Planning services for minor subdivision, special exception & variance petitions — HDC properties in Monroe Park Neighborhood Date: August 9, 2011 The attached Professional Services Agreement is a proposal from Danch, Harper & Associates to provide planning services bring seven city -owned properties (currently managed through the Housing Development Corporation) and one vacant lot into compliance with code and zoning ordinances. As the city's lease with HDC draws to a close and plans to dispose of the properties develop, bringing these properties into compliance will allow them to be sold. Part I — Preparation of 12 Special Use and multiple Variance Petition for the reconfigured home sites, including preliminary site plans, application forms, notice of public hearing, notice to adjacent owners and representation at Board of Zoning Appeals public hearings and Common Council hearing. Cost for this portion is $3,850 plus filing fees of $550$4600 (Danch Harper is working with the city to reduce filing fees). Part II — Preparation of a 10 -11 Lot Minor Subdivision for the properties, including the preparation of a primary plat, support data sheet, application forms and an adjacent property owners' list of owners within 300 feet of the subdivision boundary. Plat would allow for access to the interior parking lot through an ingress- egress easement and pedestrian easement. Cost for this portion is $4,850 with filing fees of $325. Staff requests approval of this Professional Services Agreement not -to- exceed $13,625 (which includes a maximum of $4600 in Building Department fees) to allow for the services to bring the seven Commission -owned properties into compliance and permit their eventual disposition /sale. RE: Planning Services cost quote for Special Exception, Variance Petition & Minor Subdivision for Rush St., South St. and Lincolnway properties, South Bend, Indiana: Dear Mr. Sikora: Please accept this letter as our written cost quote to provide your Department with Planning Services to prepare a Special Use and Variance Petition for the several properties located on Rush St., South St. and Lincolnway East we discussed in our meeting on August 2 "d. We would also prepare a 10 to 11 Lot Minor Subdivision for the properties once the Special Use and Variance Petition are approved. The intent is to take the existing homes and vacant land to reconfigure the properties for future sales. The Special Use request is to allow for the option for the homes to be used as single- family if desired by future homeowners. This is necessary, as the present zoning of "MF1" does not permit single- family homes. We will also request a Special Use for the existing parking lot located behind the existing homes, which is being used as off - street parking for the cluster of homes described above. We will also request several variances for the reconfigured properties to bring them into compliance with the "MF1" development standards. We will prepare a 10 -11 Lot Minor Subdivision to create legal lots of record for each home site. There will be a parking lot and ingress- egress easement created to split the existing parking lot onto several of the home sites. This will allow future homeowners to have off - street parking available for their homes. Our scope of services would be as follows: A). Preparation of a 12 Special Use and multiple Variance Petition for the reconfigured homes sites as described above, including Preliminary Site Plan, Application forms, Notice of public Hearing, Notice to adjacent owners and representation at Board of Zoning Appeals Public Hearing(s) and at South Bend Common Council Public Hearing(s). The Building Department has not confirmed how they will charge for this project as of today). B). Preparation of a 10 -11 Lot Minor Subdivision for the properties described above. This 10 -11 Lot Minor Subdivision would be prepared in accordance with the City of South Bend Subdivision Control Ordinances. The 10 -11 Lot Minor would include the preparation of the Primary Plat, the Support Data Sheet, the application forms and an adjacent property owners' list of owners within 300 feet of the subdivision boundary. The Plat would also show access to the interior parking lot through an Ingress - Egress easement and pedestrian easement. The cost for the preparation of this 10 -11 Lot Minor Subdivision including the staking of all new lot corners would be ......................... ............................... $ 4,850; The filing fees would be approximately $ 325. If revisions were requested by any review agency or the City, those revisions would be done at our standard hourly rates, which are attached. If the above proposal is acceptable, we could start the required work within 5 -9 working days or less. We would Van to submit the Petition to the Board of Zoning Appeals by Sept. 13th for an Oct. 5` Public Hearing and either an Oct. 20 or Nov. 14th meetings before the City Council.
