JOSEPH RETHLAKE RECORDER REC FEE: 845.00 PAGES: 19 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION EXPANDING THE BOUNDARIES OF THE SOUTH BEND CENTRAL DEVELOPMENT AREA, EXPANDING THE ALLOCATION AREA FOR PURPOSES OF TAX INCREMENT FINANCING AND AMENDING THE SOUTH BEND CENTRAL DEVELOPMENT AREA DEVELOPMENT PLAN WHEREAS, the South Bend Redevelopment Commission ( "Commission "), governing body of the City of South Bend Department of Redevelopment ( "Department "), on May 10, 1985, adopted Resolution No. 737 declaring the South Bend Central Development Area in the City of South Bend, Indiana ( "City") to be a blighted area within the meaning of the Redevelopment of Cities and Towns Act of 1953, as amended, I.C. 36 -7 -14 ( "Act "); and WHEREAS, Resolution No. 737 and the South Bend Central Development Area Development Plan ( "Development Plan") adopted by Resolution No. 737 on May 10, 1985, were confirmed by Resolution No. 739 adopted on June 14, 1985; and WHEREAS, Resolution No. 737 was amended by Resolution No. 745, adopted on August 9, 1985 and confirmed by Resolution No. 750, adopted on September 30, 1985; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 751, adopted on November 8, 1985 and confirmed by Resolution No. 757, adopted December 20, 1985; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 795, adopted on February 27, 1987, and confirmed by Resolution No. 798, adopted on April 10, 1987; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 800, adopted on April 24, 1987, and confirmed by Resolution No. 803, adopted on June 26, 1987; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 834, adopted on March 11, 1988 and confirmed by Resolution No. 836, adopted on April 15, 1988, and said resolutions expanded the South Bend Central Development Area by adding Expansion Area No. 1; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 867, adopted on February 10, 1989, and confirmed by Resolution No. 874, adopted on March 24, 1989; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 881, adopted on July 28, 1989; and t 1 WHEREAS, Resolution No. 737 was further amended by Resolution No. 893, adopted on October 27, 1989 and said Resolution No. 893 expanded the South Bend Central Development Area by adding Expansion Area No. 2 and Expansion Area No. 3; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 921 adopted on March 23, 1990; and WHEREAS, Resolution No. 737 was further amended by Substitute Resolution No. 944 adopted on July 27, 1990; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 974 adopted on January 25, 1991; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1019 adopted on October 11, 1991; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1077 adopted on July 24, 1992; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1205 adopted on January 4, 1994; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1284 adopted on September 2, 1994; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1547 adopted on November 21, 1997; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1758 adopted on July 7, 2000: and c, -2- WHEREAS, Resolution No. 737 was further amended by Resolution No. 1783 adopted on August 4, 2000; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1843 adopted on September 7, 2001; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1901 adopted on September 6, 2002; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1922 adopted on December 6, 2002; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1952 adopted on March 7, 2003; and WHEREAS, Resolution No. 737 was further amended by Resolution No. 1973 adopted on June 6, 2003; and WHEREAS, Resolution No. 737 was further amended by Resolution No.2001 adopted on October 3, 2003; and said Resolution No. 2001 expanded the South Bend Central Development Area by adding Expansion Area No. 5 and defined the South Bend Central Development Area as follows: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at the point of intersection of the South right -of -way line of Sample Street with the West right -of -way line of Michigan Street; thence North along said West right -of -way line of Michigan Street to its intersection with the Northerly line of the Conrail Railroad (formerly Penn Central) right -of -way; thence Northwesterly along said Northerly railroad right -of -way line to its intersection with the Southerly projection of the West right -of -way line of Taylor Street; thence North along said West right -of -way line to its intersection with the Westerly projection of the North right -of -way line of vacated Monroe Street; thence East along the said projected right -of -way line to the intersection with the East right -of -way line of Taylor Street said point also being the Southwest corner of Lot 16, Block 7 of Vail's Southwest Addition to the City of South Bend; thence North along the said East right -of -way line to the intersection with the center line of the first 14 -foot vacated alley lying North of vacated Monroe Street; thence East along the said center line to a point on the said center line that is 93.00 feet west of the East right -of -way line of Williams Street; WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or plan in a way that enlarges the boundaries of a redevelopment area by not more than 20 percent (20 %) of the original redevelopment area or adds one (1) or more parcels to the list of parcels of property to be acquired; and WHEREAS, in accordance with the Act, the Commission desires to amend Resolution No. 737 by expanding the South Bend Central Development Area to add the following described area hereinafter referred to as `Expansion Area No. 6" in order to facilitate and enhance