A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
EXPANDING THE BOUNDARIES OF THE SOUTH BEND CENTRAL
DEVELOPMENT AREA, EXPANDING THE ALLOCATION AREA FOR PURPOSES
OF TAX INCREMENT FINANCING AND AMENDING THE DEVELOPMENT PLAN
FOR THE SOUTH BEND CENTRAL DEVELOPMENT AREA
WHEREAS, the South Bend Redevelopment Commission ( "Commission "), governing body
ofthe City of South Bend Department of Redevelopment ( "Department "), on May 10, 1985, adopted
Resolution No. 737 declaring the South Bend Central Development Area in the City of South Bend,
Indiana ( "City ") to be a blighted area within the meaning of the Redevelopment of Cities and Towns
Act of 1953, as amended, I.C. 36 -7 -14 ( "Act "); and
WHEREAS, Resolution No. 737 and the South Bend Central Development Area
Development Plan ( "Development Plan ") adopted by Resolution No. 737 on May 10, 1985, were
confirmed by Resolution No. 739 adopted on June 14, 1985; and
WHEREAS, Resolution No. 737 was amended by Resolution No. 745, adopted on August
9, 1985 and confirmed by Resolution No. 750, adopted on September 30, 1985; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 751, adopted on
November 8, 1985 and confirmed by Resolution No. 757, adopted December 20,1985; and
WHEREAS, Resolution No. 737 was farther amended by Resolution No. 795, adopted on
February 27, 1987, and confirmed by Resolution No. 798, adopted on April 10, 1987; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 800, adopted on
April 24, 1987, and confirmed by Resolution No. 803, adopted on June 26, 1987; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 834, adopted on
March 11, 1988 and confirmed by Resolution No. 836, adopted on April 15, 1988, and said
resolutions expanded the South Bend Central Development Area by adding Expansion Area No. 1;
and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 867, adopted on
February 10, 1989, and confirmed by Resolution No. 874, adopted on March 24, 1989; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 881, adopted on
July 28, 1989; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 893, adopted on

October 27, 1989 and said Resolution No. 893 expanded the South Bend Central Development Area
by adding Expansion Area No. 2 and Expansion Area No. 3; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 921 adopted on
March 23, 1990; and
WHEREAS, Resolution No. 737 was further amended by Substitute Resolution No. 944
adopted on July 27, 1990; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 974 adopted on
January 25, 1991; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1019 adopted on
October 11, 1991; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1077 adopted on
July 24, 1992; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1205 adopted on
January 4, 1994; and

February 18, 2000 and said Resolution No. 1737 expanded the South Bend Central Development
Area by adding Expansion Area No. 4;
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1758 adopted on
July 7, 2000: and

August 4, 2000; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1843 adopted on
September 7, 2001; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1901 adopted on
September 6,2002; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1922 adopted on
December 6, 2002; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1952 adopted on
March 7, 2003; and
WHEREAS, Resolution No. 737 was further amended by Resolution No. 1973 adopted on
June 6, 2003; and
WHEREAS, Resolution No. 737 was further amended by Resolution No.2001 adopted on
October 3, 2003; and said Resolution No. 2001 expanded the South Bend Central Development Area
by adding Expansion Area No. 5; and
WHEREAS, Resolution No. 737 was further amended by Resolution No.2014 adopted on
December 19,2003; and said Resolution No. 2014 expanded the South Bend Central Development
Area by adding Expansion Area No. 6; and
WHEREAS, Resolution No. 737 was further amended by Resolution No.2015 adopted on
December 19, 2003; and said Resolution No. 2015 contracted and reduced the South Bend Central
Development Area by removing Reduction Area No. 1 and defined the South Bend Central
Development Area as follows:
Beginning at the point of intersection of the South right -of -way line of Sample Street with
the West right -of -way line of Michigan Street; thence North along said West right -of -way
line of Michigan Street to its intersection with the Northerly line of the Conrail Railroad
(formerly Penn Central) right -of -way; thence Northwesterly along said Northerly railroad
right -of -way line to its intersection with the Southerly projection of the West right -of -way
line of Taylor Street; thence North along said West right -of -way line to its intersection with
the Westerly projection of the North right -of -way line of vacated Monroe Street; thence East
along the said projected right -of -way line to the intersection with the East right-of-way line
of Taylor Street said point also being the Southwest corner of Lot 16, Block 7 of Vail's

