HomeMy WebLinkAbout04/09/07 Committee Meeting MinutesZonin and Annexation Committee Meetin 9 9 2007 South Bend Common Council The April 9, 2007 meeting of the Zoning and Annexation Committee of the South Bend Common Council was called to order by its Chairperson, Council Member Al "Buddy" Kirsits at 3:30 p.m. in the Council's Informal Meeting Room. Persons in attendance included Council Members Kelly, Pfeifer, Kirsits, Varner, White, Dieter, and Puzzello; Building Commissioner Don Fozo, Mark Lyons, Michael Danch, J. Edward Talley, Marty Wolfson, Martha Lewis, Mrs. Kopola, David Rafinski, Nancy Sulok and Jamie Loo of the South Bend Tribune and Kathleen Cekanski-Farrand, Council Attorney. Council Member Kirsits noted that the committee members include Council Members Kuspa, Pfeifer, Varner and himself. He noted that Council Member Kuspa is recuoperating from recent surgery. Substitute Bill No. D9-07 Rezoning of Llncolnwa_y WestlKnoblocklMaplewood:: Council Member Kirsits called for a presentation on Substitute Bill No. 09-07 which is a rezoning request from Stanz Cheese. Dr. Varner made a motion, seconded by Council Member Pfeifer to accept the substitute version of the BiII. The motion passed. Mark Lyons, an Area Plan staff member reported that the substitute bill addressing the rezoning of approximately three (3) acres from single family to light industrial. It received a favorable recommendation from the Area Plan Commission at its meeting of March 20, 2007 (report attached). David Rafinski, a representative for Stanz Foodservice, Inc. noted that the rezoning would complete the zoning for that entire city block, He highlighted the conceptual site plan for the area {copy attached}. No one from the public spoke in favor or in opposition to the bill. Dr. Varner made a motion, seconded by Council Member Pfeifer that substitute Bill No. 09-07 be recommended favorably to Council. The motion passed. Substitute Bill No. 10-07 Rezoning of1914 Miami Street:: Council Member Kirsits noted that the petitioner for Substitute Bill No. 10-07 has requested that this Bill be continued until the May 14, 2007 Council meeting. Znning and Annexation Committee Aprif 9, 2QO7 Page 2 Council Member Pfeifer made a motion, seconded by Dr. Varner that Substitute Bill NO. 10-07 be recommended to be continued to May 14t" at the request of the petitioner. The motion passed. Bill No 11-d7 Rezoning of of the Northwest Corner of Ireland Road and Lafayette Boulevard:: Council Member Kirsits called for a report from Area Plan on Bill No. 11-D7. Mark Lyons, as Area Plan staff member reported that the Area Plan Commission held a public hearing on the Bill on March 20, 2007. It is requested a rezoning from 5F1 Single Family and Two Family District to CB Community Business District. The Area Plan Commission gave a favorable recommendation to this request (report attached). Michael J. Danch, President of Dance, Horner & Associates with offices located at 1643 Commerce Drive in South Bend made the formal presentation. The rezoning would permit the construction of a multi-tenant facility. He highlighted portions of the preliminary site plan for the area (copy attached). He stated that the plan shows the new right-of-way. Dr. Varner noted that this area of the city will be very busy in the very near future in light of all the development. In response to questions from Council Member Kirsits, Mr. Danch stated that small retail who would utilize 1,500 square feet to 2,D00 square feet are anticipated. Mr. Gilot added that the Department of Public Works is involved in the traffic collector for this area. He noted that the light at Main Street is temporary. The "grandest plans" call for a tie into the theater complex, but that is not in the immediate plans. Following discussion, Council Member Pfeifer made a motion, seconded by Dr. Varner that Bill No. 11-07 be recommended favorably to Council. The motion passed. Bill No. 07-49 Board of Zonin A eats Petion for the 1708 Block of Burdette: Council Member Kirsits called for a report from the Board of Zoning Appeals on Bill No. D7-49. Dan Fozo, Building Commissioner, reported that the Board of Zoning Appeals held a public hearing on March 15t" and recommends the Bill favorably to Council. In response to a question from Dr. Varner, Mr. Fozo noted that he anticipates more requests for PUDs. Zoning and Annexation Committee April 9, 20Q7 Page 3 Michael J. Danch, President of Dance, Horner & Associates with offices located at 1643 Commerce Drive in South Bend made the formal presentation. He stated that this is the John Roy property who plans to develop single-family attached units. Mortgage lenders prefer that the person owns the property for financing purposes. There was no one present to speak in favor or in opposition to the Bill. Dr. Varner made a motion, seconded by Council Member Pfeifer that Bill No. 07-49 be recommended favorably to Council. The motion passed. Miscellaneous Business: Council Member Kirsits Hated that a meeting was held recently to receive information from the Area Plan staff to highlight proposed .changes to Chapter 21 addressing the zoning ordinance. He noted that minutes fram that meeting and the handout have been provided to the Council.