the replanning and redevelopment of the South Bend Central Development Area, which Expansion Area No. 6 is more particularly described as follows: Expansion Area No. 6 A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph IL -5- County, Indiana and being more particularly described as follows: Beginning at the intersection of the North right -of -way line of Bartlett Street and the East right -of -way line of St. Joseph Street; thence East along said North right -of -way line to the centerline of the St. Joseph River, thence North along said centerline of the St. Joseph River to the centerline of Corby Street project West; thence East along said centerline and its projection west to a point 120 feet West of the first North -South alley East of Niles Avenue projected North; thence South to the South right -of -way line of Corby Street; thence West along said South right -of -way line and its projection West to the East shore of the St. Joseph River; thence Southerly along said East shore to the\ intersection of the Southerly right -of -way line of Bartlett Street projected East; thence West along said South right -of -way line and its projection East to the East right -of -way line of St. Joseph Street; thence North to the place of beginning containing 3.24 acres more or less. and WHEREAS, consistent with the Act, the Commission has previously caused to be prepared certain maps and plats of the South Bend Central Development Area, and has supplemented said maps and plats of the South Bend Central Development Area by causing to be prepared additional maps and plats depicting a blighted area that is located adjacent to the South Bend Central Development Area and heretofore referred to as `Expansion Area No. 6 "; and WHEREAS, said maps and plats of the South Bend Central Development Area and Expansion Area No. 6 show the boundaries of said areas, the location of the various parcels of property, streets, alleys and other features affecting the acquisition, clearance, replatting, replanning, rezoning or redevelopment of said areas and parts of the areas that are to be devoted to public ways, levees, sewerage, parks, playgrounds and other public purposes under the plan for the redevelopment of the South Bend Central Development Area and Expansion Area No. 6 as described above; and WHEREAS, the Commission desires to further amend Resolution No. 737 by expanding the South Bend Central Development Area to include Expansion Area No. 6 in order to facilitate and enhance the replanning, redevelopment and disposition of property within said combined areas; and WHEREAS, the South Bend Central Development Area as expanded by Expansion Area No. 6 shall hereinafter be referenced as the "Development Area "; and WHEREAS, there was also presented to this meeting of the Commission for its consideration and approval a proposed amendment to the South Bend Central Development Area Development Plan ( "Plan") entitled "Amendment to the South Bend Central Development Area Development Plan, Expansion Area No. 6 " ( "Amendment "), which said Amendment is attached L 54 L G hereto and incorporated herein as Exhibit "A "; and WHEREAS, the Amendment to the Development Plan sets out the boundaries of the Development Area and further identifies the types of redevelopment projects and purposes to be undertaken in the Development Area; and WHEREAS, the Development Plan as amended is entitled the "South Bend Central Development Area Development Plan South Bend, Indiana" dated December 19, 2003 and is hereinafter referenced herein as the "Development Plan"; and WHEREAS, the Development Plan has been revised consistent with the proposed Amendment described herein, and has been considered by the Commission at its meeting; and WHEREAS, the Development Plan, as amended, consists of a typewritten document comprised of 28 pages plus modifications and 3 exhibits; and WHEREAS, Section 39 of the Act permits the creation of an allocation area within a blighted area to provide for the allocation and distribution, as provided by the Act, of the proceeds of taxes levied on property situated in the allocation area; and WHEREAS, the Commission in accordance with the Act, has previously established the South Bend Central Allocation Area ( "South Bend Allocation Area No. lA "); and WHEREAS, the Commission, in accordance with the Act, has previously expanded the boundaries of the South Bend Allocation Area No. IA to include: Expansion Area No.1 by the adoption of Resolution No. 834, adopted on March 11, 1988, and confirmed by Resolution No. 836, adopted on April 15, 1988; Expansion Area No. 2 and Expansion Area No. 3 by the adoption of Resolution No. 893, adopted on October 27, 1989; Expansion Area No. 5 by the adoption of Resolution No. 2001 on October 3, 2003; and WHEREAS, South Bend Allocation Area No. 1 A does not include Expansion Area No. 4 as described and approved in Resolution No. 1737 adopted on February 18, 2000; and WHEREAS, the Commission now desires to further expand the boundaries of South Bend Allocation Area No. I to include that area heretofore referenced as "Expansion Area No. 6 "• and WHEREAS, the South Bend Allocation Area No. 1 A as expanded to include Expansion Area No. 6 as described above shall be hereinafter referenced as the "South Bend Allocation Area No. 1A "; and WHEREAS, Section 17.5 of the Act provides for a public hearing to be held by the Commission, at which public hearing all persons interested in the proceedings and who have filed timely written remonstrances may be heard; and WHEREAS, the Commission has complied with the notice provisions of Section 17.5 of the Act; and WHEREAS, at the public meeting held by the Commission on