WHEREAS, Resolution No. 737 was further amended by Resolution No. 2029 adopted on
February 20, 2004; and
WHEREAS, in accordance with the Act, the Commission desires to amend Resolution No.
737 by expanding the South Bend Central Development Area to add the following described area
hereinafter referred to as "Expansion Area No. 7" in order to facilitate and enhance the replanning
and redevelopment of the South Bend Central Development Area, which Expansion Area No. 7 is
more particularly described as follows:
Beginning at a point that is 66 feet North of the North right -of -way line of Washington Street
and is on the centerline of the first alley East of Hill Street; thence East to the East right -of-
way line St. Louis Boulevard; thence South along said East right -of -way line to the North
right -of -way line of Washington Street; thence East on said North right -of -way line to the
East right-of-way line of the first North -South alley East of St. Louis Boulevard; thence
South along said East right -of -way line to the South right -of -way line of the first East -West
alley South of Washington Street; thence West along South right -of -way line of said alley
to the centerline of the first 14 -foot North -South alley lying East of Hill Street; thence North
along said centerline to the point of beginning and containing 2.97 acres, more or less; and
WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or
plan in a way that enlarges the boundaries of a redevelopment area by not more than twenty percent
(20 %) of the original redevelopment area or adds one (1) or more parcels to the list of parcels of
property to be acquired; and
WHEREAS, consistent with the Act, the Commission has previously caused to be prepared
certain maps and plats of the South Bend Central Development Area, and has supplemented said
maps and plats of the South Bend Central Development Area by causing to be prepared additional
maps and plats depicting a blighted area that is located adjacent to the South Bend Central
Development Area and heretofore referred to as "Expansion Area No. 7 "; and
WHEREAS, said maps and plats of the South Bend Central Development Area and
Expansion Area No. 7 show the boundaries of said areas, the location of the various parcels of
property, streets, alleys and other features affecting the acquisition, clearance, replatting, replanning,
rezoning or redevelopment of said areas and parts of the areas that are to be devoted to public ways,
levees, sewerage, parks, playgrounds and other public purposes under the plan for redevelopment
of the South Bend Central Development Area and Expansion Area No. 7 as described above; and
WHEREAS, the Commission desires to further amend Resolution No. 737 by expanding
the South Bend Central Development Area to include Expansion Area No. 7 in order to facilitate and
enhance the replanning, redevelopment and disposition ofproperty within said combined areas; and
WHEREAS, the South Bend Central Development Area as expanded by Expansion Area
No. 7 shall hereinafter be referred to as the "South Bend Central Development Area "; and

WHEREAS, the Development Plan for the South Bend Central Development Area as
adopted by Resolution No. 737 includes a list of parcels of property to be acquired within the South
Bend Central Development Area in order to accomplish the Development Plan; and
WHEREAS, there was also presented to this meeting of the Commission for its
consideration and approval a proposed amendment to the South Bend Central Development Area
Development Plan ("Plan") entitled "Amendment to the South Bend Central Development Area
Development Plan, Expansion Area No. 7" ("Amendment"), which said Amendment is attached
hereto and incorporated herein as Exhibit "A"; and
WHEREAS, the Amendment to the Development Plan sets out the boundaries of the
Development Area and further identifies the types of redevelopment projects and purposes to be
undertaken n the Development Area; and
WHEREAS, the Development Plan as amended herein is entitled the "South Bend Central
Development Area Development Plan" dated November 5, 2004 and, the Development Plan as
amended herein shall be hereinafter referenced as the "Development Plan"; and
WHEREAS, the Development Plan has been revised consistent with the proposed
amendment herein and has been considered by the Commission at its meeting; and
I* WHEREAS, the Development Plan as amended consists of a typewritten document
comprised of 9 pages plus modifications, 2 attachments and 1 exhibit; and
WHEREAS, Section 39 of the Act permits the creation of an allocation area within a
blighted area to provide for the allocation and distribution, as provided in the Act, of the proceeds
of taxes levied on property situated in the allocation area; and
WHEREAS, the Commission in accordance with the Act, has previously established the
South Bend Central Allocation Area; and
WHEREAS, the South Bend Central Allocation Area as expanded has been designated the
"South Bend Central Allocation Area No. IA"; and
WHEREAS, the Commission, in accordance with the Act, has previously both expanded and
contracted the boundaries of the South Bend Central Allocation Area No. 1A to include:
Expansion Area No. I by the adoption of Resolution No. 834, adopted on March 11,
1988; and
Expansion Area No. 2 and Expansion Area No. 3 by the adoption of Resolution No.
893, adopted on October 27, 1989; and

