SO A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana, Department of
Redevelopment (Redevelopment) is the owner of the following
described real property situated in St. Joseph County, Indiana:
Lot Numbered Three Hundred Twenty -six (326) as shown on
the recorded Plat of Wenger and Kreighbaum's First
Broadway Addition to the City of South Bend, excepting
therefrom a strip of land 50 feet in length, North and
South, taken off of and from the entire width of the
North end thereof. Commonly known as 301 East
Broadway,
and
Lot Numbered Three Hundred Twenty -eight (328) as shown
on the recorded Plat of Wenger & Kreighbaum's First
Broadway Addition, recorded in the office of the
Recorder of St. Joseph County, Indiana, in Plat Book 9,
page 13,
(hereinafter referred to as the Real Property), and;
WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend
Redevelopment Commission (Commission) is the governing body of
the City of South Bend, Department of Redevelopment and, pursuant
to I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and
WHEREAS, the Commission, is desirous of transferring the
property to the City of South Bend, Indiana, for the sum of Ten
Dollars ($10.00); and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting
through the Commission and the City, acting by and through the
Board of Public Works (Board), may exchange or transfer property
with one another upon terms and conditions agreed upon by the two
(2) entities as evidenced by the adoption of substantially
identical resolutions of each entity; and
WHEREAS, the Board of Public Works, at its meeting of August
4, 1997 will consider its Resolution No. 62 -1997, accepting the
transfer of the Real Property from the City of South Bend, for
the use and benefit of its Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:

1. That the transfer of the Real Property situated in St.
Joseph County, Indiana, and generally described as follows:
Lot Numbered Three Hundred Twenty -six (326) as shown on
the recorded Plat of Wenger and Kreighbaum's First
Broadway Addition to the City of South Bend, excepting
therefrom a strip of land 50 feet in length, North and
South, taken off of and from the entire width of the
North end thereof. Commonly known as 301 East
Broadway,
and
Lot Numbered Three Hundred Twenty -eight (328) as shown
on the recorded Plat of Wenger & Kreighbaum's First
Broadway Addition, recorded in the office of the
Recorder of St. Joseph County, Indiana, in Plat Book 9,
page 13,
for the sum of Ten Dollars ($10.00), by the City of South Bend,
Indiana, Department of Redevelopment to the City of South Bend,
Indiana, for subsequent transfer to South Bend Heritage
Foundation, Inc., shall be, and hereby is, approved.
rw 2. That the President and Secretary of the South Bend
Redevelopment Commission shall be, and hereby are, authorized,
respectively, to execute and attest to the execution of a
quitclaim deed conveying all of the right, title and interest in
the Real Property to the City of South Bend, Indiana.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment
Commission held at 1300 County -City Building, 227 W. Jefferson
Boulevard, South Bend, Indiana 46601 on August 1, 1997.
