(1) Public Hearing on Resolution No. 2013
amending the South Side Development
Area Development Plan.
Mr. Rock noted that the Public Hearing file
was complete and requested the following
items be entered into the record: (1) Copy of
the Notice of Hearing; (2) Copy of
Resolution No. 2013; (3) Affidavits from the
Tri County News and South Bend Tribune
that the Notice of Public Hearing was
published in those newspapers on
November 7, 2003; (4) Statement from staff
that affected property owners and registered
neighborhood associations were notified;
and (5) As of 10:00 a.m. this morning, no
written remonstrances were received.
Mr. Schalliol reported that Resolution
No. 2013 will amend the South Side
Development Area Development Plan to
include one (1) property, located at 505 East
Ireland Road, to the acquisition list. The
property is a single family structure located
on the northeast corner of Ireland Road and
Fellows Street. The parcel is necessary to
facilitate streetscape and corridor
improvements within the Erskine Hills
shopping district which is located in the
South Side Development Area.

Ms. Greene noted that an amendment to the
development plan for the area is governed by
Indiana Code 36 -7 -14 -17.5 and before
approving the proposed amendment, the
Commission must make the following
findings: (1) the amendment is reasonable
and appropriate when considered in relation
to the original resolution or development
plan and purposes of the Redevelopment Act
and; (2) the resolution or plan, as amended,
conforms to the comprehensive plan for the
City.
Mr. Hunt opened the Public Hearing on
IL Resolution No. 2013 and asked if there was
anyone from the public who wished to
speak. There being no one from the public
who wished to speak regarding Resolution
No. 2013, Mr. Hunt closed the Public
Hearing for whatever action the Commission
wished to take.
(2) Commission approval requested for
Resolution No. 2013.
Upon a motion by Mr. Faccenda, seconded
by Mr. Kahn and unanimously carried, the
Commission found the amendment to be
appropriate and reasonable, to conform to
the comprehensive plan for the City and
approved Resolution No. 2013 amending the
South Side Development Area Development

property acquisition, redevelopment and
economic development in or serving the
Airport Economic Development Area.
Mr. Rock reported that Resolution No. 2018
will appropriate $16M in bond proceeds for
the Airport Economic Development Area.
Two current bonds in the Blackthorn area
will be paid off and the additional funds will
be used for various road construction costs
including Cleveland Road, Olive Road,
Nimtz Parkway, Bendix Drive and
Lincolnway West intersection, and the
Bendix Drive relocation.
Mr. Rock advised that the public hearing
file, which was managed by Baker &
Daniels, was complete and requested the
following items be entered into the record:
(1) Copy of Resolution No. 2017 adopted
November 7, 2003; (2) Copy of Notice of
Hearing; (3) Affidavits from the Tri County
News and South Bend Tribune that the

Mr. Laurent reported that the Access and
Indemnification Agreement was the
Commission's standard form. On
November 13, 2003, the Commission and
Rose Fuel closed on the property, including
the Oliver boilerhouse and smokestack,
which is now 918 Oliver Plow Court. As a
result of our ongoing renovation and
stabilization activities at that site, we still
have approximately two to three weeks of
work remaining. Now that Rose Fuel owns
the property, the Commission will be
indemnifying Rose Fuel for our contractor's
work on site. Due to slow response from
Rose Fuel & Materials legal counsel, we
have not received their comments on the
access agreement. Two forms are being
presented in order to expedite orderly
completion of the project. Staff is
requesting the Commission execute both of
its standard forms, the short version and the
long version for Access and Indemnification.
Staff will have the appropriate form signed
by the Rose Fuel organization.
Mr. Hunt asked if this action was approved
by legal counsel.
Ms. Greene responded that it was, and both
forms were standard in content. The
Commission will indemnify the developer
for any actions or harm caused by the
Commission in their activities.

Indemnification Agreement with Rose Fuel
& Materials, Inc. in the Sample -Ewing

proposal for professional services in the
Airport Economic Development Area.

Mr. Case reported that to facilitate the
acquisition of property at 2502 Lawton
Street, staff needs to obtain a current title
policy for the property. Staff recommends
accepting the proposal from Meridian Title
Corporation in the amount of $700.

Ms. Greene noted for the record background
information related to Resolution No. 2016.
The proposed Northeast Neighborhood
Development Area is a new development
area that the Commission is seeking to
establish. Resolution No. 2016 is the
declaratory resolution for the development
area which is governed by Indiana Code
36- 7- 14 -15. The purpose of a declaratory
resolution is to declare the area as blighted,
such that it is a menace to the social and
economic interest of the jurisdiction and its
inhabitants. The Commission is also, at the
time of the declaratory resolution, asked to
declare that the plan for the underdeveloped
area cannot be achieved by the normal
regulatory processes or the ordinary
operation of private enterprise without using
redevelopment authority powers, and that
the accomplishment of the plan for
development of that area would be a public
utility and benefit by attracting new jobs,
keeping existing jobs, increasing the tax
base and diversifying the economic base.
Ms. Hughes reported that the resolution is
the first step in the process of creating a new
Development Area in the City of South
Bend. Initiating the establishment of a
Redevelopment Area is described in Indiana
Code 36- 7 -14 -1. Resolution 2016 and the
Development Area Plan, Exhibit A, must be
approved by the Redevelopment
Commission before being presented to the
Area Plan Commission of St. Joseph County

