Persons in attendance included Council Members Puzzello, Professor Martin Wolfson, Citizen Member on the Community and Economic Development Committee, Bob Mathia and John Sellers, Community and Economic Development. Bill No. 26-06: An_nronriation HUD Shelter Plus Care Grant Program Fund #21.2 John Sellers, Community anal Economic Development Department presented. Councilmember Puzzello made a motion, seconded by Citizen Member Martin Wolfson to send this bill to the Full Council with a favorable recommendation. Bill No. 06-39; Tax Abateanaeut - 915 North Notre Dame Avenue -Thomas and Shannan Guinan Bob Mathia, Community and Economic Development Department explained the request for residential tax abatement for 915 N. Notre Dame Avenue. Councilmember Puzzello made a motion seconded by Citizen Member Martin Wolfson to send this bill to the Full Council with a favorable recommendation. Bill No. 06-40: Tax Abatement - 711 & 715 California Avenue -Near Northwest Neighborhood, Inc. Bob Mathia explained the request for residential abatement for 711 & 71 S California Avenue. Doug Merritt ofthe NNW Neighborhood Organization elaborated . Councilmember Puzzello made a motion seconded by Citizen Member Martin Wolfson to send this bill to the bull Council with a favorable recommendation. White at 3:3Q p.m. in the Council Informal Meeting Roam. Absent were Councilmember's Kuspa, Kirsits and Dieter. Persons in attendance were P.J. Thuringer, Area Plan Commission; Bernie Feeney Bill No. 1S-Q6 -Rezone -Various Properties Near Bosch Corporation P. J. Thuringer reported a favorable recommendation from the Area Plan Commission. Substitute Bill accepted Bernie b'eeney presented on behalf of the Bosch Corporation stating the rezone request was to allow parking on assembled lots. No recommendation due to the lack of a quorum. White, Member Zoning and Annexation Committee UTILITIES COMMITTEE 2006 Cvrnmvn Council The May 8, 2006 meeting of the Utilities Committee was called or order by its Chairperson, Council Member Al "Buddy" Kirsits at 3:55 p.m. in the Council Informal Meeting Room. Persons in attendance included Councilmember Puzzello, and Citizen Member Gene Pendle. Absent -Councilmember Kuspa Bill No 19-a6 Amend Code Chaucer 17,_Article 2, Division 5, Section i7-29 Addressing authorization to enter into special. rate contracts for Sewer Service Councilmember Kirsits made a motion that the public hearing on this bill be continued until June 12, 2006 at the request of the petitioner. Councilmember Puzzello seconded the motion. The motion passed. Pfeifer at 4:00 p.m. in the Council Informal Meeting Roam. Persons in attendance included Councilmembers Puzzello, White, Varner and Citizen Member Nikki Hutchinson. Absent: Councilmember Kuspa Bill No. 06-41 A rovin the Issuance of Scra MetaUJunk Dealers Licenses for Calendar Year 2006 for Rec clip A/KIA Greentech Transfer Gary Gilot, South Bend Director of Public Works explained the favorable recommendation of the BPW for the license application of Greentech Transfer to start & operate a transfer statian. Councilmember White made a motion, seconded by Dr. Varner that Bill No. 06-41 be recommended favorably to Council. The motion passed. Sill No. 29-06 -Amend Code Cha ter 2 Article 9 Human Ri hts Ordinance h the Inclusions of New Provisions Addressin Gender Identi and Sexual Qrientation. Cauncilmember Pfeifer explained the rules of presentation aimed at equal, fair, opportunities for those far and against. She also announced two additional meetings of the Personnel & Finance Committee to hear Bill 29-06, they being on 5-10-06 at 4:00 p.m. and 5-1~'-06 at 5:00 p.m. Presenting for was Catherine Pittman, 2628 Summit Ridge representing South Bend Equality. She did a power point presentation documenting empirically the incidence of discrimination by sex orientation and gender identity. Presently those discriminated for the above have no where to go for adjudication. It was suggested the Human Rights Commission was the natural agency to hear claims. The petition supporting 29-06 with 1256 signatures in support is given to clerk's office. Brad Lear of 1232 Longfellow and Robin Beck owner of an alternative lifestyle bookstore in the 100 Center continued the presentation. Mayor Luecke supported the creation of a new protected class and favored manadatory compliance. Penny Hughes, 1918 Southernview Drive, and a realtor for 27 years added support. Bill Eagan, 3204 Scarlet Maple Ct, voiced support. Opponents to 29-Ob Pat Mangan, 1919 S. Michigan Street, representing Citizens for Community Values and Sergio Co. Mangan describes his position as boring opposition to the homo agenda. He states the homosexual lifestyle is a chosen one with serious public health consequences. He claimed the recognition of a new protected class to be misguided, unconstitutional, and unenforceable. He states the courts to date only recognize protected classes as those having some immutable characteristic i.e. race, ethnicity. Homos, he says, choose their distinction. He maintained the creation of a transgender class would chill economic development. He asked the opportunity far more time.
