The September 7, 2006 meeting of the Zoning and Annexation Committee was called to
order by its Chairperson, Councilmember Ervin Kuspa at 3:15 p.rn, in the Council
Informal Meeting Room.

Chairperson Kuspa began the hearing by stating the purpose was to work through the
process of putting together an effective enforceable ordinance controlling parking in
residentially zoned areas. The process, as he outlined, was io review the recent past
regarding yard parking to get infarmatian, and to solicit opinions. In other words, to
listen before submitting bi1146-06 for Council action.
Councilmember Ann Puzzello provided a brief retrospective and introduced Catherine
Toppel, Director of the Cade Enforcement Department of the City.
Catherine Toppel said Cade Enforcement would be responsible for enforcing the parking
provisions of 46-06. She noted that she was part of the group that revised the zoning bill
in 2004. Apparently yard parking controls were inadvertently left out of the revision. A
legal challenge decided by Judge Gotsch focused on that inadequacy.
Councilmember Puzzello also introduced Larry Magliozzi of Area Plan and Ann Carol-
Nash from the City Legal Department. Both helped author Puzzello's latest approach in
substitute bi1146-06 and also both stressed quality of life issues the bill would help
insure.
Councilmernber Kuspa asked to hear from those citizens attending who supported the
latest bill. Four residents rose to evidence their support, all testimony addressing quality
of life and property value issues.
Kuspa called on those against. Eight spoke all agreeing an allowance for special events
was needed though all supported general yard parking restrictions. Most vocal of those
opposing was Jim Masters. He maintained the bill as presently drafted was a
disappointment, abad bill woefully inadequate, particularly in its enforcement procedure
initiating a lengthy cumbersome legal process. He suggested as he has for the last two
years, the adoption of a permit procedure far those wishing to park in yards supported by
a stiff ticketing process.
In all Kuspa counted 6 indicated support and 13 in attendance against substitute Bill 46-
06.
During the Council portion Councilmember Puzzello described her "special exception"
approach followed by questions and comments from Couneilrnember's Varner, Kelly,
Kirsits and Rouse.
Given the division on the Council yet recognizing everyone's desire to do something
Councilmember Kuspa called upon President Rouse who articulated his support far the
spirit of the bill while recognizing apparent inadequacies that needed more work..
Without resolution Councilmember Kuspa adjourned the meeting at 7:05 p.m.
