HomeMy WebLinkAbout07-24-06 Parks, Recreation, Cultural Arts & EntertainmentParks, Recreation, Cultural Arts & Entertainment Committee (PARC} 2005 South Bend Common Council The July 24, 2006 meeting of the Parks, Recreation, Cultural Arts & Entertainment Committee {PARC) Committee of the South Bend Common Council was called to order by its Chairperson, Council Member Derek Dieter, at 4:49 p.m, in the Council's Informal Meeting Room. Persons in attendance included Council Members Pfeifer, Varner, Kuspa, Kirsits, Rouse, Dieter, Kelly, and Puzzello; Community and Economic Development Executive Director Sharon Kendall, Martha Lewis, Assistant City Attorney Thomas L. Bodnar, City Clerk John Voorde, Mrs. Kopola, Don Inks, Marty Wolfson, Cahrles A. Shock, Park Superintendent Phil St. Clair, Jamie Loo of the Saufh Bend Tribune, and Kathleen Cekanski-Farrand, Council Attorney. Council Member Dieter noted that members of the PARC Committee included Council Members Kuspa, Puzzello, Kirsits and himself; and Charles A. Shock serves as the Citizen Member. Substitute Bill No. 27-06: Park Rules: Council Member Dieter called for a presentation on Substitute Bill No. 27-06 which would amend the South Bend Municipa! Code by including a new Section 19-79 Park and Park Program Rules. Assistant City Attorney Thomas L. Bodnar made the formal presentation. He noted that Section 2-137' of the South Bend Municipal Code authorized the Park Department to operate under the state law located at Indiana Code § 36-10-4- 9(c). He noted that the state law provides the Park Board with authority to set rules, however an Indiana case has raised doubt. In light of that, the proposed ordinance has been drafted. Mr. Bodnar noted that in light of various concerns which were raised with regard to the original version, a meeting was held with Park Superintendent Phil St. Clair, Council Member Dieter, the Council Attorney and himself. Mr. Bodnar stated that additional information, requested by the Council Attorney, has been submitted (copy attached), in response to her June 6~~' memorandum (copy attached) and the subsequent discussions. The substitute bill addresses all concerns previously raised and is recommended for passage. Mr. Bodnar noted that the regulations would provide a mechanism which would protect patrons of the parks, as well as the park staff. He noted that the permanent ban provision has been eliminated and knowledge of park rules July 24, 2006 PARC Committee Meeting Page 2 and regulations would be enhanced with each major park facility having their regulations available for both patrons and employees. Park Superintendent Phil St. Clair spoke in favor of the substitute bill He circulated copies of the Code of Conduct, as well as park policies and procedures which are utilized by the park recreation programs. He noted that no one would be permanently banned from the parks. In response to a question raised by Council Member Dieter, Mr. Bodnar stated that police reports have not been required in the past. Mr. St. Clair noted that it would depend on the type of violation, with assaults requiring the police to be called. Council Member Pfeifer suggested that as much pro-active means be used to let the public knave about the regulations. Mr. St. Clair stated that some limited signage would be further looked into as one means of informing the public. Following discussion, Council Member Kirsits made a motion, secanded by Council Member Puzzello that substitute Bill No. 27-06 be recommended favorably to Council The motion passed. Under miscellaneous business, Council Member Kirsits voiced concern about heavy equipment being used in the Muessel Grove, with it becoming a staging area. He noted that in light of the many youth in the area, that he has safety concerns which should be addressed by the Administration. Mr. St. Clair stated that he would look into it. Council Me a erek ie er, hairperson PARC Committee Attachments Health and Public Safety Committee Meeting 2006 South Bend Common Council The July 24, 2006 meeting of the Health and Public Safety Committee Committee of the South Bend Common Council was called to order by its Vice- Chairperson, Council Member Ann Puzzello, at 4:34 p.m. in the Council's informal Meeting Room. Persons in attendance included Council Members Pfeifer, Varner, Kuspa, Kirsits, Rouse, Dieter, Kelly, and Puzzello; Mayor Stephen Luecke, Fire Chief Luther Taylor, Director of Public Works Gary Gilot, Community and Economic Development Executive Director Sharon Kendall, Martha Lewis, Assistant City Attorney Thomas L. Bodnar, City Clerk Jahn Voorde, Mrs. Kopola, Don Inks, Marty Wolfson, Jamie Loo of the Soufh Bend Tribune, and Kathleen Cekanski- Farrand, Council Attorney. Council Member Puzzello noted that members of the Committee included Council Members White, Varner, Kuspa and herself. Substitute Bill No. 4't-06 A ro riation: Council Member Puzzello called for a presentation on Substitute Bill No. 41-06 which would appropriate of $514,000 from the EDIT Fund # 408 and $70,730 from the Emergency Medical Fund # 288 for equipment for the Fire Station # 2 construction project and equipment. Fire Chief I-.other Taylor noted that the bids for equipment for the Fire Station No. 2 construction project came in higher than the initial appropriation. He therefore is asking for the amount of the City's shortfall. Chief Taylor stated that there would be two-bays for fire equipment, and a 3rd bay for water rescue. Public Works Director Gary Gilot stated that $514,000 would come from economic development income tax revenues. He noted that materials have skyrocketed since last year's hurricane season. He added that Memorial Hospital is contributing $1.2 million and $900,000 from city funds. The Council Attorney noted that Chief Taylor has brought to her attention that the title and the first paragraph refers to the "emergency management fund" and it should be the "emergency medical fund". She noted that since the fund numbers are correctly listed, that an amendment to the name of the fund would be classified as a scrivener's error and should be made to the Substitute Bill. Council Member Kuspa made a motion, seconded by Council Member Dieter that Substitute Bill No. 41-06, as requested to be amended by the Council Attorney, be recommended favorably to Council. The motion passed. July 24, 2006 Health and Public Safety Committee Meeting Page 2 Under miscellaneous business, Dr. Varner inquired about the proposed training site. Chief Taylor stated that he would prefer a separate meeting to address this topic. Council President Rouse noted that the Council Attorney has brought to his attention and Council Member White's that the amount of penalties which may be collected by the ordinance Violations Bureau has been raised from $'l44 to $254 effective July BSc The Councii Attorney stated that she has briefly discussed this matter with Councii Member White and suggested that current penalty provisions be reviewed. Council Member White would be addressing this topic in the near future.
