A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION EXPANDING THE BOUNDARIES OF THE SOUTH BEND CENTRAL
DEVELOPMENT AREA, EXPANDING THE ALLOCATION AREA FOR PURPOSES
OF TAX INCREMENT FINANCING AND AMENDING THE SOUTH BEND CENTRAL
DEVELOPMENT AREA DEVELOPMENT PLAN
WHEREAS, the South Bend Redevelopment Commission ( "Commission "), governing body
ofthe City of South Bend Department of Redevelopment ( "Department "), on May 10, 1985, adopted
Resolution No. 737 declaring the South Bend Central Development Area in the City of South Bend,
Indiana ( "City ") to be a blighted area within the meaning of the Redevelopment of Cities and Towns
Act of 1953, as amended, I.C. 36 -7 -14 ( "Act "); and
WHEREAS, Resolution No. 737 and the South Bend Central Development Area Development
Plan ( "Development Plan ") adopted by Resolution No. 737 on May 10, 1985, were confirmed by
Resolution No. 739 adopted on June 14, 1985; and
WHEREAS, Resolution No. 737 was amended by Resolution No. 745, adopted on August 9,
1985 and confirmed by Resolution No. 750, adopted on September 30, 1985; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 751, adopted on
November 8, 1985 and confirmed by Resolution No. 757, adopted December 20, 1985; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 795, adopted on
February 27, 1987, and confirmed by Resolution No. 798, adopted on April 10, 1987; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 800, adopted on April
24, 1987, and confirmed by Resolution No. 803, adopted on June 26, 1987; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 834, adopted on
March 11, 1988 and confirmed by Resolution No. 836, adopted on April 15, 1988, and said
resolutions expanded the South Bend Central Development Area by adding Expansion Area No. 1;
and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 867, adopted on
February 10, 1989, and confirmed by Resolution No. 874, adopted on March 24, 1989; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 881, adopted on July
28, 1989; and
ILWHEREAS, Resolution No. 737 was further amended by Resolution No. 893, adopted on
October 27, 1 989 and said Resolution No. 893 expanded the South Bend Central Development Area
by adding Expansion Area No. 2 and Expansion Area No. 3; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 921 adopted on
March 23, 1990; and
WHEREAS, Resolution No. 737 was further amended by Substitute Resolution No. 944
adopted on July 27, 1990; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 974 adopted on
January 25, 1991; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1019 adopted on
October 11, 1991; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1077 adopted on July
24, 1992; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1205 adopted on
January 4, 1994; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1284 adopted on
September 2, 1994; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1547 adopted on
November 21, 1997; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1559 adopted on
December 19, 1997; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1562 adopted on
February 24, 1998; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1723 adopted on
December 17, 1999; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1737 adopted on
February 18, 2000 and said Resolution No. 1737 expanded the South Bend Central Development
Area by adding Expansion Area No. 4 and defined the South Bend Central Development Area as
follows:

A parcel of land being a part of the City of South Bend, Portage Township, St.
Joseph County, Indiana and being more particularly described as follows, viz:
Beginning at the point of intersection of the south right -of -way line of Sample Street
with the west right -of -way line of Michigan Street; thence north along said west
right -of -way line of Michigan Street to its intersection with the northerly line of the
Conrail Railroad (formerly Penn Central) right -of -way; thence northwesterly along
said northerly railroad right -of -way line to its intersection with the southerly
projection of the west right -of -way line of Taylor Street; thence north along said

right -of -way line of vacated Monroe Street; thence east along the said projected

WHEREAS, Resolution No. 737 was further amended by Resolution No. 1973 adopted on June
6, 2003; and
WHEREAS, in accordance with the Act, the Commission desires to amend Resolution No. 737
by expanding the South Bend Central Development Area to add the following described area
hereinafter referred to as "Expansion Area No. 5" in order to facilitate and enhance the replanning
and redevelopment of the South Bend Central Development Area, which Expansion Area No. 5 is
more particularly described as follows:
Expansion Area No. 5
A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph
County, Indiana and being more particularly described as follows:
Beginning at the intersection of the East right -of -way line of Williams Street and the
South right -of -way line of Washington Street; thence West along the said South
right -of -way line to the East right -of -way line of Chapin Street; thence Westerly to
a point located on the West right -of -way line of Chapin Street and 5 feet South of the
South right -of -way line of Washington Street; thence South, a distance of 235 feet;
4 thence West, a distance of 122.84 feet; thence South, a distance of 55 feet; thence
West to the first North -South alley West of Chapin Street; thence South to a point
38.71 feet North of the North right -of -way line of Jefferson Boulevard; thence East
to the West right -of -way line of Chapin Street; thence South to the North right -of-
way line of Thomas Street; thence West along said North right -of -way line of
Thomas Street to a point 105.58 feet East of the East right -of -way line of Laurel

