Resolution No. 1636
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
ACCEPTING THE TRANSFER OF REAL PROPERTY
FROM THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana (the "City ") has or
may have an interest in the following described real property
situated in St. Joseph County, Indiana:
See attached Exhibit A
(hereinafter referred to as the Real Property); and
WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works
of the City of South Bend (the "Board ") has custody of and may
maintain all real property of the City of South Bend; and
WHEREAS, the City, through the Board, desires to transfer its
interest in the Real Property, if any, to the City of South Bend,
for the use and benefit of its Department of Redevelopment for
subsequent transfer to St. Joseph County, Indiana for use in the
construction of the new County Jail; and
WHEREAS, the City of South Bend, Department of Redevelopment,
acting by and through its governing body, the South Bend
Redevelopment Commission desires to acquire the Real Property from
the City of South Bend; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and
through the Board, may exchange or transfer property with another
governmental entity upon terms and conditions agreed upon by the
two (2) entities as evidenced by the adoption of substantially
identical resolutions of each entity; and
WHEREAS, the Board of Public Works, at its meeting of R-a4,
1998 adopted its Resolution No. _ , approving the transfer
of the Real Property to the City of South Bend, for the use and
benefit of its Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property situated in St.
Joseph County, Indiana, by the City of South Bend, Indiana to the
City of South Bend, for the use and benefit of its Department of
Redevelopment, shall be, and hereby is, accepted.
2. That the Director of Redevelopment for the City of South
Bend shall cause the recording of the quitclaim deed conveying all
of the right, title and interest of the City of South Bend, Indiana
in and to the Real Property to the City of South Bend, for the use
and benefit of its Department of Redevelopment.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Commission.

EXHIBIT A - LEGAL DESCRIPTION
That part of the Southwest Quarter of Section 12 and the
Southeast Quarter of Section 11, both in Township 37 North,
Range 2 East, Portage Township, City of South Bend, St. Joseph
County, Indiana which is described as: Being all of Lot Number
One (1) of the recorded Plat of "Studebaker Corridor Third Minor
Subdivision" as recorded as Instrument Number 9303861 and a
part of Tract 3 of the plat of the "Studebaker Corporation
Replat" as recorded in Plat Book 11, page 184 in the Office of
the Recorder of St. Joseph County. Beginning at the
intersection of the North right of way line of Sample Street
and the West right of way line of Lafayette Boulevard, said
intersection also being the Southeast corner of said Lot Number
One (1), marked by a chiseled cross found in place; thence
along said North right of way line and the South line of said
Lot Number One (1) for the next three (3) courses; (1) South 89
degrees 44 minutes 37 seconds West a distance of 181.48 feet
