JOSEPH COUNTY RECORDER REC FEE: $43.00 RESOLUTION NO. 2015 PAGES: IS A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION CONTRACTING THE BOUNDARIES OF THE SOUTH BEND CENTRAL DEVELOPMENT AREA, REDUCING THE ALLOCATION AREA FOR PURPOSES OF TAX INCREMENT FINANCING AND AMENDING THE DEVELOPMENT PLAN FOR THE SOUTH BEND CENTRAL DEVELOPMENT AREA WHEREAS, the South Bend Redevelopment Commission ( "Commission"), governing body of the City of South Bend Department of Redevelopment ( "Department "), on May 10, 1985, adopted Resolution No. 737 declaring the South Bend Central Development Area in the City of South Bend, Indiana ( "City") to be a blighted area within the meaning of the Redevelopment of Cities and Towns Act of 1953, as amended, I.C. 36 -7 -14 ( "Act "); and WHEREAS, Resolution No. 737 and the South Bend Central Development Area Development Plan ( "Development Plan") adopted by Resolution No. 737 on May 10, 1985, were confirmed by Resolution No. 739 adopted on June 14, 1985; and WHEREAS, Resolution No. 737 was amended by Resolution No. 745, adopted on August 9, 1985 and confirmed by Resolution No. 750, adopted on September 30, 1985; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 751, adopted on November 8, 1985 and confirmed by Resolution No. 757, adopted December 20, 1985; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 795, adopted on February 27, 1987, and confirmed by Resolution No. 798, adopted on April 10, 1987; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 800, adopted on April 24, 1987, and confirmed by Resolution No. 803, adopted on June 26, 1987; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 834, adopted on March 11, 1988 and confirmed by Resolution No. 836, adopted on April 15, 1988, and said resolutions expanded the South Bend Central Development Area by adding Expansion Area No. 1; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 867, adopted on February 10, 1989, and confirmed by Resolution No. 874, adopted on March 24, 1989; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 881, adopted on July 28, 1989; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 893, adopted on October 27, 1989 and said Resolution No. 893 expanded the South Bend Central Development Area by adding Expansion Area No. 2 and Expansion Area No. 3; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 921 adopted on March 23, 1990; and IL WHEREAS, Resolution No. 737 was further amended by Substitute Resolution No. 944 adopted on July 27, 1990; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 974 adopted on January 25, 1991; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1019 adopted on October 11, 1991; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1077 adopted on July 24, 1992; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1205 adopted on January 4, 1994; WHEREAS, Resolution No. 737 was further amended by Resolution No. 1758 adopted on July 7, 2000: and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1783 adopted on August 4, 2000; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1843 adopted on September 7, 2001; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1901 adopted on September 6, 2002; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1922 adopted on December 6, 2002; and IL WHEREAS, Resolution No. 737 was further amended by Resolution No. 1952 adopted on March 7, 2003; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1973 adopted on June 6, 2003; and WHEREAS, Resolution No. 737 was further amended by Resolution No.2001 adopted on October 3, 2003; and said Resolution No. 2001 expanded the South Bend Central Development Area by adding Expansion Area No. 5; WHEREAS, Resolution No. 737 was further amended by Resolution No.2014 adopted on November 17, 2003; and said Resolution No. 2014 expanded the South Bend Central Development Area by adding Expansion Area No. 6 and defined the South Bend Central Development Area as follows: Beginning at the point of intersection of the South right -of -way line of Sample Street with the West right -of -way line of Michigan Street; thence North along said West right -of -way line of Michigan Street to its intersection with the Northerly line of the Conrail Railroad (formerly Penn Central) right -of -way; thence Northwesterly along said Northerly railroad right -of -way line to its intersection with the Southerly projection of the West right -of -way line of Taylor Street; and -4- WHEREAS, in accordance with the Act, the Commission desires to amend Resolution No. 737 by contracting the South Bend Central Development Area to remove the following described area hereinafter referred to as "Reduction Area No. 1" in order to facilitate and enhance the replanning and redevelopment of the South Bend Central Development Area, which Reduction Area No. 1 is more particularly described as follows: Beginning at the intersection of the centerlines of the East Race and LaSalle Avenue; thence East along said centerline of LaSalle Avenue to a point 110 feet West of the West right -of- way line of Niles Avenue; thence North 159.25 feet; thence East 110 feet to the West right - of -way line of said Niles Avenue; thence