In 1993, by Ordinance No. 8412-93 subsection 1, the Board created the Building Department as an enterprise fund. It has been determined that in order to maintain the enterprise fund, a fee increase would be needed as set forth in this ordinance. Now, therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section 1. Residential: Ten cents ($0.10) per square footage for the first one hundred thousand (100 000) square feet and eight cents ($0.08) per square foot for each additional square foot, with a minimum fee of $20.00. b. Chapter 6, Article 1, Section 6-4.1, 4.2, 4.3, 4.4, and 4.5 be amended by renumbering these sections to 6-4.2, 4.3, 4.4, 4.5, and 4.6. Section 3. Chapter 6, Article 1, Section 6-4 be amended by adding 6.4.1 Filing, Improvement Location Permit, Written Zoning, Legal Non-conformance, and/or Legal Lot of Record Verification Fees. Sec. 6-4.1. Filing Fees and Improvement Location Permits. (a) The fees levied by this section shall be paid prior to the issuance or acceptance by the Building Commissioner of any petitions filed with the Board of Zoning Appeals and Improvement Location Permits as regulated by Chapter 21-Zoningtof the South Bend Municipal Code. 1) Board of Zoning Appeals: a. Variances and Appeals - $85.00 b. Special Exceptions - $300.00 2) Improvement Location Permit: a. First Term: $20.00 b. Renewal: $20.00 Section 4. Chapter 6, Article 2, Section 6.6.4(c) be amended as follows: (c) All installations of wood burning stoves shall be inspected by the Department two (2) times, one (1) each for preliminary venting work and for final, completed installation. The permit holder shall notify the Department at least twenty-four (24) hours in advance of the time the work is ready for inspection. If the work does not pass inspection, a reinspection fee of elhu~{-$9:98} twenty-five dollars ($25.00) shall be charged for each future inspection of that state of work. Section 5. Chapter 6, Article 4, Section 6-10 (c) be amended as follows: (c) Schedule of permit fees. Zoning Administrator This ordinance is to keep us in compliance with Ordinance No. 8412-93, subsection 1, which established the Consolidated Building Department as an enterprise fund. It is our responsibility to monitor fees in order to assure that we continue to be self-supporting. In an effort to keep the Department running with a cash reserve, we have left four (4) positions vacate over the past year. We still feel it is necessary to increase the fees due to rising costs, such as postage from 37¢ to 41¢, gas from $1.20 to $2.90 a gallon, and total increase in benefits of $67,500, since the 2004 fee increase.
