Subject: Professional Services Agreements Asbestos Inspection Reports for demolition — Ignition Park South Date: April 12, 2011 In the Ignition Park South expansion area, there are currently 41 properties with structures on them. Most of these structures are houses of varying sizes, some with other out buildings (garages, sheds, etc), and two with larger warehouse type buildings. Before demolition specs can be written for these structures, an asbestos inspection needs to be completed for each of them. To shorten the time frame to get this work done, these 41 properties were grouped by proximity to each other, and a Request for Proposal was sent to four environmental services companies. Based on the RFP's received, the three attached proposals were selected for Commission approval. With three companies working on the asbestos inspections, it will shorten the time needed to get the demo specs written, the demo's bid out, and ultimately clearing these properties. ACM will provide all labor, materials, and services to perform an asbestos containing building material survey to determine the absence or presence of asbestos containing building material (ACBM) within the buildings. MARYS, GEORGIA HOUSTON TEXAS sese���� >�s • , The inspection will begin with a review of the existing building records and drawings and will include a detailed inspection of all accessible areas. These areas include those that can be inspected through hatches, pop -up ceilings, and in open crawl spaces or pipe chases. It shall not be required to break through sealed walls, ceilings, floors or pipe chases in order to perform the inspection. The proposed inspection shall result in the identification and evaluation of asbestos containing building material (ACBM) observed. The inspection shall also evaluate the condition of ACBM so that a risk evaluation and priority for action can be developed in subsequent proposed tasks. Any suspect materials that cannot be definitely identified as asbestos through existing building records of asbestos inspections shall be scheduled for bulk sampling. 2. BULK SAMPLING ACM will conduct bulk sampling of all suspect asbestos materials. A minimum of 10 to 25 samples will be collected and analyzed per building. 3. LABORATORY All bulk samples will be analyzed by our in -house laboratory, which is accredited by the United States Environmental Protection Agency (US EPA) in accordance with 40 CFR, Part 763, Subpart F, Appendix A of the Asbestos Hazard Emergency Response Act (AHERA). Our laboratory achieved a perfect score in the US EPA Laboratory Quality Assurance Program. Our laboratory microscopists are graduates of the 5 -day program given by McCrone Research Institute. All bulk samples are analyzed under polarized light microscopes utilizing the US EPA's recommended "central stop dispersion staining" technique. Results include the type and percentage of asbestos fibers identified, non - asbestos fibers identified, and other non - fibrous materials, such as rocks, binder, filler, etc. Our laboratory's internal quality assurance program requires every 20" bulk sample analyzed be sent to an independent laboratory for comparative analysis. INSPECTION REPORT An inspection report will be generated per building identifying each homogenous material, noting the material type, location(s), condition, and whether or not asbestos was present. In addition, each sample site location will include an assessment sheet noting sample sites and laboratory analysis. Each entire building survey sample results will be summarized for easier data retrieval. All inspection repolls will be submitted to the South Bend Redevelopment Commission within 30 days of ACM's inspection start date. 5. RISK ASSESSMENT As a result of the inspection and bulk sampling tasks, ACM will assemble and document information on the relative degree of risk resulting from the types of ACBM and their condition. 6. INSPECTION SCHEDULE The anticipated on -site inspection time period is a maximum of five (5) days. Our current workload will require five days notice to proceed with the on -site work. 7. BULK SAMPLE ANALYSIS PROCEDURE Bulk samples will be analyzed utilizing the following methods to comply with Federal and State OSHA regulations. a. A minimum of one (1) bulk sample will be collected from each homogeneous material. b. Bulk samples will be analyzed for each homogeneous material until a sample is determined to be asbestos. c. If a bulk sample is analyzed and is determined to be ACBM, then the homogeneous material will be classified as such. d. If all bulk samples are analyzed and determined to be Non - Asbestos Containing Building Material (NON - ACBM), then the homogeneous material will be classified as such. 8. Although these regulations do not have jurisdiction over these buildings, they present a logical, comprehensive protocol for identification of ACM which gives accurate and reproducible results. Our protocol will incorporate the following definitions: • ALL: We will identify and classify all accessible materials. • ACCESSIBLE: Only materials which are accessible without penetration behind existing walls, floors and ceilings will be sampled; multiple layers on these surfaces will be