AN ORDINANCE OF THE COMMON COUNCILOF THE CITY OF SOUTH BEND, INDIANA,
TO AMEND VARIOUS SECTIONS OFCHAPTER 6, ARTICLE 1, OF THE
SOUTH BENDMUNICIPAL CODE ADDRESSING PERMIT FEES
AND THE DEFINITION OF PLUMBING CONTRACTOR
STATEMENT OF PURPOSE AND INTENT
On December 31, 1991, the City of South Bend and the County of St. Joseph entered into an
agreement to merge their building departments; and further create the "Consolidated Building Board".
In 1993, by Ordinance No. 8412-93 subsection 1, the Board created the Building Department as an
enterprise fund.
It has been determined that in order to maintain the enterprise fund, a fee increase would be
needed as set forth in this ordinance.
Now, therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as
follows:
Section 1. Chapter 6, Articlel, Section 6-4(b)(1)(2)(7)(8)(9) and (10) shall be amended to
read as follows:

(1) The fee for permits issued for new construction and building additions shall be
based upon square footage of such new construction or addition at the following rates:
a. Residential: Ten cents ($0.10) per square footage for the first one hundred
thousand (100 000) square feet and eight cents ($0.08) per square foot for each additional square foot,
with a minimum fee of $20.00.
b. Commercial: Twelve cents ($0.12) per square footage for the first one
hundred thousand (100.000) sauare footage and ten cents ($0.10) for each additional square foot, with a
minimum fee of $20.00.

(2) Permits issued for all alterations, repairs, remodeling of existing structures over
five hundred dollars ($500.00), fence installations, in-ground pool installations, communication towers,

(7) Sign Permits. Fees shall be charges for the issuance of permits for the installation
or erection of freestanding signs; billboards, including outdoor and off-premises signs; facia signs;
marquee or canopy signs and for lettering on buildings as follows:
(a) One (1) square foot or less of display area and embellishments: No fee
(b) One (1) square foot to twenty-five (25) square feet of display area and

(c) Twenty-six (26) square feet to fifty (50) square feet of

display area and embellishments: Seventy-five dollars ($75.00);
(e) In excess of one hundred (100) square feet of display area and

(f) Temporary signs: First thirty (30) days' permit,

(8) Wrecking and demolition permit fees shall be as follows:

Section 2. Chapter 6, Article 1, Section 6-4.1, 4.2, 4.3, 4.4, and 4.5 be amended by
renumbering these sections to 6-4.2, 4.3, 4.4, 4.5, and 4.6.
Section 3. Chapter 6, Article 1, Section 6-4 be amended by adding 6.4.1 Filing,
Improvement Location Permit, Written Zoning, Legal Non-conformance, and/or Legal Lot of Record
Verification Fees.
Sec. 6-4.1. Filing Fees and Improvement Location Permits.
(a) The fees levied by this section shall be paid prior to the issuance or acceptance by the
Building Commissioner of any petitions filed with the Board of Zoning Appeals and Improvement
Location Permits as regulated by Chapter 21-Zoningtof the South Bend Municipal Code.
1) Board of Zoning Appeals:
a. Variances and Appeals - $85.00
b. Special Exceptions - $300.00
2) Improvement Location Permit:
a. First Term: $20.00
b. Renewal: $20.00
Section 4. Chapter 6, Article 2, Section 6.6.4(c) be amended as follows:
(c) All installations of wood burning stoves shall be inspected by the Department two (2)
times, one (1) each for preliminary venting work and for final, completed installation. The permit
holder shall notify the Department at least twenty-four (24) hours in advance of the time the work is
ready for inspection. If the work does not pass inspection, a reinspection fee of elhu~{-$9:98}
twenty-five dollars ($25.00) shall be charged for each future inspection of that state of work.
Section 5. Chapter 6, Article 4, Section 6-10 (c) be amended as follows:
(c) Schedule of permit fees. Permits issued for plumbing work within the city shall be
subject to the following fee schedule, with a minimum permit fee being twenty dollars ($20.00).

Attached is a proposed ordinance to update our fees.

This ordinance is to keep us in compliance with Ordinance No. 8412-93, subsection 1, which
established the Consolidated Building Department as an enterprise fund. It is our responsibility
to monitor fees in order to assure that we continue to be self-supporting.
In an effort to keep the Department running with a cash reserve, we have left four (4) positions
vacate over the past year. We still feel it is necessary to increase the fees due to rising costs,
such as postage from 37¢ to 41¢, gas from $1.20 to $2.90 a gallon, and total increase in benefits
of $67,500, since the 2004 fee increase.

Section 1. Chapter 6, Article 1, Section 6d(b)(1)(2)~8)(9) and (1 O) shall be amended fo read as folow
(1) The fee for pemits issued for new consWrxion and building addtions shall be based upon the squat
footage of such new constrrxxiion or addition at the rate of eight cerds ($0.08) per square foot for the fir
one hundred thousand (100,000) square feet and six cents ($0.06) per square foot for each addition

STATEMENT OF
PURPOSE AND INTENT
On December 37, 1991,
the City of South Bend
and the County of St.
Joseph entered into an
agreement to merge their
building departments;
and further create the
"consolidated Building
Board". In 1993, by Or-
dinance No. 8412-93
subsection 1, the Board
created the Building De-
partment as an enter-
prise fund.
