factor in determining the lowest, responsible, responsive bidder. In no event shall persons or entities seeking the award of a City contract be required to award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate against said WBE/MBE. A finding of a discriminatory practice by the City's MBE /WBE Utilization Board shall prohibit that person or entity from being awarded a City contract for a period of one (1) year from the date of such determination, and such determination may also be grounds for terminating the contact for which the discriminatory practice or noncompliance pertains. 6. It shall be presumed that an employee is a skilled worker in that classification, and entitled to receive compensation at the skilled rate, unless the worker satisfies all of the criteria for being categorized as a semi - skilled or unskilled worker. Semi - skilled: An individual registered in a bona fide apprenticeship program registered with the United States Department of Labor, Employment and Training Administration, Bureau of Apprenticeship and Training. Apprentices are paid pursuant to their individually warranted percentage for the classification of work that they perform as set forth in the apprentice program standards. Unskilled: An individual with less than twelve months of cumulative experience in the construction trades and who is not registered in a bona fide apprenticeship program. The above definitions shall not apply to workers in the classification of Laborer. Common Construction Wage Determination inStBTC version 2 3 Of 4 Apprenticeship Programs: The Wage Committee determines that the common practice in the county is for contractors to participate in bona fide apprenticeship programs registered with the U.S. Department of Labor, Bureau of Apprenticeship and Training and that the rate of pay for the classifications of labor that participate in such programs is based in part on a percentage of the journeyman's rate (skilled rate herein) depending on the individual's progress in the program. Workers engaged in such an apprenticeship program will be permitted to work at less than the predetermined rate set out above for the work they perform. Such apprentices must be paid at not less than the rate specified in the registered program for the apprentice's level of progress, expressed as a percentage of the journeymen hourly rate which is the skilled hourly rate in this wage scale. Any worker who is not registered or otherwise employed in a bona fide apprenticeship program registered with the U.S. Department of Labor, Bureau of Apprenticeship and Training and has twelve or more months of cumulative experience in the construction trades shall be paid at the skilled wage rate on this wage determination for the classification of work actually performed by the worker regardless of how the employer classifies such a worker. Disputes regarding the appropriate classification of workers and the amounts said workers should be paid may be submitted to the Indiana Department of Labor for investigation.
