High St.) (SEDA) (2)r , rA Ln RESOLUTION NO. 1606 A RESOLUTION APPROVING AN APPLICATION FOR PERSONAL PROPERTY TAX DEDUCTION WHEREAS, I.C. 6- 1.1- 12.1 -2(1) provides that an application for property tax deduction may not be approved when the property is located in an allocation area as defined in I.C. 36- 7- 14 -39, unless the Redevelopment Commission which designated that allocation area adopts a resolution approving that application; and WHEREAS, the South Bend Common Council has received a petition for five years of personal property tax abatement consideration from Syscon International, Inc. for personal property located at 1108 S. High Street in the Sample -Ewing Development Area, the legal description of which is attached hereto, marked Exhibit "A" and incorporated herein; and WHEREAS, this Commission declared the Sample -Ewing Development Area by Resolution No. 1222, adopted February 4, 1994, and in the same resolution declared the Sample -Ewing Development Area, Allocation Area No. 8; and WHEREAS, the property located at 1108 S. High Street is located within the Sample -Ewing Development Area, Allocation Area No. 8; NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: 1) The Commission finds that the application from Syscon International, Inc. for five years of personal property tax abatement consideration for property located at 1108 S. High Street in the Sample -Ewing Development Area, Allocation Area No. 8, is hereby approved. 2) That a copy of this resolution be forwarded to the South Bend Common Council to indicate the Commission's approval of the petition for personal property tax abatement for Syscon International, Inc. Tax Abatement Petition EXHIBIT "A" LEGAL DESCRIPTION OF THE PROPERTY WHERE THE EQUIPMENT IS TO BE LOCATED: PARCEL I: A part of the Northeast Quarter of Section 13, Township 37 North, Range 2 East, in iie of South Bend Indiana which part is bounded by a line running as follows,viz: Wgnn i g at a point where the Last line of High Street in Martin L. Wenger's Third Addition co the City of South Bend intersects the South boundary line of the right -of -way of the New York Central Railway Company (formerly the Lake Shore and Michigan Southern Railway Company); thence running due South on the East line of High Street (312.36) feet; thence North (89) degrees (3H) ,mminutes East (96.75) feet; thence North parallel to the East line of High Street (7) feet (3 -1/2 aches; thence North (89) degrees (38) minutes East a distance of (110.16) feet to the Westerly line of a wall; thence North (42) feet along the Westerly line of said wall; thence West (0.9) feet along the South line of a wall; thence North (83.3) feet along the West line of a wall; thence East (0.9) feet along the North line of a wall; thence North along West line of a wall and its projection to the Northeasterly boundary (25.37) feet and which point is (209.35) feet due East of the East line of High Street; thence Northwesterly (158.92) feet to a point on the South boundary line of the New York Central Railroad Company; thence Northwesterly along said South boundary (99.86) feet, more or less, to the place of beginning. Also, a permanent non- exclusive easement for egress and ingress described as follows: Beginning at a point on the East line of High Street which is (312.36) feet South of the intersection of the East line of High Street and the Southerly right -of -way line of the New York Central Railroad in the City of South Bend, Indiana; thence North (89) degrees and (38) minutes East, a distance of (96.75) feet; thence South (16) feet; thence South (89) degrees and (38) minutes West, a distance of (96.75) feet, to the East line of High Street; thence North along the East line of High Street (16) feet to the place of beginning.
