HomeMy WebLinkAboutNo. 1501 approving the transfer of real property to the COSB for the use and benefit of its park departmentResolution No. 'qW A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY TO THE CITY OF SOUTH BEND, INDIANA FOR THE USE AND BENEFIT OF ITS PARK DEPARTMENT WHEREAS, the City of South Bend, Indiana, Department of Redevelopment (Redevelopment) is the owner of the real property and improvements described at Exhibit A, hereto, situated in St. Joseph County, Indiana, and commonly known as the Coveleski Regional Stadium (hereinafter referred to as the Stadium); and WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission (hereinafter, the Commission) is the governing body of the City of South Bend, Department of Redevelopment and, pursuant to I.C. 36 -7 -14 -12.2 and I.C. 36 -1- 11-8 may dispose of the Real Property; and WHEREAS, the Commission, is desirous of transferring the City of South Bend, Indiana for the use and benefit of its Park Department (City) for the sum of Ten Dollars ($10.00); and WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting through the Commission and the City, acting by and through the Board of Park Commissioners, may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Park Commissioners, at its meeting of April 21, 1997 will consider a Resolution accepting the transfer of the Real Property from the City of South Bend, Indiana, Department of Redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Stadium for the sum of Ten Dollars ($10.00), by the City of South Bend, Indiana, Department of Redevelopment to the City of South Bend, Indiana, for the use and benefit of its Park Department, shall be, and hereby is, approved. 2. That the President and Secretary of the South Bend Redevelopment Commission shall be, and hereby are, authorized, respectively, to execute and attest to the execution of a warranty deed conveying all of the right, title and interest in the Real Property to the City of South Bend, Indiana. 3. That this Resolution shall be in full force and effect upon its adoption by the South Bend Redevelopment Commission. Hunt, President EXHIBIT A A part of Vail's Southwest Addition to South Bend as shown on the Recorded Plat thereof in the St. Joseph County, Indiana, Recorder's Office, more particularly described as follows: Beginning at the Southwest corner of Lot 8, Block 10 of said Vail's Southwest Addition; thence North 00 000100" East along the East line of the north -south alley between Taylor Street and William Street to the Northwest corner of Lot 1, block 10, of said Vail's Southwest Addition; thence North 45 000100" West, 177.00 feet thence South 89 051144" East, 362.00 feet; thence South 45 100100" East, 120.00 feet; thence South 00 000100" West, 310.00 feet; thence South 45 000100" West, 199.53 feet to the North line of South Street; thence North 89 051144" West, along said North line of South Street, 249.52 feet; thence North 89 140105" West, along said North line of South Street, 181.41 feet to the Point of Beginning. Containing 6.547 acres, more or less.
