HomeMy WebLinkAboutNo. 1595 approving the transfer of real property to the COSBRJ Resolution No. 1595 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY TO THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, Department of Redevelopment (Redevelopment) is the owner of the following described real property situated in St. Joseph County, Indiana: A part of Lots Numbered Eleven (11) and Twelve (12) as shown on the recorded Plat of Hiram F. Berst's Subdivision of Bank Out Lot Number Seventy -three (73) of the First Plat of Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana , which part is bounded by a line running as follows, viz: Beginning at a point 108 feet West of the Northeast corner of Lot Numbered Fourteen (14) in said Subdivision; thence running West on the North line of said Sublot Number Eleven (11) to the Northwest corner thereof; thence South on the East line of Chapin Street in said City 71 feet; thence East to a point due South of the place of beginning; thence North 71 feet to the place of beginning. Key No. 18 3050 1947; and A part of Lot Numbered Thirteen (13) as shown on the recorded Plat of Hiram F. Berst's Subdivision of Bank Out Lot 73 of the First Plat of Outlots of the Town, now City of South Bend, in St. Joseph County, Indiana, platted by the State Bank of Indiana, which part is bounded by a line running as follows: Beginning 7 feet North of the Southwest corner of said Lot 13; thence North 37 feet; thence East 130.59 feet; thence South 37 feet to a point 7 feet North of the South line of said Lot 13; thence West to the place of beginning. Commonly known as 210 -212 South Chapin Street. Key No. 18 3050 1949, (hereinafter referred to as the Real Property), and; WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission (Commission) is the governing body of the City of South Bend, Department of Redevelopment and, pursuant to I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and WHEREAS, the Commission, is desirous of transferring the property to the City of South Bend, Indiana, for the sum of Ten Dollars ($10.00) ; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting through the Commission and the City, acting by and through the Board of Public Works (Board), may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Public Works, at its meeting of April IV 6, 1998 will consider its Resolution No. , accepting the transfer of the Real Property from the City of South Bend, Department of Redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows: A part of Lots Numbered Eleven (11) and Twelve (12) as shown on the recorded Plat of Hiram F. Berst's Subdivision of Bank Out Lot Number Seventy -three (73) of the First Plat of Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, which part is bounded by a line running as follows, viz: Beginning at a point 108 feet West of the Northeast corner of Lot Numbered Fourteen (14) in said Subdivision; thence running West on the North line of said Sublot Number Eleven (11) to the Northwest corner thereof; thence South on the East line of Chapin Street in said City 71 feet; thence East to a point due South of the rw place of beginning; thence North 71 feet to the place of beginning. Key No. 18 3050 1949, for the sum of Ten Dollars ($10.00), by the City of South Bend, Indiana, Department of Redevelopment to the City of South Bend, Indiana, for subsequent transfer to South Bend Heritage Foundation, Inc., shall be, and hereby is, approved. 2. That the President and Secretary of the South Bend Redevelopment Commission shall be, and hereby are, authorized, respectively, to execute and attest to the execution of a quitclaim deed conveying all of the right, title and interest in the Real Property to the City of South Bend, Indiana. 3. That this Resolution shall be in full force and effect upon its adoption by the South Bend Redevelopment Commission.
