Transfer of 3 properties to the Board of Public Works

On March 08, 2011, the Commission approved Resolution No. 2854, accepting 21
properties in the Ignition Park South expansion area from the Board of Public Works
(Board). These 21 properties will eventually become part of the Ignition Park PUD.
To complete the property transfers between the Commission and the Board, there are three
properties owned by the Commission that need to be transferred to the Board. Transferring
these properties to the Board will facilitate their eventual transfer to adjoining property
owners.
The two properties on Indiana Avenue are on the south side of Indiana, and not part of the
Ignition Park South expansion area. These two Commission owned properties are vacant
lots, and abut a vacant lot owned by the Board. It is expected these three vacant lots would
then be transferred to an adjoining property owner who would like them for his existing
business.
The lot on S. Michigan St currently has a structure on it. It was acquired by the
Commission on December 14, 2010. It is anticipated this property would be transferred to
the Center for Homeless.
Upon approval of this resolution, a resolution will be taken to the Board for its approval, and
deeds prepared so a formal transfer can occur.
Staff requests approval of Resolution No. 2866, to allow the eventual transfer of these
properties from the Commission to the Board.

RESOLUTION NO. 2866
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND
WHEREAS, the South Bend Redevelopment Commission (the "Commission "), the
governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ") and
of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District "),
exists and operates under the provisions of I.C. 36 -7 -14, as amended from time to time (the "Act ")
and is a body corporate and politic; and
WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board ") has
custody of and may maintain all real property owned by the City of South Bend, Indiana (the
"City ") pursuant to I.C. 36- 9 -6 -3; and
WHEREAS, the Department, by and through the Commission, wishes to transfer to the
Board certain parcels of land previously acquired by the Commission and more particularly
described at Exhibit A (the "Property "); and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and through the Board, may
accept transfer of property from another governmental entity upon terms and conditions agreed
upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of
each entity; and
WHEREAS, the Department, through the Commission, desires to transfer the Property to
the City and to authorize the staff of the Department to approve and execute quitclaim deeds
effecting the transfer of the Property; and
WHEREAS, it is contemplated that the City, through the Board, will adopt a resolution
consistent with the requirement of Indiana § 36-1 -11 -8; and
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION AS FOLLOWS:
1. The transfer of the Property described at Exhibit A situated in St. Joseph County,
Indiana, by the South Bend Redevelopment Commission, to the Board of Public Works, for and on
behalf of the City of South Bend shall be, and hereby is, approved.
2. The staff of the City of South Bend, Department of Redevelopment shall be, and
hereby are, authorized to approve the form of and execute quit -claim deeds or any other
instruments necessary to convey all of the right, title and interest in the Property to the City of
South Bend pursuant to the terms and conditions evidenced by this Resolution.
3. This Resolution shall be in full force and effect upon its adoption by the Board and
upon the adoption of a substantially similar resolution of the Board. The transfer of the Property
shall not be effective until deeds are duly recorded effecting the same.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on April 12,
2011, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
