Dear Mr.Kelly: Attached, is a proposed ordinance that was initiated by the Area Plan Commission at its meeting of April 15, 1997. The purpose of this ordinance is to rezone of�ce�roperties some of which are legal non-conforming uses in the "B" Residential District to the PHC" Professional/Health Care District. Legal non-conforming uses cannot be expanded or rebuilt if destroyed. The "PHC" zoning district will make existing offices in this area permitted uses. The Honorable Common Council City of South Bend County-City Bldg. - 4th Floor South Bend, IN 46601 RE: A proposed ordinance initiated by the Area Plan Commission to rezone properties within an area generally described as along and around East Jefferson Boulevard between St. Peter Street and Eddy Street, City of South Bend - APC #1777-97 Dear Council Members: The above referenced ordinance initiated by the Area Plan Commission was legally advertised on June 5, 1997. The Area Plan Commission at its public hearing on June 17, 1997, took the following action: Upon a motion by Beverly Crone, being seconded by Joseph Serge and unanimously carried, the proposed ordinance initiated by the Area Plan Commission to rezone properties within an area generally described as along and around East Jefferson Boulevard between St. Peter Street and Eddg Street, City of South Bend, as amended, is sent to the Common Council with a favorable recommendation. This petition would rezone office properties, some of which are legal nonconforming uses in the "B" Residential District, to the "PHC" District. "PHC" zoning will make offices in the petition area permitted uses, which would allow them to be rebuilt if destroyed or expanded if necessary. The "PHC" District was expressly designed for medical and professional offices. This petition will bring the zoning into line with the uses existing along East Jefferson. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation.
