HomeMy WebLinkAboutNo. 1705 approving the transfer of real property to the SBRAResolution No. 1705 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY TO THE SOUTH BEND REDEVELOPMENT AUTHORITY WHEREAS, the City of South Bend, Indiana, Department of Redevelopment (Redevelopment) is the owner of the following described real property situated in St. Joseph County, Indiana: Parcel I. Lots Numbered Fifty -five (55), Fifty -six (56) and Fifty -seven (57) as shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office of the Recorder of St. Joseph County, in Plat Book 3, page 28, together with the West Half (1h) of the vacated alley lying East and adjacent to Lots Fifty -five (55), Fifty -six (56) and Fifty -seven (57) and together with the North Half (%) of the vacated alley lying South and adjacent to said Lot Fifty -seven (57), and Parcel H. The South Half (1h) of Lot Numbered Forty-four and all of Lot Forty -five (45) as shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 3, page 28, together with the East Half (1h) of the vacated alley lying West of and adjacent to said parcel and together with the North Half (%) of i+ the vacated alley lying South of and adjacent to said Lot Forty-five (45), (collectively hereinafter referred to as the Real Property),and; WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission (Commission) is the governing body of the City of South Bend, Department of Redevelopment and, pursuant to I.C. 36 -7 -14 -12.2 may dispose of the Real Property, and WHEREAS, the Commission, is desirous of transferring the property to the South Bend Redevelopment Authority (Authority) for the sum of Ten Dollars ($10.00); and WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting through the Commission and the Authority may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and CW WHEREAS, the Redevelopment Authority, at its meeting of July 8 , 1999, will consider its Resolution No. 135 , accepting the transfer of the Real Property from South Bend Redevelopment Commission. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COM IISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows: v Parcel I. Lots Numbered Fifty -five (55), Fifty -six (56) and Fifty -seven (57) as shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office of the Recorder of St. Joseph County, in Plat Book 3, page 28, together with the West Half (V2) of the vacated alley lying East and adjacent to Lots Fifty -five (55), Fifty -six (56) and Fifty -seven (57) and together with the North Half (3h) of the vacated alley lying South and adjacent to said Lot Fifty -seven (57), and Parcel R* The South Half (1h) of Lot Numbered Forty -four and all of Lot Forty -five (45) as shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 3, page 28, together with the East Half (1h) of the vacated alley lying West of and adjacent to said parcel and together with the North Half (1h) of the vacated alley lying South of and adjacent to said Lot Forty-five (45), for the sum of Ten Dollars ($10.00), by the City of South Bend, Indiana, Department of Redevelopment, to the South Bend Redevelopment Authority, to finance its purchase through a Section 108 Loan, shall be, and hereby is, approved. 2. That the President and Secretary of the South Bend Redevelopment Commission shall be, and hereby are, authorized, respectively, to execute and attest to the execution of a quitclaim deed conveying all of the right, title and interest in the Real Property to the South Bend Redevelopment Authority. 3. That this Resolution shall be in full force and effect upon its adoption by the South Bend Redevelopment Commission.