and the Common Council of the City of
South Bend. With the subsequent approval
of these bodies, and in consideration of any
amendments they may make, a Confirming
Resolution will come before the
Commission in late December. At that time,
a public hearing regarding the designation
and the Development Plan will be conducted
before for final approval by the
Commission.
A map was displayed entitled "Northeast
Neighborhood Development Area" depicting
the proposed boundaries of the area. The
Area is approximately 616 acres and extends
from the St. Joseph River and Niles Avenue
on the west to Twyckenham Drive on the
east, and from Napoleon Street and the
current South Bend City limits on the north
to LaSalle Avenue on the south.
There are currently five other Development
Areas within the City. For each of these, a
Development Plan has been put forth and
Tax Incremental Financing has been used as
a funding mechanism for creating targeted
economic growth opportunities. The
Northeast Neighborhood will be considered
a Redevelopment Area because it meets the
statutory requirements for blight. The
designation of blight is not specific to a
property, but to the general conditions of an
entire area. Indications of blight include:

prevent the normal use or development of
property.
The Northeast Neighborhood is primarily a
residential area, situated between the
University of Notre Dame campus and the
Central Business District. The median
household income of the Area is roughly
62% of that of the City of South Bend as a
whole.
Lack of development in the Northeast
Neighborhood is evidenced by not only the
lack of new business activity and housing
starts, but the retreat of longstanding
businesses, institutions and residents.
St. Joseph Regional Medical Center
administrators have announced that the
hospital facility that has existed on LaSalle
Avenue for a century will be vacated by
2006. Another high - profile closure was that
of Aldi's and Goodwill in 1998. These
retail businesses, located on Eddy Street at
Five Points, represented not only the
commercial hub of the neighborhood but a

positive social nexus as well, one that is
critically missing now that residents must
leave the neighborhood to shop.
Cessation of growth can be seen in
population statistics that have not recovered
since an initial dramatic decrease in the
1970's. New housing investment reflects
almost entirely the activity of not - for - profits
targeting the neighborhood for heavily
subsidized rehabilitation and infill projects.
Between 1994 and 1997, Neighborhood
Housing Services added approximately 30
new homeowners to the neighborhood, and
IL Habitat for Humanity and the South Bend
Housing Authority were the only other
housing investors of note. Market rate
housing development has not been seen at
comparable levels.
Deterioration of improvements is apparent
throughout the neighborhood, and includes
both private property and public
infrastructure. Delapidated storefronts and
shop windows with burglar bars line Eddy
Street and the Five Points area, reinforcing
negative perceptions about the viability of
commercial enterprise in the area. Absentee
landlords are a particular problem in
residential areas, as conversions from single
family homes to apartments for student
rentals have proliferated over time. There
are also longtime homeowners, often the
elderly, who simply are not physically or
financially able to adequately maintain their
homes.

Lack of minimum setbacks, lack of a buffer
between vehicular traffic and sidewalks, lack
of pedestrian orientation of any kind, are
elements of an obsolete infrastructure
system that has not met increased demands
over time. State Road 23, South Bend
Avenue between Eddy Street and
Twyckenham, is currently carrying 15,550
cars per day, exceeding its capacity and
typically becoming bottlenecked at peak
times. Significant public investment will be
required to upgrade this thoroughfare and its
interchange with Corby and Eddy at Five
Points. Ms. Hughes submitted for the
record, a letter dated September 26, 2003 to
Mayor Steve Luecke from the Board
presidents of both the Northeast
Neighborhood Council and the Northeast
Neighborhood Revitalization Organization,
supporting the City's preferred plan for the
expansion of this segment of the State
highway. Unanimous consent was given by
these representative neighborhood boards to
the design supported by the Northeast
Neighborhood Development Area
Development Plan.
The housing stock of the Northeast
Neighborhood is some of the oldest in South
Bend, though it has not seen the
reinvestment other historic neighborhoods
closer to downtown have. The
neighborhood at its earliest beginnings was a
working class neighborhood; therefore,
homes were modest to start with. Today the

neighborhood is populated with a high
number of non - family households, which
tends to include student populations living
singly or in groups, and elderly homeowners
and renters living alone. The neighborhood
as a whole is statistically near the City
average in housing condition and vacancy,
but pockets of disinvestment and decay are
widely apparent. Census Block Groups can
be referenced using the displayed small map
entitled "Northeast Neighborhood
Development Area Census Tracts." Ms.
Hughes presented three Tables illustrating
the quality of housing stock in geographic
areas of the neighborhood, represented by
Census block groups.
Table 1 references the occupancy of existing
structures; showing the rates of occupancy
versus vacancy. Vacancy rates range from
8% in Block group 2 to 18% in Block group
3. The neighborhood average is about 13 %.
Table 2 points to the character of
occupancy. Of the occupied structures,
owner- occupied housing versus renter -
occupied is shown. There are wide
discrepancies here. At 70 %, Block Group 2
shows the strongest home ownership among
residents, with Block Group 3 showing only
38% owner occupancy.
Table 3 illustrates the median age of homes
in the Northeast Neighborhood and median
home value of owner - occupied units.
Homes are only slightly older on average
than the average housing stock in the City.