Easterly to the Northwest corner of Lot 71 in the Original Town of Lowell; thence East along the North line of said Lot 71 to the centerline of the first North -South alley East of Niles Avenue; thence North along said centerline of said Alley to the centerline of Madison Street; thence East along said centerline to the centerline of Hill Street; thence South along said centerline to the centerline of LaSalle Avenue; thence East along said centerline to the centerline of the first North -South alley East of Hill Street projected South; thence North along said centerline and its projection South to the centerline of the first East —West alley North of Cedar Street; thence West along said centerline to the West right -of -way line of the first North -South alley West of Hill Street; thence North along said West right -of -way line to a point 372 feet South of the South right - of -way line of Corby Boulevard; thence Southwesterly, a distance of 260.82 feet; thence Northwesterly, a distance of 85 feet; thence Southwesterly, a distance of 222 feet to the Northeasterly right -of -way line of Niles Avenue; thence Northwesterly along said right -of- way line, a distance of 312 feet; thence Northeasterly, a distance of 199.95 feet; thence Northerly to the South right -of -way line of Corby Boulevard to a point 378.66 feet West of the first North -South alley East of Niles Avenue; thence West along said South right -of -way line and its projection west to the East shore of the St. Joseph River; thence Southeasterly, Southerly and Southwesterly along said East shore to the centerline of the East Race; thence Southeasterly along said centerline of the East Race to the place of beginning containing 50.04 acres more or less; and WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or plan in a way that enlarges the boundaries of a redevelopment area by not more than twenty percent (20 %) of the original redevelopment area or adds one (1) or more parcels to the list of parcels of property to be acquired; and WHEREAS, consistent with the Act, the Commission has previously caused to be prepared certain maps and plats of the South Bend Central Development Area, and has supplemented said maps and plats of the South Bend Central Development Area by causing to be prepared additional maps and plats depicting the South Bend Central Development Area and Reduction Area No. 1; and WHEREAS, said maps and plats of the South Bend Central Development Area and Reduction Area No. 1 show the boundaries of said areas, the location of the various parcels of property, streets, alleys and other features affecting the acquisition, clearance, replatting, replanning, rezoning or redevelopment of said areas and parts of the areas that are to be devoted to public ways, levees, sewerage, parks, playgrounds and other public purposes under the plan for redevelopment of the South Bend Central Development Area as modified herein; and WHEREAS, the South Bend Central Development Area as contracted and reduced by Reduction Area No. 1 shall hereinafter be referred to as the "South Bend Central Development Area "; and -5- WHEREAS, the Development Plan for the South Bend Central Development Area as adopted by Resolution No. 737 includes a list of parcels of property to be acquired within the South Bend Central Development Area in order to accomplish the Development Plan; and WHEREAS, there was presented to this meeting of the Commission for its consideration and approval a proposed amendment to the South Bend Central Development Area Development Plan which said amendment is consistent with the contraction of the South Bend Central Development Area to exclude Reduction Area No. 1, from the development area by replacing pages 7 with page 7a of the Development Plan; and WHEREAS, the Development Plan as amended herein is entitled the "South Bend Central Development Area Development Plan" dated December 19, 2003 and, the Development Plan as amended herein shall be hereinafter referenced as the "Development Plan"; and WHEREAS, the Development Plan has been revised consistent with the proposed amendment herein and has been considered by the Commission at its meeting; and WHEREAS, the Development Plan as amended consists of a typewritten document comprised of 28 pages plus modifications and 4 exhibits; and WHEREAS, Section 39 of the Act permits the creation of an allocation area within a blighted area to provide for the allocation and distribution, as provided in the Act, of the proceeds of taxes levied on property situated in the allocation area; and WHEREAS, the Commission in accordance with the Act, has previously established the South Bend Central Allocation Area; and WHEREAS, the Commission, in accordance with the Act, has previously expanded the boundaries of the South Bend Central Allocation Area to include: Expansion Area No. 1 by the adoption of Resolution No. 834, adopted on March 11, 1988; and Expansion Area No. 2 and Expansion Area No. 3 by the adoption of Resolution No. 893, adopted on October 27, 1989; and Expansion Area No. 5 by the adoption of Resolution No. 2001 adopted on October 3, 2003; and Expansion Area No. 6 by the adoption of Resolution No. 