A RESOLUTION APPROVING AN APPLICATION FOR
REAL PROPERTY TAX DEDUCTION
WHEREAS, I.C. 6- 1.1- 12.1 -2(1) provides that an application for property tax deduction
may not be approved when the property is located in an allocation area as defined in I.C.
36- 7- 14 -39, unless the Redevelopment Commission which designated that allocation area adopts
a resolution approving that application; and
WHEREAS, the South Bend Common Council has received a petition for ten years of
real property tax abatement consideration from Indiana Land Trust 5181 for real property located
at 209 E. Colfax Avenue in the East Bank portion of the South Bend Central Development Area,
the legal description of which is attached hereto, marked Exhibit "A" and incorporated herein;
and
WHEREAS, this Commission declared the South Bend Central Development Area by
Resolution No. 737, adopted May 10, 1985, and in the same resolution declared the South Bend
Central Development Area, Allocation Area No. 1 A; and
WHEREAS, the property located at 209 E. Colfax Avenue is located within the South
Bend Central Development Area, Allocation Area No. 1 A;
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission as follows:
1) The Commission finds that the application from Indiana Land Trust 5181 for ten years
of real property tax abatement consideration for property located at 209 E. Colfax Avenue in the
South Bend Central Development Area, Allocation Area No. IA, should be and is hereby
approved.
2) That a copy of this resolution be forwarded to the South Bend Common Council to
indicate the Commission's approval of the petition for real property tax abatement for The
Ultimate Connection, Inc.
Approved this 16th day of March, 2001 at the regularly scheduled meeting of the South
Bend Redevelopment Commission.

Beginning at the point of intersection of the North line of
Colfax Avenue and the West line of Sycamore Street; thence,
North along said West line a distance of 10 feet; thence West
(assumed bearing) along a line 10 feet North and parallel to the
North line of Colfax Avenue, a distance of 100 feet; thence
Northwesterly along a line 10 feet, more or less, Easterly of
the Easterly Bank of the St. Joseph River a distance of 89
feet; thence West along a projected line perpendicular with the
St. Joseph River a distance of 5 feet; thence Northwesterly
along a parallel line 5 feet Easterly of the Easterly Bank of
the St. Joseph River a distance of 40 feet, more or less;
thence East along a line perpendicular with the St. Joseph
River a distance of 10 feet; thence Northwesterly along a
parallel line 15 feet more or less Easterly of the Easterly
Bank of the St. Joseph River a distance of 11 feet, more or
less; thence West 10 feet along a line perpendicular to the St.
Joseph River; thence Northwesterly to a point on the North lot
