AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA,AMENDING VARIOUS SECTIONS WITHIN CHAPTER 2,ARTICLE 6,
ENTITLED TAX ABATEMENT PROCEDURES OF THE
SOUTH BEND MUNICIPAL CODE
STATEMENT OF PURPOSE AND INTENT
The Indiana State Legislature has given to all communities the ability to enhance
development through a myriad of economic revitalization programs, including the designation of
an area as a residentially distressed area.
The City of South Bend has previously instituted guidelines for Residentially Distressed
Areas (RDAs) by passage of Ordinance No. 8732-96 in the effort to provide additional incentives
for some of the underdeveloped residential areas of our City to be developed, and establishes
new, additional areas with this ordinance. The City believes that this ordinance meets the
definition of"economic revitalization area", and further believes that there are additional factors
which have prevented a normal development of property or use of property which have resulted
in a lack of development and a cessation of growth.
Through the joint efforts of the city administrative branch and the city legislative branch
working together with concerned citizens, this proposed ordinance is filed in the interest of
providing an additional tool to assist the City in combating the restrictions imposed by state law
addressing annexation, which have also limited the growth and development of the City.
It is believed that the following ordinance is in the best interest of the City and would
help bring needed economic revitalization and development.

Section I. Chapter 2, Article 6, Section 2-76.1 entitled"Definitions" subparagraph
(a) (20) of the South Bend Municipal Code is amended to add the following E�ibits:

The RDAs designated herein are found to meet the state law requirements more
particularly set forth in Indiana Code §6-1.1-12.1-2 and are declared residentially distressed
areas (RDAs). The Council hereby makes that additional findings that each of the RDAs listed
herein:
(I) Are comprised of parcels that are either unimproved or contain only one (1) or
two (2) family dwellings or multifamily dwellings designed for up to four(4)
families, including accessory buildings for those Dwellings; and
(II) Have dwellings which are not permanently occupied and are:
(I) the subject of an order issued under Indiana Code
§36-7-9; or
(III) Have parcels of property in the area which:
(I) have been sold and not redeemed under Indiana Code §6-1.1-24 and
Indiana Code §6-1.1-25; or
(ii) are owned by a unit of local government;
or are found in the alternative to:
(I) Have a significant number of dwelling units within the area which are not
permanently occupied or have a significant number of parcels in the area which
are vacant land; and
(II) Have a significant number of dwelling units within the area which are:
(I) the subject of an order issued under Indiana Code
§36-7-9; or
(ii) evidence of significant building deficiencies; and
(III) Have experienced a net loss in the number of dwelling units, as documented by
census information, local building and demolition permits, or certificates of
occupancy, or
the area is owned by Indiana or the United States; and
The RDAs designated herein(plus any areas previously designated under Indiana Code
§6-1.1-12.1-2)will not exceed ten percent(10%)of the total area within the Council's
jurisdiction.
SECTION II. Chapter 2, Article 6, Section 2-77.1(b) entitled"New Construction" of the
South Bend Municipal Code shall be amended in its entirety by the following language:
(b) New Construction: Proposed single-family new construction homes which
meet the requirements addressing residentially distressed areas set forth in I.C.. 6-1.1-12.1-2,
may be considered for five-year real property tax abatement.
SECTION III. This Ordinance shall be in full force and effect from and after its passage
by the Common Council and approval by the Mayor.