sampled. • ASSUMED: Suspect ACM enclosed behind existing walls, floors and ceilings will be assumed to be the same material as those portions of the surface or similar surfaces which are accessible. Our scope of services under this Agreement does not include assistance during the design, bid procurement or construction phases of the project. We can provide these services on request for an additional fee once the results of the sampling under this proposal have identified the structures involved. Our normal scope for these additional services is as follows: • prepare technical specifications for asbestos abatement, to be incorporated into the Contract Documents for the project • review the contractor's procedures and operations for compliance with the Contract Documents and USEPA, IDEM and DOT regulations, to include: worker training, respiratory protection, equipment, containment barriers, EPA/IDEM notifications and waste material manifests • provide post- abatement inspection, for final release of each structure to the demolition contractor • provide documentation of the asbestos abatement activities to the Owner for record purposes COMPENSATION For providing this Scope of Services, Grauvogel & Associates will be paid on an hourly rate basis, in accordance with the following schedule, plus reimbursable expenses: Classification Hourl" `Raze Certified Industrial Hygienist $100.00 IDEM Asbestos Inspector /Planner $100.00 Certified Hazardous Materials Manager $100.00 Reimbursable expenses will consist of laboratory charges and sample shipping/handling charges. The number of structures takes into account any multiple structures at combined addresses, except as noted for warehouses. This fee will not be exceeded without prior written justification and approval. Analyses of samples for suspect asbestos - containing materials (ACM) will be invoiced at the stated unit costs. The number of suspect asbestos containing materials (ACM) per structure based on our previous experience with structures of similar size, age and construction is expected to average 6 by PLM per structure. This includes brittle, potentially friable Category II suspect materials. We do not anticipate the need to sample resilient Category I non - friable materials at this time (floor tile, asphalt roofing, sheet vinyl). Older linoleum consisting of two separable layers will be considered Category II and potentially friable if encountered. The actual number of samples needed will be determined in the field. It is not expected to vary greatly from the number quoted. The Commission will be billed for the actual number of samples collected. BASIS OF PROPOSAL The above pricing is based on the following assumptions: • Commission to provide ready access to each structure • Commission to assure that each structure is unoccupied Ready access includes keys or the typical chipboard or plywood sheeting over doors fastened with hex head or #2 square drive multipurpose screws. Locked doors either alone or underneath this sheeting are not considered "ready access ". IDEM allows the demolition of residences with non - friable Category I and II materials in place, except when intentionally burned. We propose to assume such materials to be ACM and document them as such, including their quantities, on the IDEM Notification and in our survey reports. Although it rarely occurs, severely water - damaged resilient flooring, normally a Category I non - friable material even for demolition, may be encountered and need to be classified as potentially South Bend Redevelopment Commission Ignition Park ACM Demolition Proposal — Revision 1 4/7/2011 Page 4 friable for demolition. The confirming analysis for this type of material is done by TEM at substantially greater cost. This analysis is not included in this pricing, and will be brought to the Commission's attention for action if need be. TIME OF COMPLETION from receipt of the formal Notice -to- Proceed to completion of the field survey -- 1 week from completion of the field survey until submission of the Survey Report and IDEM Notification -- 2 weeks This schedule includes the laboratory analysis time. We are normally able to schedule the field survey within 5 working days of the Notice -to- Proceed. BILLING and PAYMENT One invoice will be issued at the completion of the project. The survey of the property for ACMs will begin with a walk- through of the existing structures to document locations of friable and non - friable materials that may be present. Friable materials are those that can be pulverized or reduced to powder by moderate pressure, such as spray applied fireproofing and acoustical materials, ceiling tiles and most thermal system insulation. Non - friable materials are those that cannot be crumbled easily, such as resilient floor tiles and cement asbestos (Transite) board. Although emphasis is on detecting friable materials, the possible presence of non - friable ACMs must also be considered, as during renovation, non - friable materials may be pulverized or otherwise damaged so as to release asbestos fibers into the air. The sampling strategy for any suspect material is dependent upon the application, the area of coverage and the uniformity of the