The 1998 "Housing and Community
Development Plan" found that 74% of South
Bend's housing stock was built before 1960.
76% of housing units in the Northeast
Neighborhood were built before 1960.
Block Group 3 home values are far below
the other areas represented, and most are
below the City's median home value average
of $64,206.
Substandard buildings are concentrated in
pockets slated for Residential and
Commercial redevelopment in the Northeast
Neighborhood Development Area Plan.
Earlier comprehensive and neighborhood
plans have documented the blighting
influence of these properties. Repeat
building code violations and illegal dumping
in this area are prevalent.
As an example, in the blocks between
Georgiana and Duey Streets in the
northeastern quadrant of the Development
Area, of 103 lots, 56% are vacant lots and
44% have structures. Of the lots with

Surveys conducted by South Bend Heritage
staff and City of South Bend Community
Development staff quantifying code
adherence have found a large number of
structures in this area to be deteriorating or
delapidated.
Other factors that hamper normal, private
sector -led development include the lack of
large development parcels. Marketable sites

opportunities. The proposed reconfiguration
of the Five Points intersection, in particular,
will further this goal.
The Northeast Neighborhood Development
Area Plan is a general development plan that
outlines goals, objectives, strategies and
proposed activities aimed at the
revitalization of the neighborhood. The Plan
is the result of a joint commitment and effort
of the City and the institutions and
neighborhood residents represented by the
Northeast Neighborhood Revitalization
Organization. The Plan begins with a
history and survey of existing conditions in
the Area. The Plan also recognizes and
draws from previous Plans that have been
done for and by neighborhood residents and
stakeholders.
Ms. Hughes displayed a map entitled
"Northeast Neighborhood Development
Area Sub - areas" illustrating the 5 sub -areas
that are delimited in this Plan. These are
Eddy Street Commercial Redevelopment
Area, Georgiana- Talbot Residential
Redevelopment Area, Homeownership
Preservation Area, St. Joseph Regional
Medical Center Redevelopment Area, and
Madison Center Housing and Commercial
Redevelopment Area.
The Northeast Neighborhood Development
Area will be declared a Tax Increment
Finance allocation area, which will serve to

direct nonresidential property tax increment
generated back into the Area. The resources
needed to bring about the reversal of blight
conditions will have to come from the
partnership efforts of multiple sources over
many years, including federal, state and local
governments, not - for - profits and
neighboring institutions, private sector
developers and other neighborhood
stakeholders. The plan identifies no
properties for acquisition at this time.
In accordance with state statute, Declaratory
Resolution No. 2016 specifically sets forth a
IL finding of blight and gives the Development
Area a name, this being the "Northeast
Neighborhood Development Area," and
declares the redevelopment of the Area to be
in the public interest of the City. It also
approves the Northeast Neighborhood
Development Area Development Plan,
together with all maps, plats and surveys
which are included, and assures
development of the Area will be in
accordance with the Plan presented to the
Commission.
In addition, Resolution No. 2016 approves a
Relocation Policy that is consistent with past
development area relocation policies.
Resolution No. 2016 declares an allocation
area for the purposes of capturing a tax
increment. The allocation area has specific
uses set forth in the statute as to how the tax
increment can be used, and the declaratory
resolution sets forth those uses.

Ms. Greene asked for confirmation that all
maps and studies prepared by Ms. Hughes
are available for public inspection.

no properties are to be acquired at this time.
Ms. Hughes answered that the statement was
correct.
Upon a motion by Mr. Faccenda, seconded
by Mr. Blake and unanimously carried, the
Commission approved Resolution No. 2016
designating the Northeast Neighborhood
Development Area, declaring the Northeast
Neighborhood Development Area to be
blighted, approving a Development Plan and
conditions under which relocation payments
will be made, and establishing an Allocation
Area for purposes of Tax Incremental
Financing.

was sold to Rose Fuel & Materials, Inc.

Mr. Rock expressed the designation of the
Northeast Neighborhood Development Area will
certainly improve that neighborhood and area, and
staff looks forward to moving the plan ahead.
8. NEXT COMMISSION MEETING
The next Regular Meeting of the Redevelopment
Commission is scheduled for December 5, 2003 at
10:00 a.m.
