A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana, Department of Redevelopment
(Redevelopment) is the owner of the following described real property situated in St. Joseph
County, Indiana:

a strip of land ten (10) feet in width off of the East end of said lot as platted and
heretofore excepted in the Original Deed of said Lot from Jacob K. Huston and Wife, as
and for an alley. Also excepting and reserving from said Sublot Eleven (11) One Hundred
and Twenty-five (125) feet off of the West end of said lot, heretofore conveyed by
Lucinda Kelley to Catherine Polack leaving of said lot after the foregoing exceptions a
strip forty-seven and three- fourths (47 3/4) feet in width from East to West fronting on

Bank of Indiana, which part is described as beginning at the Northwest corner of said Lot
Numbered Thirteen (13), running thence East Eighty-nine (89) feet; thence South Twenty-
three (23) feet and Eight (8) inches; thence West Eighty-nine (89) feet; thence North to
the place of beginning, ALSO a strip of land Three (3) feet in width lying immediately East
of the above - described land which shall be used for the purpose of ingress and egress to
the above described land with the owners of the land adjoining said Three (3) foot strip on
the East, ALSO a tract of land three and one -half (3 1/2) feet in width, North and South,
taken off the entire length of the South side of Lot Numbered Twelve (12) as shown on

tract of land Ten (10) feet in width, East and West, taken off the entire width of the East
end thereof, which was dedicated to the public use for an alley by Jacob K. Huston. Key

Subdivision of Bank Out Lot Number Seventy-two (72) of the First Plat of Out lots of the
Town, now City of South Bend, platted by the State Bank of Indiana, which part is
described as beginning at the Southwest corner of Lot Thirteen (13), running thence East
89 feet North 23 feet and 8 1/4 inches; thence West 89 feet; thence South to the place of

(hereinafter referred to as the Real Property), and;
WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission
(Commission) is the governing body of the City of South Bend, Department of Redevelopment
and, pursuant to I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and
WHEREAS, the Commission, is desirous of transferring the property to the City of South
Bend, Indiana, for the sum of Ten Dollars ($10.00); and
CO WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting through the Commission
and the City, acting by and through the Board of Public Works (Board), may exchange or transfer
property with one another upon terms and conditions agreed upon by the two (2) entities as
evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the Board of Public Works, at its meeting of , 1998 will
consider its Resolution No. , accepting the transfer of the Real Property from the City
of South Bend, Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and
generally described as follows:

Town, now City of South Bend, platted by the State Bank of Indiana, which part is
described as beginning at the Southwest corner of Lot Thirteen (13), running thence East
89 feet North 23 feet and 8 1/4 inches; thence West 89 feet; thence South to the place of

for the sum of Ten Dollars ($10.00), by the City of South Bend, Indiana, Department of
Redevelopment to the City of South Bend, Indiana, for subsequent transfer to South Bend
Heritage Foundation, Inc., shall be, and hereby is, approved.
2. That the President and Secretary of the South Bend Redevelopment Commission
shall be, and hereby are, authorized, respectively, to execute and attest to the execution of a
quitclaim deed conveying all of the right, title and interest in the Real Property to the City of
South Bend, Indiana.
3. That this Resolution shall be in full force and effect upon its adoption by the South
Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment Commission held at 1300
County-City Building, 227 W. Jefferson Boulevard, South Bend, Indiana 46601 on