application. In accordance with the United States Environmental Protection Agency (USEPA) 40 CFR 763.83, Subpart E definitions, there are three (3) types of asbestos containing materials (ACMs): 1. Thermal System Insulation (TSI), 2. Surfacing Materials (S), and 3. Miscellaneous Materials (Misc). Thermal System Insulation is material used to prevent heat loss or gain and prevent condensation, and includes: pipe insulation, valve and fitting insulation, boiler system insulation, breeching insulation and tank insulation. Surfacing materials are spayed on, troweled on or materials otherwise applied to a surface and include: acoustical plaster, fireproofing on structural members or decking, or on surfaces for the purpose of fireproofing. Miscellaneous or "other" materials are those that are not characterized as Thermal System Insulation or Surfacing Materials, and include: ceiling tile, floor tile, roofing felt, cove base and associated adhesive or mastic. Each suspect ACM (i.e., TSI, S or Misc.) identified from the initial walkthrough of the facilities will be placed into a group of similar materials identified as a homogeneous area. Homogeneous areas are identified as materials of the same type, color, texture and estimated age of installation. Upon identifying homogeneous areas, representative samples will be collected on a random basis. The number of samples collected depends upon the type of material (TSI, S, Misc) and the amount of the material, in accordance with the following, based on OSHA regulations detailed in 29CFR 1926.1001). At any time during the survey, the Inspector can elect to assume that a specific material is asbestos containing, and thereby forego sampling requirements for that homogeneous area. Samples, as appropriate, will be collected in general conformance with the procedures outlined in the Asbestos Hazard Emergency Response Act of 1986 (AHERA). Sample collection will involve extraction /separation of approximately 1 to 10 cubic centimeters of the suspect material, inclusive of all layers present within the material. Only suspect material samples will be submitted for laboratory analyses. Samples will be sealed in airtight containers, numbered and labeled, and forwarded to an approved laboratory for analysis by the EPA recommended method of Polarized Light Microscopy (PLM) coupled with dispersion staining. Sampling and analysis of suspect materials is performed in an effort to try and confirm the presence of asbestos, or eliminate suspect materials as ACMs. Elimination of a material as ACM for purposes of maintenance, renovation or demolition occurs if: 1. the material is visibly non -ACM (fiberglass and rubberized materials), 2. documentation indicates that the materials used in manufacture are non -ACM, or 3. sampling and analysis are performed. According to OSHA Construction Standards, negative analysis for a minimum of three (3) samples is required to conclusively determine a material as being non -ACM. In addition, all of the samples must be from the same homogeneous area (color, texture and estimated date of installation). Wightman Petrie will attempt, through application of our sampling strategy, to make a determination of the asbestos content of any identified homogeneous materials for which sampling is in fact performed (i.e., certain materials may be assumed to be asbestos - containing). City of South Bend April 7, 2011 Page 4 of 5 COST INFORMATION AND SCHEDULE Wightman Petrie proposes to perform the Asbestos Surveys for the following fees: Field Services and Reporting $4,300.00 Laboratory Fees $2,000.00 Total Fee $6,300.00 Within approximately one (1) week of acceptance of this proposal, Wightman Petrie can begin our initial walkthrough activities. We would anticipate actual sampling activities to be completed over a span of approximately two (2) weeks. Laboratory analysis will be performed on a one (1) week turnaround from the time that the samples have been received by the laboratory. Wightman Petrie will provide the City of South Bend with a verbal summary of the results within two (2) days of receipt of all analytical data from the laboratory. A Letter Report summarizing the methods employed for the collection and analysis of samples, as well as estimated quantities and recommendations for additional actions, will be presented within two (2) weeks of the date of verbal debriefing. QUALIFICATIONS Wightman Petrie assumes that immediate access will be provided upon proposal acceptance. We have also assumed that the buildings will be vacant and that sampling efforts will be destructive in nature. Please note that our proposal does not include any costs for the rental of any scaffolding or hydraulic lift equipment to reach high ceilings or areas that would not be considered as readily accessible by ladder. Certain "conditions" may escape detection due to: 1. limitations in the scope of this assessment, 2. inaccuracy and /or limited availability of documentation made available to Wightman Petrie at the time of the survey, and 3. inaccessible areas. If this assessment includes a review of documents prepared by others, it must be recognized that Wightman Petrie has no responsibility for the accuracy of such information.