2014 adopted on November 17, 2003; and WHEREAS, South Bend Allocation Area No. I does not include Expansion Area No. 4 as described and approved in Resolution No. 1737 adopted on February 18, 2000; and WHEREAS, the South Bend Central Allocation Area as expanded has been designated the "South Bend Central Allocation Area No. 1 A "; and WHEREAS, the South Bend Central Allocation Area No. 1 includes the area heretofore referenced as Reduction Area No. 1; and L L WHEREAS, the Commission now desires to modify the boundaries of the South Bend Central Allocation Area No. I to exclude that area heretofore referenced as Reduction Area No. 1 so that the boundaries of the allocation area as modified are coterminous with the boundaries of the South Bend Central Development Area; and WHEREAS, the allocation area, as modified herein, shall be hereinafter referenced as the "South Bend Central Allocation Area No. lA "; and WHEREAS, Section 17.5 of the Act provides for a public hearing to be held by the Commission, at which public hearing all persons interested in the proceedings and who have timely filed written remonstrances may be heard; and WHEREAS, the Commission has complied with the notice provisions of Section 17.5 of the Act; and WHEREAS, at the hearing held by the Commission on the 17`x' day of November, 2003, at 10:00 a.m. Eastern Standard Time, at 1308 County -City Building, South Bend, Indiana, the Commission heard all persons interested in the proceedings and received and considered written remonstrances and objections and other such evidence presented. THE COMMISSION HEREBY FINDS THAT: (i). The proposed amendment to Resolution No. 737 to exclude Reduction Area No. 1 is reasonable and appropriate when considered in relation to Resolution No. 737 and the purposes of the Act. (ii). The proposed amendment to the South Bend Central Development Area Development Plan is reasonable and appropriate when considered in relation to the Development Plan and the purposes of the Act. (iii). Resolution No. 737, as amended herein, conforms to the comprehensive plan for the City. (iv). The Development Plan, as amended herein, conforms to the comprehensive plan for the City. NOW, THEREFORE BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT, AS FOLLOWS: (1). The South Bend Central Development Area is hereby reduced to delete Reduction Area No. 1 as described in the 32nd WHEREAS clause above. (2). The South Bend Central Development Area, as reduced herein to exclude Reduction Area No. 1 shall be hereinafter known as the "South Bend Central Development Area" and is more particularly described as follows: Beginning at the point of intersection of the South right -of -way line of Sample Street with the West right -of -way line of Michigan Street; thence North along said West right -of -way line of Michigan Street to its intersection with the Northerly line of the Conrail Railroad (formerly Penn Central) right -of -way; thence Northwesterly along said Northerly railroad right -of -way line to its intersection with the Southerly projection of the West right -of -way line of Taylor Street; thence North along said West right -of -way line to its intersection with the Westerly projection of the North right -of -way line of vacated Monroe Street; thence East along the said projected right -of -way line to the intersection with the East right -of -way line of Taylor Street said point also being the Southwest corner of Lot 16, Block 7 of Vail's Southwest Addition to the City of South Bend; thence North along the said East right -of -way line to the intersection with the center line of the first 14 -foot vacated alley lying North of vacated Monroe Street; thence East along the said center line to a point on the said center line that is 93.00 feet west of the East right -of -way line of Williams Street; thence South parallel with the West right -of -way line of Williams Street, 114.00 feet; thence East 93.00 feet to a point on the East right -of -way line of Williams Street, said point being 8.00 feet South of the Southwest corner of Lot 6, Block 8, of said Vail's Southwest Addition and the beginning of the vacated Williams Street to the South; thence North 8.00 feet along the East line of Williams Street to the said Southwest corner of Lot 6, Block 8; thence East along the South line of said Lot 6, Block 8, to the Southwest corner of Lot 6, Block 8; thence Southeasterly to a point on the East line of Lot 31 of said Vail's Southwest Addition, said point being 22.00 feet North of the Southeast corner of said Lot 31; thence South along the East line of Lot 31 to the North right -of -way line of Monroe Street; thence East along the North right -of -way line of said Monroe Street to its intersection with the centerline of the first 14 foot alley lying West of Lafayette Boulevard; thence North along said centerline of said 14 foot alley to the South right - of -way line of Washington Street; thence West along said South right -of -way line to the East right -of -way line of Chapin Street; thence Westerly to a point located on the West right -of -way line of Chapin Street and 5 feet South of the South right-of- way line of Washington Street;