0 Expansion Area No. 5 by the adoption of Resolution No. 2001 adopted on October
3, 2003; and
Expansion Area No. 6 by the adoption of Resolution No. 2014 adopted on December
19, 2003; and
Reduction Area No. 1 by the adoption of Resolution No. 1215 adopted on December
19, 2003; and
WHEREAS, South Bend Allocation Area No. I does not include Expansion Area No. 4
as described and approved in Resolution No. 1737 adopted on February 18, 2000; and
WHEREAS, the Commission now desires to further expand the boundaries of South Bend
Allocation Area No. 1 to include that area heretofore referenced as "expansion Area No. 7; and
WHEREAS, the South Bend Allocation Area No. lA as expanded to include Expansion
Area No. 7 as described above shall be hereinafter referenced as the "South Bend Allocation Area
No. 1 A "; and
WHEREAS, Section 17.5 of the Act provides for a public hearing to be held by the
Commission, at which public hearing all persons interested in the proceedings and who have filed
timely written remonstrances may be heard; and
WHEREAS, the Commission has complied with the notice provisions of Section 17.5 ofthe
Act; and
WHEREAS, at the public meeting held by the Commission on the 5th day of November,
2004, at 10:00 a.m., Eastern Standard Time, at 1308 County -City Building, South Bend, Indiana,
the Commission has reviewed the maps and plats and proposed amendments and heard all persons
interested in the proceedings and received and considered P written remonstrances and objections
and other such evidence presented.
THE COMMISSION HEREBY FINDS THAT:
(i). The proposed amendment to Resolution No. 737 to include Expansion Area No. 7
is reasonable and appropriate when considered in relation to Resolution No. 737 and
the purposes of the Act.
(ii). The proposed amendment to the South Bend Central Development Area
Development Plan is reasonable and appropriate when considered in relation to the
Development Plan and the purposes of the Act.
(iii). Resolution No. 737, as amended herein, conforms to the comprehensive plan for the
0 city.
(iv). The Development Plan, as amended herein, conforms to the comprehensive plan for
the City.
NOW, THEREFORE BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF
SOUTH BEND DEPARTMENT OF REDEVELOPMENT, AS FOLLOWS:
(1). The South Bend Central Development Area is hereby expanded to include
Expansion Area No. 7 as described in the 32 °d WHEREAS clause above.
(2). The South Bend Central Development Area, as expanded herein to include Expansion
Area No. 7 shall be hereinafter known as the "South Bend Central Development Area" and
is more particularly described as follows:
Beginning at the point of intersection of the South right-of-way line of Sample Street
with the West right-of-way line of Michigan Street; thence North along said West
right-of-way line of Michigan Street to its intersection with the Northerly line of the
Conrail Railroad (formerly Penn Central) right-of-way; thence Northwesterly along
said Northerly railroad right-of-way line to its intersection with the Southerly
projection of the West right-of-way line of Taylor Street; thence North along said
West right-of-way line to its intersection with the Westerly projection of the North
right-of-way line of vacated Monroe Street; thence East along the said projected
right-of-way line to the intersection with the East right-of-way line of Taylor Street
said point also being the Southwest comer of Lot 16, Block 7 of Vail's Southwest
Addition to the City of South Bend; thence North along the said East right-of-way
line to the intersection with the center line of the first 14-foot vacated alley lying
North of vacated Monroe Street; thence East along the said center line to a point on
the said center line that is 93.00 feet west of the East right-of-way line of Williams
Street; thence South parallel with the West right-of-way line of Williams Street,
114.00 feet; thence East 93.00 feet to a point on the East right-of-way line of
Williams Street, said point being 8.00 feet South of the Southwest comer of Lot 6,
Block 8, of said Vail's Southwest Addition and thebeginning ofthe vacated Williams
Street to the South; thence North 8.00 feet along the East line of Williams Street to
the said Southwest comer of Lot 6, Block 8; thence East along the South line of said
Lot 6, Block 8, to the Southwest comer of Lot 6, Block 8; thence Southeasterly to a
point on the East line of Lot 31 of said Vail's Southwest Addition, said point being
25.00 feet North of the Southeast comer of said Lot 31; thence South along the East
line of Lot 31 to the North right-of-way line of vacated Monroe Street; thence East
along the North right-of-way line of said vacated Monroe Street to its intersection
with the southerly projection of the centerline of the first 14 foot alley lying West of
Lafayette Boulevard; thence North along said projection and the centerline of said 14

