A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND
WHEREAS, the City of South Bend, Indiana, Department of
Redevelopment (Redevelopment) is the owner of the real property
and improvements described at Exhibit A, hereto, situated in St.
Joseph County, Indiana, (hereinafter "Real Property "); and
WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend
Redevelopment Commission (hereinafter, the "Commission ") is the
governing body of the City of South Bend, Department of
Redevelopment and, pursuant to I.C. 36 -7 -14 -12.2 and I.C. 36 -1-
11-8 may dispose of the Real Property; and
WHEREAS, the Commission, is desirous of transferring the
Real Property to the Board of Public Works of the City of South
Bend ( "Board ") for the sum of Ten Dollars ($10.00); and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting
through the Commission and the City, acting by and through the
Board of Public Works, may exchange or transfer property with one
another upon terms and conditions agreed upon by the two (2)
entities as evidenced by the adoption of substantially identical
resolutions of each entity; and
WHEREAS, the Board of Public Works, at its meeting of April
21, 1997, will consider its Resolution No. , accepting
the transfer of the Real Property from the City of South Bend,
Indiana, Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property for the sum of
Ten Dollars ($10.00), by the City of South Bend, Indiana,
Department of Redevelopment to the Board of Public Works for the
City of South Bend, Indiana, shall be, and hereby is, approved.
2. That the President and Secretary of the South Bend
Redevelopment Commission shall be, and hereby are, authorized,
respectively, to execute and attest to the execution of a
*4W warranty deed conveying all of the right, title and interest in
the Real Property to the Board of Public Works of the City of
South Bend, Indiana.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment
Commission held at 1300 County -City Building, 227 W. Jefferson
Boulevard, South Bend, Indiana 46601 on April 4, 1997.

EXHIBIT A - LEGAL DESCRIPTION
That part of the Northeast Quarter of Section 13, Township 37
North, Range 2 East, City of South Bend, St. Joseph County,
Indiana, which is known as a portion of Lot Sixty -six (66) and
Lots Sixty -seven (67) through Seventy -three (73), a portion of
the South Half of vacated Keasey Street lying North of and
adjacent to said Lots, the vacated alley between said Lots
Sixty -nine (69) and Seventy (70) and the West Half of vacated
Rush Street lying East of and adjacent to said Lot
Seventy -three (73) as shown on the recorded Plat of "Wenger's
4th Addition ", recorded in Plat Book 5, on page 40, in the
Office of the Recorder of St. Joseph County, Indiana, and being
more particularly described as: Beginning at the intersection
of the East line of Fellows Street with centerline of vacated
Keasey Street as shown on said recorded plat; thence South 89
degrees 38 minutes 03 seconds East, 394.12 feet to the
centerline of vacated Rush Street; South 00 degrees 16 minutes
40 seconds West along said centerline, 157.07 feet to the
intersection of the centerline of vacated Rush Street with the
South line of said Lot Seventy -three (73), extended East;
thence along the South line of said Lots Sixty -six (66) through
Seventy -three (73) and their South line's Easterly extension,
North 89 degrees 39 minutes 50 seconds West, 368.75 feet;
thence North 01 degrees 03 minutes 32 seconds East, 17.63 feet;
thence North 35 degrees 57 minutes 05 seconds West, 45.70 feet;
thence North 01 degrees 03 minutes 32 seconds East, 102.81 feet
to the point of beginning.