WHEREAS, consistent with the Act, the Commission has previously caused to be prepared
certain maps and plats of the South Bend Central Development Area, and has supplemented said
maps and plats of the South Bend Central Development Area by causing to be prepared additional
maps and plats depicting a blighted area that is located adjacent to the South Bend Central
Development Area and heretofore referred to as "Expansion Area No. 5 "; and
WHEREAS, said maps and plats of the South Bend Central Development Area and
Expansion Area No. 5 show the boundaries of said areas, the location of the various parcels of
property, streets, alleys and other features affecting the acquisition, clearance, replatting, replanning,
rezoning or redevelopment of said areas and parts of the areas that are to be devoted to public ways,
levees, sewerage, parks, playgrounds and other public purposes under the plan for the redevelopment
of the South Bend Central Development Area and Expansion Area No. 5 as described above; and
WHEREAS, the Commission desires to further amend Resolution No. 737 by expanding
the South Bend Central Development Area to include Expansion Area No. 5 in order to facilitate and
enhance the replanning, redevelopment and disposition of property within said combined areas; and
WHEREAS, the South Bend Central Development Area as expanded by Expansion Area
No. 5 shall hereinafter be referenced as the "Development Area "; and
WHEREAS, there was also presented to this meeting of the Commission for its
consideration and approval a proposed amendment to the South Bend Central Development Area
Development Plan ( "Plan ") entitled "Amendment to the South Bend Central Development Area
Development Plan, Expansion Area No. 5, Studebaker Museum" ( "Amendment "), which said
Amendment is attached hereto and incorporated herein as Exhibit "A "; and
WHEREAS, the Amendment to the Development Plan sets out the boundaries of the
Development Area and further identifies the types of redevelopment projects and purposes to be
undertaken in the Development Area; and
WHEREAS, the Development Plan as amended is entitled the "South Bend Central
Development Area Development Plan South Bend, Indiana" dated October 3, 2003 and is hereinafter
referenced herein as the "Development Plan "; and
WHEREAS, the Development Plan has been revised consistent with the proposed
Amendment described herein, and has been considered by the Commission at its meeting; and
WHEREAS, the Development Plan, as amended, consists of a typewritten document
comprised of 28 pages plus modifications and 2 exhibits; and
WHEREAS, Section 39 of the Act permits the creation of an allocation area within a
blighted area to provide for the allocation and distribution, as provided by the Act, of the proceeds
of taxes levied on property situated in the allocation area; and

WHEREAS, the Commission in accordance with the Act, has previously established the
South Bend Central Allocation Area ( "South Bend Allocation Area No. 1 A "); and
WHEREAS, the Commission, in accordance with the Act, has previously expanded the
boundaries of the South Bend Allocation Area No. 1 A to include:
Expansion Area No. l by the adoption of Resolution No. 834, adopted on March 11,
1988, and confirmed by Resolution No. 836, adopted on April 15, 1988;
Expansion Area No.2 and Expansion Area No.3 by the adoption of Resolution No.
893, adopted on October 27, 1989; and
WHEREAS, South Bend Allocation Area No. 1 A does not include Expansion Area No. 4
as described and approved in Resolution No. 1737 adopted on February 18, 2000; and
WHEREAS, the Commission now desires to further expand the boundaries of South Bend
Allocation Area No. I to include that area heretofore referenced as "Expansion Area No. 5 "; and
WHEREAS, the South Bend Allocation Area No. I as expanded to include Expansion
Area No. 5 as described above shall be hereinafter referenced as the "South Bend Allocation Area
No. 1 A "; and
WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or
plan in a way that enlarges the boundaries of a redevelopment area by not more than twenty percent
(20 %) of the original redevelopment area or adds one (1) or more parcels to the list of parcels of
property to be acquired; and
WHEREAS, Section 17.5 of the Act provides for a public hearing to be held by the
Commission, at which public hearing all persons interested in the proceedings and who have filed
timely written remonstrances may be heard; and
WHEREAS, the Commission has complied with the notice provisions of Section 17.5 of the
Act; and
WHEREAS, at the public meeting held by the Commission on the 3rd day of October 2003,
at 10:00 a.m., Eastern Standard Time, at 1308 County -City Building, South Bend, Indiana, the
Commission has reviewed the maps and plats and proposed amendments and heard all persons
interested in the proceedings and received and considered 0 written remonstrances and
objections and other such evidence presented.
THE COMMISSION HEREBY FINDS THAT:
(i). The proposed amendment to Resolution No. 737 to include Expansion Area No. 5