land within the Area as shown on page 22(Z) of the Development Plan attached hereto as
Attachment I to Exhibit "A" and incorporated herein.
(10). It is estimated that the cost of acquisition and redevelopment of the properties
being added to the acquisition list is $25,000.
(11). The Development Plan is amended at page 22(Z) as shown by the page attached
hereto as Attachment I to Exhibit "A ", and is hereby in all respects approved.
BE IT FURTHER RESOLVED that all other findings, determinations and conclusions
in Resolution No. 737, as amended from time -to -time, shall remain as stated therein.
BE IT FURTHER RESOLVED that the United States of America is hereby assured of
full compliance by the South Bend Redevelopment Commission with regulations of the
Department of Housing and Urban Development ( "HUD ") effectuating Title VI of the Civil
Rights Act of 1964, as amended.
BE IT FURTHER RESOLVED that the Secretary is hereby directed to file with the
Office of the Recorder for St. Joseph County, Indiana a certified copy of Resolution No. 2105,
the Development Plan, as amended, with the minutes of this meeting.

0 1.0 INTRODUCTION
Considerable economic growth is occurring at the east central boundary of the Development
Area. Further economic growth will be stifled if room for development is not approached in an
integrated and coordinated fashion. In order to assure that such growth occurs it is necessary to
expand the eastern boundary of the Development Area. The area to be included as Expansion
Area No. 7 contains several parcels that are vacant and others that contain residences, rental
housing, surface parking lots, offices and commercial /light industrial activities. Expansion Area
No. 7 consists of a total of 15 property parcels. Inclusion of the parcels in the Development Plan
will permit development to grow along the eastern border in an orderly fashion and in a timely
manner. Not including Expansion Area No. 7 in the Development Area could force entities in the
Development Area to look elsewhere outside the Area. This, in turn, would negatively impact
efforts by the City and the Commission to achieve the goals and objectives of the Development
Plan.
2.0 DEVELOPMENT PLAN GOALS/DEVELOPMENT PLAN OBJECTIVES
The goals and objectives as described in the South Bend Central Development Area
Development Plan as amended will be followed in Expansion Area No. 7. More specifically the
Development Plan Objectives as listed for the East Bank shall be applied to Expansion Area No.
7.
3.0 OTHER PROVISIONS AND REQUIREMENTS OF THE DEVELOPMENT PLAN
Expansion Area No. 7 shall be included as part of Area G as described in Sub - section IR.A.2.b of
the Development Plan All other provisions and requirements of the Development Plan shall be
followed. Any deviations or exceptions where permitted within the Development Plan will be
approved by the Redevelopment Commission.
4.0 LIST OF PROPERTIES TO BE ACQUIRED
A list of properties to be acquired as a component of this plan amendment is contained in
Attachment I to this Exhibit.

C. Development Plan Goals
The overall goal for the Area is to achieve the economic revitalization and physical
redevelopment of the Area as an attractive, exciting, unique and viable urban center for people,
businesses, and institutions. Related to this goal are various sub - goals:

1. To make the Area a multi -use regional center for North Central Indiana and South Central
Michigan for business and consumer services, specialty retail, governmental and medical
services, cultural, entertainment, recreational, and convention uses.
2. To strengthen the residential component of the Area by increasing the number and type of
middle income housing units.
3. To increase the level of private investment and reinvestment in the Area.
4. To increase both the personal and real property tax base within the Area.
5. To retain and increase jobs within the Area by retaining and attracting both consumer
service, business service and light industrial uses.
G. To increase the functions and facilities within the Area to make it an attractive and
competitive area for living, working, and recreation.
7. To enhance and strengthen the various linkages between the Central Business District,
East Bank and Monroe Park.
to 8. To create the physical and organizational environment that will facilitate and enhance the
phase -in of private resources and the phase -out of extraordinary public investment.
9. To make the old and new buildings, facilities, and public improvements work together to
enhance the uniqueness and attractiveness of the Area.
