A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
ACCEPTING THE TRANSFER OF REAL PROPERTY
FROM THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana (the "City ") is the
owner of the following described real property situated in St.
Joseph County, Indiana:
Lot Numbered Forty -four (44) as shown on the recorded
Plat of Martin L. Wenger's Third Addition to the City of
South Bend, dated December 12, 1887, and recorded
December 12, 1887, in the Office of the Recorder of St.
Joseph County, Indiana, in Plat Book 5, page 2, EXCEPTING
THEREFROM the South 5 feet thereof for the widening of
Wenger Street;
Lot Numbered Forty -six (46) as shown on the recorded Plat
of Martin L. Wenger's Third Addition to the City of South
Bend, dated December 12, 1887, and recorded December 12,
1887, in the Office of the Recorder of St. Joseph County,
Indiana, in Plat Book 5, page 2;
and
Lot Numbered Forty -eight (48) as shown on the recorded
Plat of Wenger's Third Addition to the City of South
Bend, dated December 12, 1887, and recorded December 12,
1887, in the Office of the Recorder of St. Joseph County,
Indiana, in Plat Book 5, page 2,
(collectively hereinafter referred to as the Real Property); and
WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works
of the City of South Bend (the "Board ") has custody of and may
maintain all real property of the City of South Bend; and
WHEREAS, the City, through the Board, desires to transfer the
Real Property to the City of South Bend, for the use and benefit of
its Department of Redevelopment for use in the redevelopment of the
Sample -Ewing Development Area; and
WHEREAS, the City of South Bend, Department of Redevelopment,
acting by and through its governing body, the South Bend
Redevelopment Commission desires to acquire the Real Property from
the City of South Bend; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and
through the Board, may exchange or transfer property with another
governmental entity upon terms and conditions agreed upon by the
"aw two (2) entities as evidenced by the adoption of substantially
identical resolutions of each entity; and
WHEREAS, the Board of Public Works, at its meeting of ,
1997 adopted its Resolution No. , approving the transfer
of the Real Property to the City of South Bend, for the use and
benefit of its Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property situated in St.
Joseph County, Indiana, and generally described as follows:
Lot Numbered Forty -four (44) as shown on the
recorded Plat of Martin L. Wenger's Third
Addition to the City of South Bend, dated
December 12, 1887, and recorded December 12,
1887, in the Office of the Recorder of St. Joseph
County, Indiana, in Plat Book 5, page 2,
EXCEPTING THEREFROM the South 5 feet thereof for
the widening of Wenger Street;
Lot Numbered Forty -six (46) as shown on the
recorded Plat of Martin L. Wenger's Third
Addition to the City of South Bend, dated
December 12, 1887, and recorded December 12,
1887, in the Office of the Recorder of St. Joseph
County, Indiana, in Plat Book 5, page 2;
and
Lot Numbered Forty -eight (48) as shown on the
recorded Plat of Wenger's Third Addition to the
City of South Bend, dated December 12, 1887, and
recorded December 12, 1887, in the Office of the
Recorder of St. Joseph County, Indiana, in Plat
Book 5, page 2,
by the City of South Bend, Indiana to the City of South Bend, for
the use and benefit of its Department of Redevelopment, shall be,
and hereby is, accepted.
2. That the Director of Redevelopment for the City of South
Bend shall cause the recording of the quitclaim deed conveying all
of the right, title and interest of the City of South Bend, Indiana
in and to the Real Property to the City of South Bend, for the use
and benefit of its Department of Redevelopment.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Commission.