is reasonable and appropriate when considered in relation to Resolution No. 737 and
the purposes of the Act.
(ii). The proposed amendment to the South Bend Central Development Plan is reasonable
and appropriate when considered in relation to the Development Plan and the
purposes of the Act.
(iii). Resolution No. 737, as amended herein, conforms to the comprehensive plan for the
City.
(iv). The Development Plan, as amended herein, conforms to the comprehensive plan for
the City.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH
BEND, DEPARTMENT OF REDEVELOPMENT, AS FOLLOWS:
(1). The South Bend Central Development Area is hereby expanded to include Expansion
Area No. 5 as said Expansion Area No. 5 is described in the 30`h WHEREAS clause above.
(2). The South Bend Central Development Area, as expanded herein to include Expansion
Area No. 5 shall hereinafter be known as the "South Bend Central Development Area" and
is more particularly described as follows:
A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph
County, Indiana and being more particularly described as follows:
Beginning at the point of intersection of the South right -of -way line of Sample Street
with the West right -of -way line of Michigan Street; thence North along said West
right -of -way line of Michigan Street to its intersection with the Northerly line of the
Conrail Railroad (formerly Penn Central) right -of -way; thence Northwesterly along
said Northerly railroad right -of -way line to its intersection with the Southerly
projection of the West right -of -way line of Taylor Street; thence North along said

Highway #933); thence Southeasterly along said Easterly right -of -way line to the
South right -of -way line of Sample Street; thence West along said South right -of -way
line to the place of beginning containing 644.3 acres more or less.
(3). The previously prepared maps and plats showing the boundaries of the South Bend
Central Development Area, as expanded herein, showing the location of the various parcels
of property, streets, alleys, and other features affecting the acquisition, clearance, replatting,
replanning, rezoning or redevelopment of the South Bend Central Development Area,
indicating any parcels of property to be excluded from acquisition, and indicating the parts
of the South Bend Central Development Area to be devoted to public ways, levees, sewerage,
parks, playgrounds, and other public purposes under the Development Plan as modified
herein are hereby approved.
(4). The Development Plan attached hereto as Exhibit "A" is in all respects approved.
BE IT FURTHER RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION CONCERNING THE ESTABLISHMENT OF AN ALLOCATION AREA
FOR PURPOSES OF TAX INCREMENTAL FINANCING, THAT:

(5). South Bend Allocation Area No. I is hereby expanded to include Expansion Area
No. 5 as described in the 30`h WHEREAS clause above so that the boundaries of the
Allocation Area and the South Bend Central Development Area are coterminous excepting
therefrom Expansion Area No. 4 as described and approved in Resolution No. 1737 adopted
on February 18, 2000.
(6). Any taxes levied on the property imposed under Ind. Code § 6 -1.1 in South Bend
Allocation Area No. IA, as amended herein, shall be allocated, distributed and used as

DESCRIPTION
Expansion Area No. 5 is currently in the West Washington -Cha in Development Area. The
Expansion Area is being transferred to the South Bend Central Development Area in order to
finance a planned development project in the area. The development project involves the
construction of a new building for the Studebaker Museum. A bond will be issued for the South
Bend Central Development Area that will finance among other projects the construction of the
Studebaker Museum. The Museum is currently located in the Central Development Area.
Although the present site was originally intended for construction of a new museum it has been
determined that the new site next to the Center for History would be more beneficial to the
Museum and also complement the Center for History. Locating the two museums next to each
other will permit certain economies of scale in the form of shared staff and facilities. Also, being
in close proximity to each other will permit the two museums to offer joint exhibits and
programs. Finally, locating the two museums close together will complement and strengthen the
attractiveness of each organization to their clients and customers allowing those customers to see
a greater variety of exhibits in one visit. As a result, the City is considering other potential uses
for the present site of the Museum that will further contribute to the goals and objectives of the
Central Development Area Development Plan.
It is anticipated that the Museum will have a beneficial impact on the surrounding neighborhood
by bringing new investment to that area. Also, the additional influx of museum customers will
contribute to increased interest in the area for investment in both commercial activities and
housing.
Expansion Area No. 5 only contains properties devoted to the Center for History and the
properties to be acquired for the Studebaker Museum. Expansion Area No. 5 was already
determined to be in a blighted area when it was incorporated into the West Washington- Chapin
Development Area. That status remains unchanged. The Museum will be located on several
parcels of land. The parcels are being acquired by the Museum in collaboration with the South
Bend Heritage Foundation. At present it is intended that the land will be donated to the City. If
necessary, the parcels will be added at a later date to the property acquisition list for the Central
Development Area.
Plans call for the Studebaker Museum building to have three floors including a basement. It will
contain approximately 49,000 square feet and hold approximately 115 cars but only 70 will be
on display. The estimated construction cost is $6.5 million.
