HomeMy WebLinkAbout08/27/07 Committee Meeting Minutes,~ x."'. ~~ ~ ; , ' ~ Public Works and Property Vacation Committee 2007 Sou#h Benc[ Gommon Council The August 27, 2007 meeting of the Public Works and Property Vacation Committee of the South Bend Common Council was called to order by its Chairperson, Council Member David Varner at 4:06 p.m. in the Council's Informal Meeting Room. Persons in attendance included Council Members Kelly, Varner, Pfeifer, Kirsits, Dieter, Kuspa, Rouse, and Puzzello;, Mayor Stephen Luecke, Public Works Director Gary Gilot, Bernie Feeney, Mrs. Kopola, City Clerk John Voorde, George Herendeen, Mark Dobson, Robert Mathis, Jamie Loo of the South Bend Tribune and Kathleen Cekanski- Farrand, Council Attorney. Dr. Varner noted that the Committee members include Council Members Pfeifer, Dieter, Kelly and himself; slang with J. Edward Talley as the Citizen Member. Dr. Varner then called for a presentation on Substitute Bill No. 43-07 requesting a vacation of the first eastlwest alley north of Nnrthside Boulevard. Substitute Bill No. 43-07: Re nest to Vacate Ist EIW Alle north of Northside Boulevard J. Bernard Feeney of Lang, Feeney & Associates, Inc., with offices located at 795 South Michigan Street in downtown South Bend made the formal presentation. He noted that the purpose of the vacation is to eliminate the alley which access and divides an existing parking lat. The parking lot has access from 21St Street. Mr. Feeney provided a 2-page handout depicting maps of the area in question (copy attached). He indicated that his client would provide an access agreement with the Fire Department. Public Works Director Gary Gilot reviewed the areas of concern highlighted in the Board of Public Works letter of June 11, 2007 (copy attached). He noted that based on the information provided by Mr. Feeney all three (3) items have been addressed. No one from the public spoke in favor or in opposition to the Bill. Council Member Pfeifer made a motion, seconded by Council Member Dieter that Substitute Bill No. 43-07 be recommended favorably to Council. The motion passed. Dr. Vamer then called for a presentation an Bill No. 49-07 requesting a vacation of a portion of Brick Raad right-of-way in German Township. August 27, 2007 Public Works and Property Vacation Committee Page 2 Bill No. 49-07: Re nest to Vacate a Portion of Brick Road Ri ht-of-Wa George E. Herendeen, an attorney with offices at 419 West Jefferson Boulevard in downtown South Bend made the formal presentation. He noted that the Council's Informal Meeting Room formerly housed the City Court Chambers when he was City Judge. Mr. Herendeen stated that the land in question is a "sliver of right-of-way" which abuts the petitioner`s property and Brick Road. The land in question was formerly owned by the State of Indiana and was given to the City of South Bend. The City has no other use for the property and has na objection to it becoming part of the petitioner's Iot. Mr. Gilot stated that the Board of Public Works recommends the vacation. Council Member Dieter made a oration, seconded by Council Member Pfeifer that Bill No. 49-07 be recommended favorably to Council. The motion passed.
