Wenger)D Resolution No. 1625 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY TO THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, Department of Redevelopment (Redevelopment) is the owner of the following described real property situated in St. Joseph County, Indiana: Lot Numbered One Hundred Eleven (I 11) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, Key No. 18- 7023 -0883; A lot or parcel of land Ninety (90) feet in length, East and West, taken off of and from the entire width of the West end of Lot Numbered One Hundred Twenty -three (123) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, Key No. 18- 7023 -0901; Lot Numbered One Hundred Fourteen (114) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, Key No. 18- 7023 -0880; and Lot Numbered One Hundred Fifteen (115) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, EXCEPTING THEREFROM a lot or parcel of land 52 feet in length, North and South, taken off of and from the entire width of the South end thereof. Commonly known as 628 Wenger Street. Key No. 18- 7023 -0878 (hereinafter referred to as the Real Property), and; WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission (Commission) is the governing body of the City of South Bend, Department of Redevelopment and, pursuant to I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and WHEREAS, the Commission, is desirous of transferring the property to the City of South Bend, Indiana, for the sum of Ten Dollars ($10.00); and WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting through the Commission and the City, acting by and through the Board of Public Works (Board), may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Public Works, at its meeting of , 1998 will consider its Resolution No. , accepting the transfer of the Real Property from the City of South Bend, Department of Redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows: Lot Numbered One Hundred Eleven (111) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, Key No. 18- 7023 -0883; A lot or parcel of land Ninety (90) feet in length, East and West, taken off of and from the entire width of the West end of Lot Numbered One Hundred Twenty -three (123) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, Key No. 18-7023-0901; Lot Numbered One Hundred Fourteen (114) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, Key No. 18- 7023 -0880; and Lot Numbered One Hundred Fifteen (115) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana, recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21, EXCEPTING THEREFROM a lot or parcel of land 52 feet in length, North and South, taken off of and from the entire width of the South end thereof. Commonly known as 628 Wenger Street. Key No. 18- 7023 -0878 for the sum of Ten Dollars ($10.00), by the City of South Bend, Indiana, Department of Redevelopment to the City of South Bend, Indiana, for subsequent transfer to American Home Dreams, Incorporated, shall be, and hereby is, approved. 2. That the President and Secretary of the South Bend Redevelopment Commission shall be, and hereby are, authorized, respectively, to execute and attest to the execution of a quitclaim deed conveying all of the right, title and interest in the Real Property to the City of South Bend, Indiana. r to 3.