the 19`x' day of December, 2003, at 10:00 a.m., Eastern Standard Time, at 1308 County -City Building, South Bend, Indiana, the Commission has reviewed the maps and plats and proposed amendments and heard all persons interested in the proceedings and received and considered 0 written remonstrances and objections and other such evidence presented. THE COMMISSION HEREBY FINDS THAT: (i). The proposed amendment to Resolution No. 737 to include Expansion Area No. 6 is reasonable and appropriate when considered in relation to Resolution No. 737 and the purposes of the Act. (ii). The proposed amendment to the South Bend Central Development Plan is reasonable and appropriate when considered in relation to the Development Plan and the purposes of the Act. (iii). Resolution No. 737, as amended herein, conforms to the comprehensive plan for the City. (iv). The Development Plan, as amended herein, conforms to the comprehensive plan for the City. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT, AS FOLLOWS: (1). The South Bend Central Development Area is hereby expanded to include Expansion Area No. 6 as said Expansion Area No. 6 is described in the 31 S` WHEREAS clause above. (2). The South Bend Central Development Area, as expanded herein to include Expansion Area No. 6 shall hereinafter be known as the "South Bend Central L -8- Development Area" and is more particularly described as follows: Beginning at the point of intersection of the South right-of-way line of � g p Sample Street with the West right -of -way line of Michigan Street; thence North along said West right -of -way line of Michigan Street to its intersection with the Northerly line of the Conrail Railroad (formerly Penn Central) right -of -way; thence Northwesterly along said Northerly railroad right -of -way line to its intersection with the Southerly projection of the West right -of -way line of Taylor Street; thence North along said West right -of -way line to its intersection with the Westerly projection of the North right -of -way line of vacated Monroe Street; thence East along the said projected right -of -way line to the intersection with the East right -of -way line of Taylor Street said point also being the Southwest corner of Lot 16, Block 7 of Vail's Southwest Addition to the City of South Bend; thence North along the said East right -of -way line to the intersection with the center line of the first 14 -foot vacated alley lying North of vacated Monroe Street; thence East along the said center line to a point on the said center line that is 93.00 feet west of the East right -of -way line of Williams Street; thence South parallel with the West right -of -way line of Williams Street, 114.00 feet; thence East 93.00 feet to a point on the East right -of -way line of Williams Street, said point being 8.00 feet South of the Southwest corner of Lot 6, Block 8, of said Vail's Southwest Addition and the beginning of the vacated Williams Street to the South; thence North 8.00 feet along the East line of Williams Street to the said Southwest corner of Lot 6, Block 8; thence East along the South line of said Lot 6, Block 8, to the Southwest corner of Lot 6, Block 8; thence Southeasterly to a point on the East line of Lot 31 of said Vail's Southwest Addition, said point being 25.00 feet North of the Southeast corner of said Lot 31; thence South along the East line of Lot 31 to the North right -of -way line of vacated Monroe Street; thence Southeasterly along said Easterly right -of -way line to the South right -of -way line of Sample Street; thence West along said South right -of -way line to the place of beginning containing 647.54 acres more or less. (3). The previously prepared maps and plats showing the boundaries of the South Bend Central Development Area, as expanded herein, showing the location of the various parcels of property, streets, alleys, and other features affecting the acquisition, clearance, replatting, replanning, rezoning or redevelopment of the South Bend Central Development Area, indicating any parcels of property to be excluded from acquisition, and indicating the parts of the South Bend Central llw� Development Area to be devoted to public ways, levees, sewerage, parks, playgrounds, and other public purposes under the Development Plan as modified herein are hereby approved. (4). The proposed amendment to the Development Plan to replace pages 7 and 8 with pages 7, 7a and 8 as attached hereto as Exhibit "A "is in all respects approved. Development Plan Goals The overall goal for the Area is to achieve the economic revitalization and physical redevelopment of the Area as an attractive, exciting, unique and viable urban center for people, businesses, and institutions. To make the Area a multi -use regional center for North Central Indiana and South Central Michigan for business and consumer services, specialty retail, governmental and medical services, cultural, entertainment, recreational, and convention uses. 2. To increase the level of private investment and reinvestment in the Area. 4. To increase both the personal and real property tax base within the Area 5. To retain and increase jobs within the Area by retaining and attracting both consumer service, business service and light industrial uses. 6. To increase the functions and facilities within the Area to make it an attractive and competitive area for living, working, and recreation. 7. To enhance and strengthen the various linkages between the Central Business District, East Bank and Monroe Park. 8. To create the physical and organizational environment that will facilitate and enhance the phase -in of private resources and the phase -out of extraordinary public investment. 9.
