A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING THE ASSIGNMENT OF THE COMMERCIAL LEASE BETWEEN THE
COMMISSION AND CATERING BY BILLIE, INC.
WHEREAS, the City of South Bend, Indiana, Department of Redevelopment acting by and
through the South Bend Redevelopment Commission ( "Commission ") approved a Commercial
Lease ( "Lease ") by and between the Commission and Catering by Billie, Inc. ( "Lessee ") on February
19, 1999; and
WHEREAS, pursuant to Paragraph 25 of the Lease, Lessee has the right to assign its rights
in the Lease provided that Commission has given express written consent to the assignment; and
WHEREAS, by the execution of an Assignment of Lease dated November , 2000
( "Assignment ") Lessee has requested and Commission has consented to the assignment of the Lease
by Lessee to Kendall Catering, Inc. d/b /a Catering by Billie ( "Assignee "); and
WHEREAS, Assignee has agreed to assume the obligations of Assignor and to be bound by
the terms and conditions contained in the Lease and the Assignment; and
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION AS FOLLOWS THAT:
1. The Assignment of Lease between the Commission and Lessee to Assignee shall be,
and hereby is, approved.
2. This Resolution shall be in full force and effect upon its adoption by the South Bend
Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment Commission held at 1300
County -City Building, 227 W. Jefferson Boulevard, South Bend, Indiana 46601 on November 17,
2000.
