Michigan, Fulmer)RESOLUTION NO. 1848 A RESOLUTION APPROVING AN APPLICA'T'ION FOR REAL, PROPERTY TAX DEDUCTION WHEREAS, I.C. 6 -1.1- 12.1 -2(1) provides that an application for property tax deduction may not be approved when the property is located in an allocation area as defined in I.C. 36- 7- 14 -39, unless the Redevelopment Commission which designated that allocation area adopts a resolution approving that application; and WHEREAS, the South Bend Common Council has received a petition for three years of real property tax abatement consideration from Charles, Jr. & Tracie Fulmer and Charles, Sr. and Faye Fulmer for real property located at 918 S. Michigan Street in the Sample -Ewing Development Area, the legal description of which is attached hereto, marked Exhibit "A" and incorporated herein; and WHEREAS, this Commission declared the Sample -Ewing Development Area by Resolution No. 1222, adopted February 4, 1994, and in the same resolution declared the Sample -Ewing Development Allocation Area, Allocation Area No. 8; and WHERL:AS, the property located at 918 S. Michigan Street is located within the Sample - Ewing Development Allocation Area, Allocation Area No. 8. NOW, T11FREFORE, BE iT RIESOi,VED by the South Bend Redevelopment Commission as (lows: 1) 'File Commission finds that the application from Charles, Jr. &'Tracie Fulmer and Charles, Sr. & Faye Fulmer for three years of real property tax abatement consideration for property located at 918 S. Michigan Street in the Samplc -Ewing Development Allocation Area, Allocation Area No. 8, is hcrchy approved. 2) That a copy of this resolution be forwarded to the South Bend Common Council to indicate the Commission's approval of the petition for real property tax abatement for Charles, Jr. & Tracie Fulmer and Charles, Sr. and Faye Fulmer. Approved this 21 `` day of September, 2001, at the regularly scheduled meeting of the South Bend Rcdcvelopmcnt Commission. Ida, Secretary ML:Res1233 RESOLUTION 1848 EXHIBIT A That part of the northeast quarter of Section 13, Township 37 North, Range 2 East, City of South Bend, St. Joseph County, Indiana which is described as: that part of the recorded plat of "Baker's First Addition ", as recorded in the Office of the Recorder of St. Joseph County, Indiana. Beginning at the point of intersection of the East right -of -way line of Michigan Street and North right -of -way line of Ohio Street; thence along the East line of Michigan Street, N. 00° - 13'- 30" E., 80.52 ft. (North, 80.5 ft., record): thence S. 89° - 40'- 57" E., 149.98 ft. (East, 150.0 ft., record) to the West line of a 12 ft. wide public alley; thence along the Westerly line of said public alley for the next three courses, S. 00° - 19'- 55" W., 22.02 ft. (South, 22.0 ft., record) and N. 89° - 40' - 29" W., and S. 00° - 13'- 28" W., 58.57 ft.
